  • I just wanted to bring everybody up to speed on my recent zoning violations. I had a lot of viewers reach out to me with advice and support, and I thought you might be curious as to how it played out. I learned a couple loopholes that might help you keep your sawmill or homestead if you're in a similar situation and I want to share those with you here. Thanks for checking in.

    You might want to put up a few trail cameras and clearly sign the property as "No trespassing allowed." I am fairly certain the person who took the photos will be back to see what's taking place on the property in the future.

    I wish more people would take responsibility for their actions. I don't feel it was your fault. Someone was jealous of how nice your place looked. You had a beautiful get a way there and it was very tasteful and well kept. The person that trespassed should have been charged for that. If they had to come on the property to see the place, then you were not bothering anyone. Someone probably wants your property and is trying to get you to sell. You have a reason to be upset.

    The saw mill is likely the exact thing one of your neighbors based their complaint on and now they have to look at it every day because it is not a violation.

    The funniest part about this is they probably wanted the sawmill gone more than anything, I’d never move it and start that up at 5am anytime I wanted to use it

    Great for you. I understand. Moved into my house . At that time the subdivision was about 35 years old. The lot had restrictions which I was glad of. After reading all of them, I realized that there were many structures not in compliance. I approached the association committee regarding building a carport.The newly elected president, who was a two year resident, said, we are going by the conventicles exactly. I pointed out that there were many structures that didn't meet the requirements. No matter, the answer is NO. Ok, I reread them and they were the house had to be 20' from the line, but the eave was not part of the set back. That is it. I started remodeling, converted the part of the house that was a carport to a sunroom, and when I put on the roof, I used four 36' I beams across the sunroom which was 20' wide, which left me with a 16' eave. I had reviewed the design with an architect friend and got a structural engineer to size the I beams. The association took me to court. I obtained all of their records, which proved that the many structures that had been built were never authorized. After a couple of years they abandoned the suit. The judge dropped it with prejudice, and now I have a carport under my eave. I have left out my discussions with the parish (county) safety advisor, who, comc to find out only had a high school education. He and the assist DA left quickly when I pulled out the architect design, and structural engineer's document.

      Nice work. It's nice to hear about somebody coming out on top for a change. You must have the biggest eave in town! I'll have to remind myself that there's always creative solutions hiding in the rule books. I just have to find them. Thanks for checking out my videos.

      Neighborhoods are zoned to allow people to get along. Since I don’t like people, I moved out of their neighborhoods, and checked the ordinances and zoning regulations. My desires for how to live do not negate their desires for how to live. We’re just different. Different is okay. They can have their mowed yards and cookie cutter houses. I have my hens and rooster, my sheep lawn mowers for the pasture, and my LSG dogs.
      And I still make an effort to not be a pita neighbor. I keep my animals in the barn until after 8 am, which is a time when noise ordinances allow noise. The dogs tend to bark when they first come out, but then only in reaction to things. The rooster crowing is muffled by the barn. He’s mostly quiet after dawn.
      I don’t allow my dogs to roam.
      We have ordinances because of people who do puss off neighbors. Building codes are because of people who do crap builds that are a hazard. And people invest a lifetime into their homes…they want to protect the value of that investment. I’m sure you’d be upset if you lost a $50,000 on a home sale because your neighbor is a hoarding slob. I’m sure you’d be upset if your hoarding neighbor had a yard that was breeding rats that were invading your house.
      I put up with living by the rules of my former neighborhood. I wasn’t held hostage there…I chose to move.
      Freedom is not ONLY you being able to do what you want…your neighbors ALSO the freedom to live in a way that is comfortable and peaceful for them. Ordinances and zoning allow us each to make choices without infringing on everyone else.
      It is not a perfect system, but you can get ordinates and zoning rules changed. You can get variances. You can vote to replace the people making the rules.
      But the onus is on each of us to research before buying and before investing in changes.

    I had a similar experience with my property. I only used it a few weekends a month to ride atvs, motorcycles, and hunting fishing etc. It ended when I filed the paperwork to sell it to a hog farm company. All of a sudden the neighbors decided I wasn’t so bad after all.

    That's why, down here in the South, we have country stores with trail cameras, lead spitters and cases of whoop ass.

    I am not a lawyer but from the time I was little I was always told by the Constitution you were guaranteed the right to confront your accuser. Not your elected "implementer" but your accuser. In other words not the cop that bullies you but the guy that claims you did something wrong is your accuser. Stemmed from abuses by the British Crown when we were colonies, done there and here.

