Technically, the phone has been stolen. Which still makes you the legal owner, I would give the IMEI number to the authorities and have the phone blocked and terminated. If possible, have its location traced and track down the scambag. Don't let this rest until its resolved.

Honestly..... You are out the $$$ / phone.. From what i've read phones are the highest category of scams. I just got screwed on a phone sale as well mine was just a low price phone though. You have all their info, order him MASS food to be delivered all around the same time multiple times. Post ads on craigslist etc etc.. He screwed you can just hassle the piss outta him.

eBay automatically takes the money from your PayPal account as soon as the tracking number states you received the return item. It doesn't matter what the item actually is, as long as the seller received "something" back via tracking number.
I feel your pain Shining Polaris, when i first started selling on Ebay i was scammed out of thousands of merchandise from those using a fake Pay Pal site, I learned the hard way and believe me, it doesn't feel good when you realize you've been scammed, but you learn quickly and watch more closely. I just buy now off Ebay sometimes, no phones because I'm in video production and need production equipment on the cheap and I never by foreign or overseas, I tried that twice and never got my product. Good luck to you in the future, chock this up to a loss and move on with greater awareness and understanding how this system works, On big ticket items try selling local on craigs list, always worked for me.
I live in the UK and sold a lot of Laptops/Tablets on Ebay and I have never come across so many stupid buyers before, only on Ebay. I was taken for several scams, the same as yours, and EBay could not care less. When I tried to explain what the buyer sent back was not what I sent to them, they told me “prove it”, which I could not. I stopped selling lots of Laptops/Tablets and only have about 4 left, plus some model railway items. As soon as they sell I will not be selling on eBay anymore. Buyers are gods on ebay, for some reason Ebay removed all power from the seller, to include leaving negative feedback. If all buyers stopped selling on ebay they would soon change their attitude, but that will never happen.
Honey I feel so bad that you got scammed I did see another youtube video of a engine rebuilder who was scammed by him from paypal and american express he filed a police report against him for wire fraud and drove with one of his employees to his home and meet the local police there and got his engine back love your ebay products like the belt I bought from you it is so lovely your ebay prices are very good very good quality take care my friend
The best advice I can give you is put it as NO RETURNS then the person cant request one...ive been scammed a couple times like this too so I just shut down my ebay.
Ebay is a scam, most of time, fyi always record imei numbers are serial numbers of items you sell on ebay and even take pictures, also take pictures of packaging you sent the item in, that way you got proof, cause if they send you something different you can go back and show paypal and you get money back, thats always worked for me as a seller on ebay.

A class action lawsuit against eBay from sellers should be an easy way to force eBay to fix the problem or shut down. eBay should not be in the business of giving warranties on sellers products. That's between the seller and the buyer. You experienced the reason why i NEVER buy or sell through eBay. Always in person, locally through Craigslist, if at all. Put it this way I was buying and selling on eBay for along time but I was disgusted when I seen what happened to you and eBay let it go they used to do investigations report the buyer to eBay as well it helps let people know we are on guard and watching what's happening because there is alot of sellers which we should be watching and helping each other as friends just because we are doing the same thing on eBay doesn't mean we have to be enemy's of each other we are on there to make money not to be ripped off by unscouprilous people
Try calling ebay more than once. There are more than one customer service person and you will probably get a different person. Also ask to talk to their supervisor or their supervisor. Keep going up the ladder. This pissed me off. I am glad I only sell stickers and stationary. I trade in my electronics at great loss out of fear of stuff like this.
I just had someone claim there was an issue with a nikon d610 i sold him. Long story short he couldnt provide sufficient proof and i won the case. The biggest thing as a seller is to document everything, When a case is filed you have to write to the buyer in a civalized manor with the facts and ebay will review your coments. Just make sure you know your facts and stand behind them with ebay. If you get a ebay rep that wont help ask to speak to his manager.

