Apparently the 4th Amendment, "that prohibits unreasonable searches and seizures" is null and void, for those Americans that live within 100 miles of any border. I may have missed that part in the Constitution. As I approached this checkpoint in South Texas I had only intended to film the area and document the absurdity of it, but as I pulled into the cattle line I could not resist the urge....

the issue isn't whether or not the checkpoints are legal or not, they are, the issue is whether you need to cooperate with federal agents and answer their questions, such as the "are you a US citizen" one, and the answer is NO, you are not under any legal obligation to answer any questions or consent to any searches

I just went through a border checkpoint last Thursday afternoon in an enclosed Uhaul truck. The agent smiled
and asked me what was I carrying. I replied; just household stuff. Her reply; have a nice day. I didn’t say; it’s none of your business or anything derogatory like that. You always end up in trouble when you become confrontational. It’s just amazing as to why & how people don’t understand that concept. It’s not rocket science.

They are really just drug checkpoints, which is efficient as the dogs can sniff out drugs without physically searching your car. They say the dogs can search for hidden people as well but it just so happens that the dogs always seem to be designated as drug sniffing dogs. Ok, maybe the dog can do both, but even if they can, a concealed person does not mean an illegal alien. If you had a search warrant it would have to state what is being searched for (illegal alien). So if the dog found a concealed person who lets say had warrants out on him, that person would not be arrested. It they did arrest him, it would be thrown out of court and the person would go free do to an illegal search and seizure.
So why is it admissible at an immigration checkpoint to arrest a concealed person who is not an illegal alien? Because they don't care about illegals. They are looking for drugs and other crimes to arrest people for. Thus circumventing the Supreme Courts decision that these other check points are unconstitutional.
So if you are so naive that you believe the dogs are there for illegals you really are gullible (and stupid). It also means you are one of the people who have made it so easy for our government to take the power away from the people. This is one of the more respectful instances of a citizen attempting to exercise rights in this type of situation that I've seen on UA-cam. The average citizen wouldn't be aware of the case law surrounding that particular statute, but the average citizen would have expectations about the constitutionality of any kind of detention without probable cause. Unfortunately it's not the respectful encounters that end up in front of judges, so I'll bet case law gets tarnished by the people who flee, fight or obstruct. I support anyone who politely protests an obvious constitutional grey area in this way.

There is a huge difference. By enforcing policy, they can also enforce arbitrary rules and policy changes that aren't passed by Congress or voted on by citizens

It is unlawful to detain a person longer for refusing to answer their questions, yet they have him move from the primary checkpoint inspection area because he lawfully refused to answer their questions.

group 1: why are you threatened by a peaceful refusal to comply with questioning about citizenship? yes, it is easy to answer YES to the citizen question. I used to travel between El Paso and Holloman AFB weekly. I also traveled between Las Cruces NM and Holloman AFB weekly.
The one and only road had border patrol stops at points between both cities.
The first few times driving through the stops were amusing and enlightening. The questions generally were:
Are you a US citizen? [yes]
Where are you going? [Holloman]
Where are you coming from? [El Paso, or Las Cruces]
Whats your business at Holloman? [classified]
Are you in the military? [no]
Who is your commanding officer? [Again, I'm not in the military. I don't have a C/O]
What was your business in Mexico? [never said i was in mexico]
and more than once, "pull over to secondary, we need to search your vehicle to make sure you don't have any other passengers hiding in your vehicle."
I drove a corvette convertible.
They would ask me to open the trunk AND the engine compartment.
They would bring out the dogs to check for illegals hiding under the car...or in the wheel wells...or...?
After a few 30-45 minute 'inspections' in 105+ degree heat, I did some research. I read the 'LAW'. I also read the supreme court decision regarding immigration stops. It is legal for the govt to have stops in the middle of the desert with a defined mileage from a border.
It IS NOT LEGAL for them to ask for anything other than citizenship. They don't have the 'right' to check under the hood, or under the car, or the wheel wells of my corvette. They DON'T have the right to check for drugs, weapons or any other contraband.
So...I became a proponent of group 2.
Things went a little differently.
Are you a US citizen? [I invoke my right under the 5th amandment and refuse to answer all questioning without my attorney being present]
Where are you going? [silence]
Where are you coming from? [silence]
Sir, are you a US citizen?
More 'agents' are called over and they surround my car...dogs...guns in the 'ready position...]

I did not give in. I complied with their directive to move my vehicle out of the traffic lane. I put my top up, rolled the windows up and turned the ac AND radio up. I ignored them.
Someone would come over and bang on the window or door to try to get my attention.
They would yell threats about breaking the glass and pull me out.
They yelled that they would call the state PD and 'have me arrested'.
I ignored them.
And amazingly enough, after they ran my FLORIDA tags, somehow they determined that the driver must have been a US citizen and not a threat to the desert.
This happened at one or the other location for about a year. Total time spent each time DIMINISHED. I rarely saw the same 'agent' more than once.
The point?
I complied and was treated like a suspect in a major criminal investigation.
They wasted my time as well as theirs.
We all spent 30-45 minutes in the desert heat and were miserable.

As a retired Border Patrol Agent and a Border Patrol Academy Instructor I must say the following - Agents can stop you until they determine alienage. At this point, the onus is on the BP to establish the subject is an alien. Based on the subjects apparent mastery of the English language and the apparent absence of any other occupants, and I'm assuming a negative canine alert (checkpoints tend to have a dog performing a "sniff" as they approach primary inspection) there is no apparent reason to detain this vehicle. A simple "thank you have a nice day" would have been more appropriate.

I did exactly that at the checkpoint on I-19 coming out of Nogales, AZ.
Though I wound up never answering their question, I got a ticket for obstructing traffic, which I fought and lost.

These seem like they would get really annoying having to go through them for the fastest route to your destination. Why do the agents even ask the question if all they really do is check the car out when it stops? It is like asking a cop or politician if they are corrupt. You will only get one answer to the question every time.

What people don't understand is that even by arguing and thinking they're smart, they are giving the agent all they need. The answers to the questions are irrelevant. The purpose is to engage the citizen in normal conversation to listen for English speaking abilities. At the same time, the agent is scanning the vehicle visually and making nonverbal observations of the citizen's actions. The dog is most likely conducting a free air search at the same time. You don't realize how much information is being gathered and exchanged during this brief interaction. The combination of all these factors determine if the agent waives you through or socandaries you for further inspection.