      The code enforcement droid can be the accuser if they see a violation. It's a different word than plaintiff for a reason.

    You are a good dude. That neighbor is comfortable walking your land and will do it again because now they feel even more emboldened that you had to remove your structures because of their complaint. I would post no trespassing signs at all possible ways into your property. You could set a camera to catch them and then report them (actually, curious if you can request that same lawmaker enforce your right to no trespassing under the maximum extent of the law, they have all the proof! as the trespasser implicated himself). Or a baited camera trap with something that looks juicy and might be reportable but is actually fine. It's for sure a neighbor. a very close neighbor that has been there awhile and feels like they belong there more than you. likely older retired with plenty of time on their hands to to walk around looking for conflict. You've probably even talked to them.. Remember the guy asking all the stupid questions??

      I do remember the guy! I just don't have the proof. My cheap Amazon trail cams died this spring, and I never got around to replacing them. I'll be getting some better cameras now. That's for sure.

      Hello from New Brunswick Canada 🇨🇦. Could you not request the identity to have him trespassed. If they won't give you his identity, then call your local authorities to get them to have him trespassed. People just can't come onto your property without your consent. It's not like he was lost and stumbling through the woods. He knew it wasn't public land. He knew it was private property. Hense having a camera and taking pictures then making a complaint. He knew it was private property. At least there would be a record if he was to do it again. Might help for future issues. Anyways, just my 2 cents. Love the sawmill. Have one myself. Enjoy YOUR property and play safe

    Place some trail cameras on the property because the person that complained will come by to check on it and then you file a complained for trespassing.

    I had CoE pull my permit, I was able to fight to get it back. Glad I did since they are no longer allowing new ones. Thanks for the updates!

    If you encounter more problems with the jurisdiction ask The Institute for Justice for help. You have standing and can make a difference for other land owners.

    This anonymous person who filed the complaint did it because they don't like what you are doing. Either they don't want someone living there, or they don't like the noise of the sawmill. There's a good chance they will be back to find dirt or other contraband on your property. I would recommend a camera like the ones the hunters use. The ones that are camouflaged and can take either stills or short video of intruders.

    If they trespass on your land again, you need to file a trespass suit. Post signs that do not trespass and they would be in violation of this. If they want to protect your whistleblower, then sue the person who allowed them to file. In this way, you will end this attack.

    Your situation upsets me! And you're not the only one this happens to. The government needs to remember how they got there and who elected them. I'm so proud of the residents in Green Township Michigan for removing ALL of their officials in a recall election! Our VOTED IN government (who is supposed to be OUR voice and represent OUR views and opinions (not their own)) needs to be put in check. I hope more (all) people will band together and do exactly as Green Township did.

    Subscribed and wish you well on your project. It’s completely out of line that you’ve had to deal with this situation. We are fortunate in TN with permitting and zoned agricultural as well, so we more like the land you grew up on. My son and I just set up our woodland mills HM130 max for his abandoned shed to tiny (big) house channel. Look forward to following your progress!

    Regardless of what you knew, didn’t know, did or didn’t do, those zoning regulations are bat shit crazy, sounds like the folks around there are so ungrateful to have others enjoying themselves doing things that they probably never experienced in their pathetic lives. Glad you got it sorted out.

    I live in holton north of Muskegon MI and dealed with a similar situation about my sawmill in residential area it was deemed as a tool and allowed. I have a sawmill Channel I'll go check it out. Thanks for the update great videos.

    I've done a lot of work for the City of Manistee (and other surrounding towns, including this area) as an engineer and some people will go to the end of the earth to complain about their neighbor doing something they don't think they should be able to.

    The other thing about "you grew up there" is that most kids tend to read "The Hardy Boys" and not "Local Zoning Regulations" growing up. Glad to hear you've worked out the issues, even if it didn't all go as you liked.

    You may want to contact The Institute for Justice. They handle many similar cases of civil rights violations, this type of case has been successfully argued before. You have a strong case my friend.

      Everyone i've talked to seems to be surprised by that ordinance when I mention it. It's only enforced if a complaint is filed, so most people get away with it.