Scammers are everywhere, you should always be very careful with buyers that are very impatient and this loser will get his one day. I have dealt with a lot of scammers myself and the worst ones were the ones from Nigeria, coming with sob stories to trick the sellers in to sending items to Nigeria. It sucks that eBay always sides with the buyer, even if the buyer is clearly a scammer. I had to deal with one a few weeks ago. The buyer I met was impatient and was asking where his order is, even though it was only 1 day since he had paid. I sent him a brand new Xbox One controller and when he received it, he opened a case without even contacting me, claiming that the item is defective. I was forced by eBay to pay return postage and upon arrival, I tested the controller and it was fully working. I called eBay and they didn't do shit to solve the problem, instead they said they will keep him under their radar, as if. So in short, I lost money sending it, I lost the case, I lost money so that the buyer could return the item and on top of it all, I got a strike on my account for selling defective items as new. This was a low blow from eBay and put my account in jeopardy. Stuff like this makes me want to boycott eBay and become part of anonymous and DDoS the shit out of eBay. They are forgetting that without their sellers, they are worthless. The seller is the backbone of eBay and this is how eBay treats the sellers. I am leaving them soon, switching over to Amazon, not sure if it is any better. Anyway, I hope karma kicks this douche bag in the balls one day.
i know how you feel i had a bicycle guy scammed me ones out of bicycle parts in my city where i ended up losing the same amount of money you did cause when i tried to sell my full specialized bike to him he tried to scam me 250 when my bike was worth 1,000 but i am sorry about your loss for what this guy did to you since i did learn my lesson as well cause when i tried to sell my bike on ebay i was just glad i didn't since i know people in the world can be fake like this guy was to you
i disagree about persons who anxious about having there items shipped out as something is wrong. i bought two LG e980 and i was very anxious about getting them bcuz i know of people who buys item and have not gotten them to this day. also some person wait too long to ship the item so that the return time is minimize. buyers arent the only one that scam the first Lg e980 i bought the seller stated that the phone dropped and that is why the screen stop working and when got the phone and change the screen and it still was not working i took it to a technician who found that it was water damage. im always anxious when buying phone cuz phone aint cheap where im at
Hi there, I too am an eBay seller bro, lol this is why I stopped selling high priced items on eBay. The only way to win a case such as yours is to annoy eBay even before the item has been returned. Get a reference number and everything you need for when you are able to escalate the case, call about 10 times and get as many reference numbers as you can. For as you said, eBay is always going to side with the buyer. Even after a buyer is banned, he can open a new account and keep scamming, eBay won't do anything unless it's a seller. The recording of the package opening was a smart move, but of course eBay won't even look into it... Looking at your scammers info, it seems he fixes iPhones...well it seems he tried and failed. Then decided to scam someone instead of buying a new phone. Typical scam that happens on Amazon too. Amazon on the other hand doesn't even help sellers, they'll just refund seeing that the buyer provided a tracking number... Anyways, thanks for sharing bro. Sorry you fell into this scam, the "have you shipped" was a dead giveaway.

I purchased a galaxy S 4 from a gug on craigslist. Met up and he said the phone was stuck in assistive touch mode. I knew how to do it so it wasnt a problem. Phone looked good and i made the purchase. 150 bucks. Got in my truck to put my sim card in and no network. Plugged it in to the charger and no connection. Contacted the guy and he wouldnt answer. Texted him and nothing. I filed a report and police havent done anything. So i took it apart thinking i could fix it. No. The phone itself was supposed to be a AT&T phone. The screen was a Verizon screen and the hardware was AT&T. So the cable from the digitizer to the main board was too long. Resulting in a crushed cable with crushed other cables and the antenna cable was pinched. All in all the screen was a replacement and the guy didnt know what he was doing and i got scammed hard.
I hate the new policy on eBay, no protection for sellers. Even for reviews, buyer can leave a positive or negative review but seller can only leave a positive review
I'm not saying that you're wrong for being upset, but you shouldn't name the user who you sold this to. Legally that is considered defacement of character. If you would take him to court, he could void your case because you've been defacing his character publicly.
Not to mention the fact that he could take you to civil court for harassment and defacement. You should keep your nose clean. If you have a legitimate case, don't risk ruining it.

