Chapter Two
ILLEGAL MARRIAGES
Art. 349. Bigamy. - The penalty of prision mayor shall be imposed upon any person who shall contract a second or subsequent marriage before the former marriage has been legally dissolved, or before the absent spouse has been declared presumptively dead by means of a judgment rendered in the proper proceedings.
Article 40 of the Family Code of the Philippines provides that:
“Art. 40. The absolute nullity of a previous marriage may be invoked for purposes of remarriage on the basis solely of a final judgment declaring such previous marriage void.“

Section 3. Subsequent Marriages
Article 27. By a husband. Notwithstanding the rule of Islamic law permitting a Muslim to have more than one wife but one wife unless he can deal with them with equal companionship and just treatment as enjoined by Islamic law and only in exceptional cases.

RULE OF BIGAMY
Article 180. Law applicable. The provisions of the Revised Penal Code relative to the crime of bigamy shall not apply to a person married in accordance with the provisions of this Code or, before its effectivity, under Muslim law.

Question po. Di ba po pre-requisite ng kasal ang CeNoMar? Paanong nagkakaroon ng Bigamy cases when in fact, it should have been prevented by PSA through CeNoMar in the first place? Hindi ba dapat si PSA liable din pag nagkataon na binigyan ng CeNoMar ang taong merong valid na kasal?

Maraming salamat po sa walang sawa nyong pagtulong. Ask ko lang po kaparehong sitwasyon ng Pulido case pero nakamit ng asawa ko ang annulment finality dahil sa fraudulent misrepresentation, false witnesses at false testimonies. He commited perjury sa annulment. Ayon sa finality ng annulment namin void kasal namin due to psychological incapacity. Kaya po mawawalan sala sya.sa bigamy. Ano po pwede ko gawin?

Why so expensive if your spouse was married and remarried with you not knowing they was married. Going to a PSA don't do anything but tell you to talk to a attorney . Nul and void of the marriage cost over 150 k pesos when it wasn't your fault

There is bigamy only when both marriages were solemnized in the Philippines.
