The issue in this case was whether English courts are entitled to require a party resisting enforcement of a foreign arbitral award to provide security for the money payable under the award as a condition of being entitled to advance a good arguable defence that enforcement should be refused under s.103(3) of the Arbitration Act 1996.
The Supreme Court unanimously allows the NNPC’s appeal.
