The argument should about fairness across the country. One part can be priced and regulated different if the court accepts it is to fight climate change. If the federal government thinks it is urgent to fight climate change let it do so universally across the country and own the tax. Jurisdictions that have some sort of policy already can either shelf it or else. For the federal government to implement taxation on a regional level to address an issue it can do so on all provincial taxations.