    Just came across this, and this makes me livid, I'm glad you have resolved this to the best of your capabilities in this situation. As a fellow Michigander(west Michigan) this state is turning into an absolute shit show, you can do everything in your power to be non political but the over reach and in many cases blatant violations of constitutional, personal and land rights will find a way to find you and piss ya the hell off even if you just wanted to relax and do your own thing. yes part of your confusion is probably sourced by not understanding zoning but a HUGE part this misunderstanding of is the recent expansion of zoning laws in many areas that have stacked up over decades of poorly elected officials effectively nit picking what you can and cant do like a HOA on steroids. What we don't need is these morons telling us we cant buy a property to go and camp on to relax, and instead they need to start looking at actual good zoning laws like purple post laws in place of their current trespass posting laws. a permit so you can camp on your own land is ridiculous let alone "only for three weeks" is complete bull.
    I know you said you don't want to get political but it may be worth doing a FOYA request to see the similar cases of overreach to land owners contact them and get either a lawsuit or a recall on the local elected officials started. At this moment in time like you said they brought the politics to you, and even if on your B property that is agricultural you can do most of what you want today, that doesn't guarantee you can still do it tomorrow. to protect yourself and your family (and other families that might not be as fortunate as you to be able to relocate their buildings, and have another property) I encourage you to step up for yourself and band together with others that have experienced your situation or other locals that want to prevent it to stop it from ever happening again.
    on your B property I encourage you to setup no trespassing postings (purple post still isn't law in all of Michigan yet so that may entail a shit ton of metal/plastic signs and high viz tape) and some sort of camera systems, game cams work good, but if they are found they are easily vandalized without knowing who vandalized them, and with some thought it might be worth setting up solar powered wireless cameras. if you are the kind of guy that likes to look at all the details "the hook up" has a ton of in detail videos about cameras at all price ranges, if you just want a DIY guide I saw something a couple years back by "Stoney ridge farmer" that looked promising.
    Things in Michigan have gotten so damn convoluted I have half a mind to leave this state, the main reason for my staying is family the only other reason I stay is its like a toxic relationship I feel I can fix it if I just stick it out and talk with the right people to rectify the relationship with the state :P.
    Also ​ @GrumpyToadCreations you NEED to contact a civil rights lawyer in regards to them not disclosing the identify of who trespassed on your property, whistleblower laws only apply to individuals whistleblowing on the government or their employer. by them not providing this information to allow you to trespass the individual they are violating your 1st amendment rights, and with them saying "its because you were found guilty" this would also violate your 8th amendment rights protecting you from unusual punishments. I'm pretty sure this is a civil not criminal manner so I don't think the 6th applies to this particular case but there could be an argument that this case does violate your 6th. ESPECAILLY do this if your fines/fees exceeded $1000 (including the cost of moving your buildings or buying new land)

    Me and my Brother built a 400sq ft cabin on his property 6 years ago so I understand your frustration. We managed to stealth live in a 8x12 shed converted into a tiny house on the property while we built, we also had a 10x14 tent on the property we used for storing tools & supplies that we told everyone was were we lived while building. I'm aware of the extreme difficulties & backwards rules that exists. The most frustrating thing was how everything was set up to prevent anyone from saving a few bucks by doing it yourself. It ended up taking us 6 months to build the house & in that time we had to have a temporary power pole, even though a neighbor said we could use his power, and a porta-potty even though we had a shower tent and access to the neighbors septic system for waste disposal. Instead of building a smaller cabin like my brother wanted he was forced to build a 400 sq ft due to minimum size requirements. But we did it, we had to jump through hoops, deal with the inspectors, do things the way the country wanted us to but My brother built his house for around $100k & just sold it for $250k. Don't be discouraged, just find the loopholes, try not to make enemies at the planning and inspection office, and forge ahead!

      Wow, I can't imagine living in an 8x12 with my brother, lol. That's the same size shed that I have. It's cool that you guys were able to make it work. He made quite a profit off the cabin, I'm gonna have to try that. Maybe I can profit off all these out of towners.

      @@GrumpyToadCreations Yeah, we built a bunk bed with mattress on top and cot on the bottom, we had a mini fridge, hot plate, microwave, small tv, storage rack for food in the tiny house / shed. We would go into town once a week to take a shower at Planet fitness gym. and we used neighbors water also. We got into some arguments from time to time but we were both motivated to build his cabin & he paid me for my time.

    In terms of zoning, one of the best is "Open Range". If you combine that with filing a "Timber Exemption" plan which is a form of agricultural exemption, you have tremendous latitude in terms of what you can do on your private property.

