She is incorrect on the question of traditional systems versus the constitution. Clearly, she is not an authority on intricacies of the traditional African systems as found in South Africa. The systems are not homogenous throughout the country. For example, Bakgatla ba Kgafela in north west got rid of their king because he entered into a mining deal with Anglo-American group without community mandate. On the second point about constitutionalism. It would be wrong and ahistorical to focus on the adoption of the progressive constitution without understanding its location within the broader anti-colonial efforts. This constitution is the product of more one century of the battle by African lawyers who used the law as an instrument of anti-colonialism. Leading lights like George Montshiwa, Mangena, Seme, and many others were lawyers. People like Professor ZK Mathews, Anton Lembede, Godfrey Pitje were lawyers and anti-colonialist who grapple with not only liberty, but were seeking a constitutional blueprint for post colonial era. In addition, Professor Matthews spearheaded the drafting and the adoption of the Freedom Charter. The latter contributed immensely in the drafting of our current constitution. Outstanding lawyers such as Tambo, Nokwe, Mandela, Bezos, Chaskalson, Langa, Moseneke and more also played a pivotal role in a push towards a constitutional order. All these were happening while the so-called white liberals were promoting qualified franchise as opposed to the much more egalitarian systems epitomised by our current constitution.
