    My question is: How legal was the expropriation of land in Zimbabwe according to their constitution? My guess is that it was not very "legal" at all but it never stopped them. What will stop the ANC from just going ahead regardless? My guess is that they will no matter what "laws" are put in their path. They have made promises and better keep them or they will have their own throats slit.

      To reply, I should first be clear that the White Zimbabwean farmers SHOULD be compensated for land that either they or their folks of prior generations bought according to the legal environment that they found themselves in.
      Regarding the legality or illegality of land taken away from the White Zimbabwean farmers, heed this: that country was ruled in violation of international law from 1965 to 1980. The UK, the former colonial "boss" of Rhodesia/Zimbabwe, publicly denounced that illegal regime, but behind the scenes allowed it to perpetuate. Too much proof has come to light that the UK even secretly assisted the illegal regime of Rhodesia. Keep in mind that every western developed democracy of the Angloshere condemned the Rhodesian regime that prevailed from 1965 to 1980.
      So you have a whole nation who find it hard to respect international law, simply because they were not able to invoke it during those 15 years of deprivation and war, years that have scarred them deeply. "International Law" means nothing to them, except as something that exists in the dreams of dreamers.

      Wonderfully presented by Mr. Mark Oppenheimer and very, very informative might I add. He somehow omits to explain just what one must do when the blood thirsty marauders arrive at your front door. Surely he has taken into account that some citizens do not have access to well stocked offshore accounts and private jets as a plan B.

    Having land gives you leverage for bank loans because it is an asset, of course this does not work if the state owns the land suddenly the land is worthless and you no longer have leverage. Very simple really, this is why property rights exist.

      I thought so too, then heard Malema talking about china, and I know it is true, china is like that, state owns all the land and people have a "licence to occupy" which can be sold. Banks lend money against that. Also, here in NZ many people have leasehold land, it is owned by someone else, often a church, and is on a 99 year lease, they buy them without owning the land, get mortgages. So it can be done! watch out! Malema is not stupid! thought he is evil.

      In the ex-Communist East Block land was owned by collectives, but really under the yoke of the government. There was no private enterprise or private immovable property of any kind allowed. Yet after economic failures even the ex-Soviet dictator Kruschev admitted, but without private incentive, it is not possible to achieve any kind of economic progress. After this, small businesses mostly involving grocery stores and small restaurants were allowed, although heavily taxed. The so-called socialism was actually state capitalism.

    This is funny because during apartheid the land was owned by the state and the land was distributed by the state. Most Africans were forced to move from their areas and grouped according to the tribe they belonged to, that is why in KZN you find Zulus, Limpopo you find Pedis, Eastern Cape you find Xhosas, Western Cape you find Coloured. The truth of the matter is that we will never move forward until the land question is solved. When I ask some friends of mine who are white people about how the land was obtained some of them do say that they bought it legally but from the apartheid state, that is like I stealing something then somehow "legally" selling it to you does it now make it yours?

    Mark, are you not making a mistake by taking the value of property to be at current levels? If the government starts expropriating most land what will the market value of land be? Who is going to by land that is going to be expropriated ? my guess is no one! The market value is whatever price if can command on the open market, which is virtually nothing. If, somehow, if stil has value, the currency it's self will be worth nothing. (Malema has stated that this is his intention) Factor that into your deliberations....

    Why is the land still included with business, cars, pension all other assets in act 25. I thought by now they would be separated. Is this going to happen or will the government have free run on citizens belongings, assests.

      btw, There was a time when our votes did count...1994! We just voted wrong...
      Think about it this way.

      But you forgot something....There are no food left in the house...and out of the 10 voters...you are the only one that is not a cannibal....

    Mark, thank you. however you are missing one small factor that will demolish all the rules of our constitution. that being exactly what happened in Hermanus and Clifton over the Christmas period, its called "LAWLESSNESS" who controls that. What do I do when a group of young gentlemen arrive on my farm and start attacking my wife and I ?? do I pull out the constitution and have meaningful dialog ??

      You defend yourself as best as you can. Get some decent "white" unemployed people (ex military) or coloured to stay on your farms and for payment help on the farm too. Numbers is a good thing.

    We want to be part of that 1% we want that 1% to truly reflect the demographic of RSA, 85% of South Africans are black so this should be reflected in the 1%, so the issue is not so much about land its about true equality. Unfortunately some politicians have made it about land which is misleading. Apartheid took a huge toll on the black majority and we feel that its only fair that we get better chance to advance as the whites did during this time. you also mention Zimbabwe and Venezuela but you are lying outright about why those countries are in that state, they are like that because of SANCTIONS from the west, if there had been no sanctions then they would function much better. I am more of the view that we share the land. you keep the parts that you have developed and we develop the rest of it. Speak of the Meyer family who owned a stretch between Midrand and Pretoria, but ask yourself who did the land belong to before they took it? and why was it fair that our land was stolen from us by you but we cant expropriate it back? Its one thing I do not like about this because you are saying its OK that we took your land but you cant have it back. which i feel that that would be the fair thing to do, however I smart enough to know that if we did that the ZA will turn into a Zimbabwe or Venezuela so for all intents and purposes fair isn't the right thing to do. this still leaves us with tons of disenfranchised people some of whom need land for various purposes then we have to arrive at an amicable solution and as an intelligent person try solve that.