      I haven't seen any open range cattle here, so regular old agricultural zoning is my best bet. I'll have to look up what the requirements of a timber farm are.

    You have a sawmill so build a tree "house" and really mess with them. You are technically not on the land (dirt) but in the trees. Wouldn't this be a fascinating twist.

    I wanted a tiny home at one time. In New York they told me I can't have a "secondary structure " without a "primary structure ". So, no tiny home

    Look for advice to see if this loophole works out: buy the cheapest big box truck you can find and turn that into your shed. Make a little retractable awning as a work area that can deploy in a minute or so. When you wanna work at the sawmill, drive your shed up to the worksite, deploy the awning, and when it's all done, drive it back home in the end. Not a shed!

      Someone else mentioned a box truck, and it's an interesting idea. Technically, I can park there as long as I'm on the driveway, and it's not stored off in the grass. Something to ponder.

    🟠Replace the shed with a cheap box truck (w/ lift gate) that is similar size as the shed, you can then move it on and off the property at will. Serves same purpose (albeit different design), and is mobile! Then sell it when you don't need it anymore and profit since you will have likely fixed it up quite a bit.

      @@GrumpyToadCreations yes, doesn't have to be perfect since you're obv. not doing long hauls. Maybe one that needs sheet-metal repair of the box, but is mechanically sound otherwise.

    Lawyer here. We (attorneys) hate that word loop hole. Something is prohibited or not. The sawmill is not prohibited, so it is allowed. No loop hole here!
    As for what an actual loop hole is... When multiple laws or ordinances create a conflicting legal regime, the loop hole is created. Pretend that one law says "no commercial equipment allowed", but another law says "timber processing is allowed". The loophole is therefore to claim noncommercial timber processing.
    The guy was fully in his rights. Good for him!

    I know you already complied with everything. Buuuuut if I were in a situation such as you were. When I had the time and means I would proceed to build a dwelling "To code" the smallest and cheapest possible to meet the requirements and then proceed to build everything back to exactly the way it was... And make even more noise from then on since someone in the neighborhood seems to hate the sawmill sounds.

    Funny thing about ZONING(aka telling you what to do on your own land) I bought land zoned rural/ag specifically to build a repair shop behind my home however by the time I saved the money to build the property had been "rezoned" residential-1 which would make the shop illegal
    Luckily I had opened the business(filed the paperwork) BEFORE the change and therefore (after paying a lawyer) I was "allowed" to build the shop

    Still, it seems like evidence to lodge a complaint or to show wrong-doing or breaking of laws/ordinances obtained through illegal means or activities should not be admissible. I know this isn't a court of law but shouldn't the same principles apply? I guess it comes down to resources and how much you want to dig in. And, inevitably, you'd have arrived at the same outcome, just further down the timeline and you'd be moving your shed in the fall/winter timeframe. Still, it would be nice to be able to find out who the self-important, busy-body was who ratted you out. And you're right: It bothers me to my core that someone came onto your property and created angst and anxiety where it didn't need to be. They could have just as easily stopped by and given you a heads up concerning the zoning violations so you weren't blindsided. The idea that they're sitting at home all smug about getting their way is bothersome. At least you still have the sawmill which is likely the entire reason they started this whole mess to begin with. So, mill away! Balance their karma wheel and mill away. Good luck and I'm sorry this happened to you.

      It depends where. Each city and county creates their own rules. Some are really ridiculous. Other places much more open. The country was founded on principals that land ownership and use of that land was a fundamental right. The federal government has not protected those rights and they have been eroded significantly in many places.

      With what they did to indigenous people here, this should come as no surprise. They want to use the land THEIR way, and thats the law. They will push you out exactly like the last people who "lived off the land". Since that doesnt support Big Business, its not allowed. (BIG Business owns the government, through lobbying)

    Always post a sign no trespassing once they cross that line it's a 95 ticket for trespassing no one is allowed to trust us on your property Goodland inspectors cops nobody can come on your property without a warrant they have to issue you a letter through mail to notify you that they need to come and check out what you're doing you cannot just walk on your property second of all I would just pick up the song No move everything to your new place and sell that property and move on with life glad to see everything is working out