I would never sell electronics on Ebay, because a few years back I sold some jewelery to a buyer in Europe, and of course they scammed me, and I was out money and the item. I stopped selling outside the country after that. Strictly do craigslist only or FB, and meet the person and cash only transactions.
Can't you report the phone's IMIE as stolen? Whenever I sell a phone on eBay I take a pic of the phone's IMIE number, so if I get scammed I can have the phone deactivated.
I know just how you feel! I sold a an expensive camera on ebay. The guy got it and said there was a problem with the zoom lens. I told him the problem he was describing was impossible. He insisted it was. I contacted Canon, the camera manufacturer and they also told me that what he was telling me was impossible. Anyway, long story short, I sent ebay the letter from Canon and they said they'd send it to arbitration. Few days later ebay said they decided in the buyers favor. I asked how they decided and they hung-up on me. Guy sends the camera back and it works great. I sold the camera privately and screwed ebay out of the money. Can't use ebay now but who gives a crap. And I had sold hundreds of items on ebay and never had one negative feedback. SCREW EBAY !
Can you not report the phone stolen with the service provider? In Canada when the ESN is reported stolen the phone cannot be activated on the network. I realize its late now but just come across your video.
JusstyteN my partner just said same lol. I'm watching this video because someone just scammed me on eBay for £35. Annoying that eBay always side with buyers never good ( as I am) sellers. Wish I could go to the address but scammers always make sure they live far away.
That sucks but I do have a question. Why did you say you knew something was wrong just because he was anxious about you shipping the phone. I know when I ordered a PS3 just last week I was anxious and asked if it was shipped. from Amazon. That person tried to scam me but he was new and didn't know Amazon holds the money until they get confirmation of shipment. Just because someone is anxious doesn't mean their going to scam. I didn't scam. I did end up buying a PS3 from a different seller and it arrived two days ago.
I stopped shipping out of the United States too. I had International Buyers who claimed that the items were never received. I had others who lied. They claimed that the items were not what was listed.
I'm very sorry to hear about this.. Since you had his address and name+phone number, you should've phoned his local police station at the time and told them what was up.. I'm sure they probably couldve helped you.. Again, I am sorry to hear this.. I do hope that you are a lot more safer in how you sell your products...

