He is looking at the big picture and long term effect on the Department. Otherwise he would be acting just like Barr, only concerned about his own motives. Powerful move

Garland is holding on to his right to appeal. Not appealing could hinder the next time he wants to appeal. It is a game he is forced to play even if he doesn't want to! This is why his appeal is worded the way it is. Garland knows the appeal will lose, but it maintains his ability to do so in the future!