    Never ceases to amaze me how nosey and obnoxious people can be. I have four blink cameras on my cabin roof facing north, south, east and west. On four different occasions i have had trespassing neighbors nosing around my property. There aren't many restrictions here in this section of TN but my development has a few covenants; mainly no mobile homes allowed.
    Two of the trespassers i recognized as distant neighbors. When i confronted them they both claimed that they got lost on hikes.??? I confronted them further by stating that they sure were taking their time eyeballing my property as they made their way across my it. In this day and age of cameras and weapons it still surprises me that people are so rude. This county is the least populated per sq. mile in TN. And the development im in is very spread out. Most residents own at least 20 acres. So it goes without saying that people who crave privacy are attracted to this development.

    what county are you in that you can't camp on your own property? I'm in the northern lower penninsula myself, and have never heard anything like that

      Manistee. It's zoning dependent. In Resort Residential, I can't camp. In Agricultural I can camp if I pay an annual permit fee. Nobody in the area is aware of it, and they're all shocked when I talk about it. It's only enforced if somebody complains.

      I am in Osdcoda County and live on residential property and run what essentially constitutes a campground (non commercial) out of it. I have a large fire pit and generally have a number of friends camping out every summer. I've gotten issues with "blight ordinances" here but never about anything to do with camping. Hope it all works out for you my friend.

      They seem like decent people. They get lost on the hiking trails often and wind up on my land. They're always apologetic and give compliments on what I'm working on. The camp is far enough away that they wouldn't be bothered by the noise. I'm sure it's someone who owns a house near me.

    Many times dealing with the city is terrible, they don’t tell you all the answers.. I want a garage with a loft.. submit by plan to city. Told it was not allowed to be that high..I will have to resubmit with lower height....I asked about a variance for the height. They said yeah I can do it with a variance... you think they would have said it in the first place..

    All of the restrictions and regulations to control what you do on your own land. The Government is so out of control it isn't funny. It's the reason my wife and I are leaving California. We bought a 1.5 acre parcel of 'raw" land near flagstaff Az. and have been developing it and building our retirement cabin on it. This is year 7 of a 5 year plan. I think it's going to be another 3 years before we can move in. I have an HM122 Woodland Mills sawmill. I'm building a Timber Frame mountain lodge style cabin. Only 640 sq. ft. but it's a beautiful cabin with a lot of love built into it. I hate the government agents with their overreaching and power trips. So done with them. And they wonder why there are so many homeless. They don't care, they don't give a shit. Good luck to you. Resist

    As long as the saw mill is not operated commercially, your not selling wood for profit. You ok. The complainer staying hidden, ya that's a cop out. Research the tress passing laws in your town, county ,state, then post your property. That way, if this occurred again, that person is a tress passer. Next inform the zoning people they are not allowed on your property with out you present and an appointment made with you.

    I would pursue this with the police and with a lawyer to gain as much knowledge as possible for the future.
    For example, if the police trespass on your property, gather evidence without a warrant and charge you will a crime, the evidence would be tossed out because they gathered it illegally.
    How does this apply to a common citizen that does the same thing? I have no idea but I would arm myself with as much information as possible. Talk to police. Talk to a lawyer. Knowledge is gold in this situation. Cheers

    If you had bought a used trailer and built a wood shelter on top of a used trailer, its on wheels, not a permanent fixture and there isn't shit anyone can do. There's so many ways around these rules. I heard of a farmer that built a roof to put over the hay bales he set out for his horses in a field. Someone complained. He then built a huge set of tables and chairs, big enough for his horse's and hay bales to fit under and there was nothing in the ordinance that did not prohibit tables and chairs on his property in his field. The first thing I would've done is put up no trespass signs and trail cams

      Wheel's seems to be the best way around the rules that I've seen so far. It's the only way to truly say that a structure isn't permanent. My next build might be a trailer.

    You need to get yourself some cell-based cameras to monitor who comes and goes on your property. I have a piece of property that I monitor. This way. The cameras I use are made by Bushnell. You subscribe to their service and when the camera goes off it texts me pictures. I recently prevented a significant theft on the property because I had those cameras up. If that person came on your property one time, they have most likely come back repeatedly.

    The only person allowed to enter your property off of an easement is a Surveyor. All others should be charged with criminal trespassing in this case the elected official since that is where the paper trail ends. It’s essential to remember that elected officials are subject to the same legal standards as any other citizen. I am glad that I live in a state where, if you walk past a No Trespassing sign, you do so at your own peril.

    2nd, the complaint is very revealing.
    My take based on the wording is that it's not just about what you are doing on the property.
    This sounds personal, someone is out to get you, personally. imho.