Why can't the process be that the funds are held in escrow until both parties state they got back the product. I wouldn't mind at all having to do a refund as long as I get back what I I fact shipped.
This happened to me, buyer returned the iPhone saying it was broken, when i received it back the insides were taken out. Ebay done nothing saying i could just be lying.
I know your pain. I sold an individual a PS3 on eBay. As soon as the person got it, they tried to message me saying that the system was DoA/broken etc. They even filed a complaint with eBay. However I was actually fortunate, because I had video and picture evidence that the system was working before I sent it to the buyer. So needless to say I didn't have to send out a refund. Unable to follow through with their ploy, the individual just left a negative review on my account. I recommend other people do the same. Document your shipments. It might be tedious, but better to be tedious than screwed.
I am totally with you on ebay giving no help to sellers. Which is also why I only sell stickers. Nothing I sell is over $5.00 so I don't have to break the bank to refund. But I do have to admit the one time ebay did at least right to me. I had sold a magazine set and it never arrived and you can see from the tracking I did ship it and it made it halfway there and then something happened. I spoke to a woman in my USPS post office who told me, without hesitation or pause, my package had been stolen from with USPS. I called ebay and told them this. The buyer deserved a full refund but why should I suffer as well. I did my part as a seller. The person told me not to worry. Close the case and ebay will refund them. I would not have to pay for it. So I was shocked when my account was overdrawn. I called ebay twice and yelled but I knew the date and time I had made the first call and they looked back on their records and told me the first person was wrong and to be aware of this in the future I did get my $50 back. I lost shipping and the overdraft fees but I got something.
Keep calling eBay and tell them that you're advertising them as terrible selling places because of this. If you have the option, open a case on the buyer from your seller account and call eBay and tell them you never got your money back. I had the same problem when I sold my Sailor Moon collection and she actually sold everything separately as soon as she received the items and she suddenly wanted a refund claiming she never received the item. I called them and I won the case because someone else had posted a listing of the item I had sold her.
True - ebay is now a scammers paradise and there is no protection for the seller. I try not to sell on ebay anymore but when I do I feel a lot of stress waiting to find out if I've been scammed or not.
Same thing happened to me. eBay told me to file a police report with my local police and faxed eBay the report. The police said there is nothing they can do but I told them I just need a police report as documentation. eBay repaid my money they took out of my paypal. I asked eBay what happens to the buyer that scammed me, they said they can only note it but can't take his money away. Basically eBay eat the cost. $600 back to me and the buyer gets a free item. Just wrong but at least I got my money back. See if you can do the same. I know it's been a while but keep complaining.
There is a way to actually prevent scams like this.... Just videotape ur self packing the phone and shipping ( it might take a bit longer but worth the protection ) if he sends the item back record you opening it (don't forget to check the shipment weight before and after ). This pretty much solid proof u can send to eBay support. (100% guarantee to get ur item back + a fair chance to actually keep the money )
I have bought and sold many phones over ebay and this has never happened to me before and one thing you can do is call you cellphone company and submit your phone as being stolen and they can block the imei and just turn it into a a brick.
Some Police stations have safe places in their lots where you can meet for face to face sales. If anything starts to go wrong, they can come out and arrest him/her. Do it cash only, no checks or anything that can be reversed and you won't have the buyer taking the money and the item at the same time. It would seem safer to meet at a Police station instead of a different parking lot or other place. If you personally know an officer and can not get to a Police station, see if you can get him or her to be present for the transaction with you. They can be plain clothes officers.
I have experience this with a laptop I sold. ebay and paypal are now separate I have always got my money back going through paypal rather than ebay please contact them ASAP an tell them you have the evidence. I got refunded same day when it happened with an xbox one, 50" TV and the acer laptop. all three I got my money back after the cases where won in the buyers favour.
That's so messed up! I'm a buyer on eBay and I've sold a few things off of there, too. I think it was the fact that it is as a cellphone though. :/ I've had my cellphone stolen before and that was one of the worst experiences of my life. If eBay can't do anything then try to file a lawsuit against either the guy or eBay. I'm sure if you fight them about it you'll win...especially with all of the evidence you have.
in such case you should wait till you get your phone back before before giving back the refund. ebay has to make sure of this or was it just you that gave him back the refund too quickly?

I don't think this was a unhappy buyer. It appears that this "unhappy buyer" swapped his broken junk for the operating stuff. I've seen several UA-cam videos where this has been done. And of course, I've seen where sellers misrepresent the items they are selling.
Always keep a note of the imei number...if this happens call your network and get the phone blown !! Maybe you dont get your money back but he doesnt get to use your phone either.
Did you unlock the phone? Just because you paid it off doesn't mean it's unlocked. Then you told him how to rip you off. He has a 100% feedback and when he first complained you immediately told him he couldn't return it. Try being nice to people.
I was selling a high end gaming laptop. Had around 1800 in it, sold for like 1400 on ebay, but after fees and shipping and paypal fees it would have been 1200....I found a local buyer for 1200 before I shipped. The guy that won the laptop on ebay did the same thing, did you ship it, has it shipped, why have you not shipped it. I cancelled that ebay ad after he won it, refunded his money and sold it locally...Wasn't gonna play his game.
Dude I just went through same thing selling a printer. Buyer filed claim it didn't work. eBay took money back and printer returned to me in broken parts. And parts missing. eBay said tough shit.

