Adding Legends in wwe games is one of the best features they ever added to these games. Not only is it nostalgic for older long time fans, it can also be a cool introduction to those who didn’t grow up with them.
The thing about SVR 2010 was that those legends seemed like they were only included because they were already apart of the story and had made models for them. So just include them.
Something I didn't even notice until now is the probable reason why guys like Bret Hart, Sgt. Slaughter, Mr. Perfect and Rick Rude were in the SVR games to begin. While many legends were signed to legends contracts which allowed them to be in the games, I think some were in due to the DVDs which were sold at the time. You can see these DVDs in the instruction manuals of the games at the back. WWE DVDs featured "Life And Times Of Mr. Perfect", "Bret Hart: The Best There Is, The Best There Was And The Best There Ever Will Be", "The Ladder Match Volume 1" and "The Spectacular Legacy Of The AWA". Most the legends in the games were featured in these DVDs and maybe as part of the deal, their contracts also allowed them to be part of the games' rosters. Of course, I'm still speculating but it's not out of the realm of possibility.
Yeah although Bret’s dvd came out in 2005 a year after the first Smackdown vs Raw which he was already in. Speaking of his dvd, apparently according to Wikipedia so take this with a grain of salt, one of the reasons he did it was because he met a young fan who knew of him because of the video games but didn’t know anything about Bret himself outside of the games.

He was refusing to do business with WWE at the time due to that issue. I wish Lesnar and Goldberg could have been in as well.

Ric Flair got a similar treatment in SVR 09, where you had to unlock him through a cheat code or through Triple H's RTWM. If Legends were in that game's roster, Flair would have been a legend.

I think C is a bit harsh on SvR 08. I’d put it at a B- and I’d give 06 and A- personally.
Hell no, svr 08 legend’s roster was extremely underwhelming, and locking 1/4 of the legends to the PSP version was stupid and unnecessary.
