All the land, area covered by the society including the Terrace area belongs to the owners via the society. And the area is to be distributed equally amongst all the owners as per their alloted share.
Flat owner at lower floor paid more amount than owner at higher floor level for equal built up area but as per your concept both have same share in land.why?Why not extra weightage is given for higher investor.

If any land owner hands over his land to builder and the builder while selling does not mentions the UDS in the sale deed to the purchasers of apartments, pl inform what the law says in such a situation.

There is difference between flats and floors as you asked I think you purchased a floor than if the whole building has 4 floors than your share in plot land on which floors are built up is 1/4 ( if floors are on 200 sq. Yards than your share is 50 sq. Yards ) please check the occupation/ licence certificate of builder which he get from government authority. You will have to pay proper stamp duty to receive your share. Dealer can't sold roof / stairs/ stealth parking and commen land to anyone other than floor owners as per their licence to build up floors/ multy storey building by goverment/ municipal council/ district town planner.
Bhai sahab mujhe to ye samjh nahi aa raha hai ki kisi building ka build-up area society ke total surface area se greater kaise hoga. Example ke liye ki total jo falts bane hai unka area 125k sqft and total society area is just 100k sqft.... It's really very amazing 😅😅

This is false information, check your BBA. It clearly says all the land other than were the tower are belongs to builder. builder can create new tower on them(happened in many society in gurgaon after 8 year of delivery). Lastly the undivided share of land is only for the land on which your tower stands. So if it is demolished you will get 1/20 the price of land on which tower was standing if your tower has 20 floor
When someone buys an apartment, they are charged for extra amenities such as a garden, parking space, clubhouse, playground, gym, swimming pool, etc., which are also included in the apartment cost. In a proper gated community, you are not just paying for the 2 BHK units, but also for the additional facilities provided by the builder.
@@_Final_Boss sir let me give one recent example. In gurgaon there is godrej one property in sector 79 it is an existing society where people are living in it. Now they have launched 3 more towers in same society. So the original buyer thought that all land belongs to them but in reality it is always with builder. If you own an apartment which is not a cooperative society then reread the BBA, it will clearly say the land other than the where building stands belong to builder and you have cannot object if builder do any activity in that.

If the land is on Lease, your flat will be on sublease. In that the authority will be the owner of the land and you have to pay some amount for renewal of lease at the time of completion of lease term.
In MH there are two things Once the entire project is sold out and is certified by Local Authorities to be completed Builder has to transfer the land and building to the organisation of flat owners in the building This organisation may be a Co-operative Society or Pvt Ltd company or Apartment Condominium.. Once this transfer is complete both land and building is owned by that organisation and flat owners are the shareholders of that organisation with certain occupancy rights about their flats and rights to enjoy all the privileges of the project..

in simple words its better to sell flat 5-10 years before demolition to avoid loss, aka flat bought in newly constructed building sell that flat nearby 20 years

In most of agreement UDS is not mentioned, that's why builder go on adding new towers subsequently reducing value of our UDS in land.

In high rise apartments with more than 10 floors, you have to pay premium for taking higher floors.

All noida and near by area are not under uds. Threre is leased system
Sir my bldg (mumbai ) is on common plot of 15 societies (Total 25 Bldg) my society (3 bldg) is going for redevelopment and we have separate conveyance can we go for individual redevelopment ? other societies are taking objection and insisting us for common Re development but we want to go for individual Re development
all societies have separate conveyance but common property card . Pls rely sir. if not what is solution ?

in simple words its better to sell flat 5-10 years before demolition to avoid loss, aka flat bought in newly constructed building sell that flat nearby 20 years