I've got a similar thing going on at the moment so I've stopped any automatic refunds and payments to eBay from my paypal account and will be closing my eBay account and I'll just start another account because I won't be selling on eBay again
A similar thing happened to me on Ebay Uk. I sold a a phone but stupidly i posted it before checking Paypal. When i reported to Ebay did not refund or supported me. So now take IMEI of the phone. Also i never any item until i am paid. I ever state it in my listing. Plus if the buyer acts funny. I just cancel the sale and refund them. Ebay is crap at supporting sellers.
if the note 3 you sold to him was from tmobile and financed at one point on your account you can call tmobile and report the phone lost or stolen and they will blacklist the imei. which would screw him over. I hate scammers

I just had someone claim there was an issue with a nikon d610 i sold him. Long story short he couldnt provide sufficient proof and i won the case. The biggest thing as a seller is to document everything, When a case is filed you have to write to the buyer in a civalized manor with the facts and ebay will review your coments. Just make sure you know your facts and stand behind them with ebay. If you get a ebay rep that wont help ask to speak to his manager.
I have been on eBay for a long time now and I can understand your situation. Scammers are everywhere, you should always be very careful with buyers that are very impatient and this loser will get his one day. I have dealt with a lot of scammers myself and the worst ones were the ones from Nigeria, coming with sob stories to trick the sellers in to sending items to Nigeria. It sucks that eBay always sides with the buyer, even if the buyer is clearly a scammer. I had to deal with one a few weeks ago. The buyer I met was impatient and was asking where his order is, even though it was only 1 day since he had paid. I sent him a brand new Xbox One controller and when he received it, he opened a case without even contacting me, claiming that the item is defective. I was forced by eBay to pay return postage and upon arrival, I tested the controller and it was fully working. I called eBay and they didn't do shit to solve the problem, instead they said they will keep him under their radar, as if.
So in short, I lost money sending it, I lost the case, I lost money so that the buyer could return the item and on top of it all, I got a strike on my account for selling defective items as new. This was a low blow from eBay and put my account in jeopardy. Stuff like this makes me want to boycott eBay and become part of anonymous and DDoS the shit out of eBay. They are forgetting that without their sellers, they are worthless. The seller is the backbone of eBay and this is how eBay treats the sellers. I am leaving them soon, switching over to Amazon, not sure if it is any better.
Anyway, I hope karma kicks this douche bag in the balls one day.

i know how you feel i had a bicycle guy scammed me ones out of bicycle parts in my city where i ended up losing the same amount of money you did cause when i tried to sell my full specialized bike to him he tried to scam me 250 when my bike was worth 1,000 but i am sorry about your loss for what this guy did to you since i did learn my lesson as well cause when i tried to sell my bike on ebay i was just glad i didn't since i know people in the world can be fake like this guy was to you
i disagree about persons who anxious about having there items shipped out as something is wrong. i bought two LG e980 and i was very anxious about getting them bcuz i know of people who buys item and have not gotten them to this day. also some person wait too long to ship the item so that the return time is minimize. buyers arent the only one that scam the first Lg e980 i bought the seller stated that the phone dropped and that is why the screen stop working and when got the phone and change the screen and it still was not working i took it to a technician who found that it was water damage. im always anxious when buying phone cuz phone aint cheap where im at

I too am an eBay seller bro, lol this is why I stopped selling high priced items on eBay. The only way to win a case such as yours is to annoy eBay even before the item has been returned. Get a reference number and everything you need for when you are able to escalate the case, call about 10 times and get as many reference numbers as you can.
For as you said, eBay is always going to side with the buyer. Even after a buyer is banned, he can open a new account and keep scamming, eBay won't do anything unless it's a seller. The recording of the package opening was a smart move, but of course eBay won't even look into it...
Looking at your scammers info, it seems he fixes iPhones...well it seems he tried and failed. Then decided to scam someone instead of buying a new phone. Typical scam that happens on Amazon too. Amazon on the other hand doesn't even help sellers, they'll just refund seeing that the buyer provided a tracking number...

I purchased a galaxy S 4 from a gug on craigslist. Met up and he said the phone was stuck in assistive touch mode. I knew how to do it so it wasnt a problem. Phone looked good and i made the purchase. 150 bucks. Got in my truck to put my sim card in and no network. Plugged it in to the charger and no connection. Contacted the guy and he wouldnt answer. Texted him and nothing. I filed a report and police havent done anything. So i took it apart thinking i could fix it. No. The phone itself was supposed to be a AT&T phone. The screen was a Verizon screen and the hardware was AT&T. So the cable from the digitizer to the main board was too long. Resulting in a crushed cable with crushed other cables and the antenna cable was pinched. All in all the screen was a replacement and the guy didnt know what he was doing and i got scammed hard.

I'm not saying that you're wrong for being upset, but you shouldn't name the user who you sold this to. Legally that is considered defacement of character. If you would take him to court, he could void your case because you've been defacing his character publicly.
Not to mention the fact that he could take you to civil court for harassment and defacement. You should keep your nose clean. If you have a legitimate case, don't risk ruining it.

I would never sell electronics on Ebay, because a few years back I sold some jewelery to a buyer in Europe, and of course they scammed me, and I was out money and the item. I stopped selling outside the country after that. Strictly do craigslist only or FB, and meet the person and cash only transactions.
Can't you report the phone's IMIE as stolen? Whenever I sell a phone on eBay I take a pic of the phone's IMIE number, so if I get scammed I can have the phone deactivated.
I know just how you feel! I sold a an expensive camera on ebay. The guy got it and said there was a problem with the zoom lens. I told him the problem he was describing was impossible. He insisted it was. I contacted Canon, the camera manufacturer and they also told me that what he was telling me was impossible. Anyway, long story short, I sent ebay the letter from Canon and they said they'd send it to arbitration. Few days later ebay said they decided in the buyers favor. I asked how they decided and they hung-up on me. Guy sends the camera back and it works great. I sold the camera privately and screwed ebay out of the money. Can't use ebay now but who gives a crap. And I had sold hundreds of items on ebay and never had one negative feedback. SCREW EBAY !
Can you not report the phone stolen with the service provider? In Canada when the ESN is reported stolen the phone cannot be activated on the network. I realize its late now but just come across your video.

That sucks but I do have a question. Why did you say you knew something was wrong just because he was anxious about you shipping the phone. I know when I ordered a PS3 just last week I was anxious and asked if it was shipped. from Amazon. That person tried to scam me but he was new and didn't know Amazon holds the money until they get confirmation of shipment. Just because someone is anxious doesn't mean their going to scam. I didn't scam. I did end up buying a PS3 from a different seller and it arrived two days ago.

I stopped shipping out of the United States too. I had International Buyers who claimed that the items were never received. I had others who lied. They claimed that the items were not what was listed.

there are programs that can change imei numbers, reporting the phone won't do anything.
Why can't the process be that the funds are held in escrow until both parties state they got back the product. I wouldn't mind at all having to do a refund as long as I get back what I I fact shipped.

I know your pain. I sold an individual a PS3 on eBay. As soon as the person got it, they tried to message me saying that the system was DoA/broken etc. They even filed a complaint with eBay. However I was actually fortunate, because I had video and picture evidence that the system was working before I sent it to the buyer. So needless to say I didn't have to send out a refund. Unable to follow through with their ploy, the individual just left a negative review on my account. I recommend other people do the same. Document your shipments. It might be tedious, but better to be tedious than screwed.
I am totally with you on ebay giving no help to sellers. Which is also why I only sell stickers. Nothing I sell is over $5.00 so I don't have to break the bank to refund. But I do have to admit the one time ebay did at least right to me. I had sold a magazine set and it never arrived and you can see from the tracking I did ship it and it made it halfway there and then something happened. I spoke to a woman in my USPS post office who told me, without hesitation or pause, my package had been stolen from with USPS. I called ebay and told them this. The buyer deserved a full refund but why should I suffer as well. I did my part as a seller. The person told me not to worry. Close the case and ebay will refund them. I would not have to pay for it. So I was shocked when my account was overdrawn. I called ebay twice and yelled but I knew the date and time I had made the first call and they looked back on their records and told me the first person was wrong and to be aware of this in the future I did get my $50 back. I lost shipping and the overdraft fees but I got something.
Keep calling eBay and tell them that you're advertising them as terrible selling places because of this. If you have the option, open a case on the buyer from your seller account and call eBay and tell them you never got your money back. I had the same problem when I sold my Sailor Moon collection and she actually sold everything separately as soon as she received the items and she suddenly wanted a refund claiming she never received the item. I called them and I won the case because someone else had posted a listing of the item I had sold her.
True - ebay is now a scammers paradise and there is no protection for the seller. I try not to sell on ebay anymore but when I do I feel a lot of stress waiting to find out if I've been scammed or not.

Same thing happened to me. eBay told me to file a police report with my local police and faxed eBay the report. The police said there is nothing they can do but I told them I just need a police report as documentation. eBay repaid my money they took out of my paypal. I asked eBay what happens to the buyer that scammed me, they said they can only note it but can't take his money away. Basically eBay eat the cost. $600 back to me and the buyer gets a free item. Just wrong but at least I got my money back. See if you can do the same. I know it's been a while but keep complaining.
There is a way to actually prevent scams like this.... Just videotape ur self packing the phone and shipping ( it might take a bit longer but worth the protection ) if he sends the item back record you opening it (don't forget to check the shipment weight before and after ). This pretty much solid proof u can send to eBay support. (100% guarantee to get ur item back + a fair chance to actually keep the money )

Stopped buying/selling on Ebay a year ago.
I have bought and sold many phones over ebay and this has never happened to me before and one thing you can do is call you cellphone company and submit your phone as being stolen and they can block the imei and just turn it into a a brick.
Some Police stations have safe places in their lots where you can meet for face to face sales. If anything starts to go wrong, they can come out and arrest him/her. Do it cash only, no checks or anything that can be reversed and you won't have the buyer taking the money and the item at the same time. It would seem safer to meet at a Police station instead of a different parking lot or other place. If you personally know an officer and can not get to a Police station, see if you can get him or her to be present for the transaction with you. They can be plain clothes officers.
Seller and buys are sometimes stupid you always want to meet them in person and in front of a store that can verify the item.

I have experience this with a laptop I sold. ebay and paypal are now separate I have always got my money back going through paypal rather than ebay please contact them ASAP an tell them you have the evidence. I got refunded same day when it happened with an xbox one, 50" TV and the acer laptop. all three I got my money back after the cases where won in the buyers favour.
That's so messed up! I'm a buyer on eBay and I've sold a few things off of there, too. I think it was the fact that it is as a cellphone though. :/ I've had my cellphone stolen before and that was one of the worst experiences of my life. If eBay can't do anything then try to file a lawsuit against either the guy or eBay. I'm sure if you fight them about it you'll win...especially with all of the evidence you have.

I don't think this was a unhappy buyer. It appears that this "unhappy buyer" swapped his broken junk for the operating stuff. I've seen several UA-cam videos where this has been done. And of course, I've seen where sellers misrepresent the items they are selling.

Did you unlock the phone? Just because you paid it off doesn't mean it's unlocked. Then you told him how to rip you off. He has a 100% feedback and when he first complained you immediately told him he couldn't return it. Try being nice to people.

I was selling a high end gaming laptop. Had around 1800 in it, sold for like 1400 on ebay, but after fees and shipping and paypal fees it would have been 1200....I found a local buyer for 1200 before I shipped. The guy that won the laptop on ebay did the same thing, did you ship it, has it shipped, why have you not shipped it. I cancelled that ebay ad after he won it, refunded his money and sold it locally...Wasn't gonna play his game.

A similar thing happened to me on Ebay Uk. I sold a a phone but stupidly i posted it before checking Paypal. When i reported to Ebay did not refund or supported me. So now take IMEI of the phone. Also i never any item until i am paid. I ever state it in my listing. Plus if the buyer acts funny. I just cancel the sale and refund them. Ebay is crap at supporting sellers.

if the note 3 you sold to him was from tmobile and financed at one point on your account you can call tmobile and report the phone lost or stolen and they will blacklist the imei. which would screw him over. I hate scammers