    I don't want to leave my country. I was born in South Africa and I have known no other home. But I am leaving. As are my educated daughters. I don't consider myself wealthy and my savings are meagre at best. I'm taking my nursing skills elsewhere. Yes, I will work until I drop if I have to because that's what South Africans do. My husband's blood has already mixed with the soil of this land.

    There are many terrible examples around but who want to learn from somebody"s experience. We all have equal rights now but not equal means. What's new? Only some time ago people did not have equal rights. Use at least your right to educate your children and yourself, do your jobs with efficiency and grow. Every good process take time. Don't expect to get everything in one generation. Pave the road for your children and grandchildren by good example not by violating other people rights. This is the only way to break the evil circle. Read what the 10th Commandmand sais and don't desire what your neighbour possesses.

    Oppenheimer huh .... here's a 30 second advice : (1) Give a huge mortgage bond to the bank in the form of an Accessbond type mortgage (2) Take out all the money (3) Put it back into the accessbond to keep interest payable at zero, until : (4) when the Gov threatens to take your property, withdraw the accessbond funds.
    Good luck to the Government taking on the banking sector, because that money has been moved overseas.

    All I see is that when Europeans came into Africa, they knew little or nothing about fRming the land. si, Africans welcomed and taught them the techniques of farming the land. once the whites learned, they forced the blacks off the land without compensation. Africans were forced to live in cities and work farming the land that was really theirs. Also, they are forced to buy the food products and pay taxes on other resources that were once in their possession. they are not being compensated for what they lost. colonization equates to the TAKEOVER of a country's resources without pay. then to add insult to injuries, those who who were thus mistreated are shunned, scorned, talked about and otherwise hated because they won't work or pay for the food coming from the farms, that are now under European ownership, who WORSHIP A JUST GOD. give back what then and YOU'LL HAVE PEACE.

    lol, Imagine if the 4% black population in France owned the vast majority of the farm land. The way it is now, it is either going to be an organised expropriation without compensation or eventually as history all over the world proves, the poor get fed up and do stupid things. If you gained land and wealth from Colinisation then you have no right to then turn around and complain, how do you think you gained that land and wealth in the first place? How can you expect South Africa to move forward when the foundation is built on desert sand? After WW2, the British government stepped in and created a tide that lifted all boats. Somehow after centuries of exploitation and genocide all of a sudden the right to vote is all the ancestors fought for...go to hell. There will be land expropriation and should the people go hungry for 20000 centuries after then so be it.

    at the beginning I thought that you would come up with a good plan of how you would stop expropriation but really you have not, go back to the drawing board and come up with a plan that can speak to both sides because you wont stop or pause it. i too am not a fan of land expropriation but I am let down in this presentation.

    The reasons the Zimbabweans ended up takin back their land by force is similar to the South African situation. The Zimbweans spent years trying to hammer some sense to their fellow white citizens and the western countries that redistribution of land is critical for the sustainability of peace and prosperity in that country. Because all those years it was the black nation which was at the receiving end, less attention was paid by the world to what the Zimbabweans were crying about. Hence, they stopped explaining themselves nor follow their own laws. The people just started grabbing the land and of course there was nothing their political leaders could do to stop them. Let's hope that just as we did leading to a negotiated settlement, our explanation will some day drive some sense in the head of our fellow white citizens and the rest of the world for the benefit of all who are affected. Employing all strategies to defend the status quo does not assist at all. Our political leaders have been restraining Blacks from taking action for a very long time. With the revelation in the Zondo Commission, it has become clear why our leaders were ignoring to address the issue of land, it's because unlike the rest of us, they were surviving through the underhand. The time will come when we will no longer listen to them. At the moment there is no land grab in Siuth Africa, but like Julius rightfully stated, no one can predict the future. Mugabe himself was the one who was defying everyone who wanted toke over land in the early 80s but because the future cannot be predicted especially in an economic environment oppressing one population group, he found himself at the forefront of championing the grabbing of land, why, because he was going to lose the flowing elections. The same situation in which the ANC find itself in the current political dynamics of South Africa. The ANC is currently compelled to talk about the expropriation of land without compensation. This is the only ticket which can retain the majority votes in South Africa because, so far, it has failed the majority the citizens in all department. The danger, though, is that the ANC will not afford to retract from its promise to expropriate land without compensation after the election because if it does, people will betrayed again and this time around, like in Zimbabwe, they will no longer want to do anything with the oppressive laws but to act against such laws.

What you don't get is that we no longer want to do things your way because, it may be working for you but, it truly is not working for us. There is no amount of effort you can put which can make the majority of Black South Africans think otherwise. They heard and seen it all and they are fed up. Hence they want to decide on their own fate going forward. In the video, the presenter was telling his audience what they want to hear. For example, he says it's a few amongst the Black South Africans who are interested in amending the constitution. It is clear that he does not understand the political dynamics of this country and he obviously does not associate with his fellow black citizens because if he did, he would know what is their position on land.

The failure of Zim was also a fact, not because whites said so.If foreign investors stay away because their investments will no longer be safe, because private property is no longer safe and can be expropriated, then you will be free of "imperialists". If you were one of them, you would fell the same way. The fact that money would; become worthless would also not be an "imperialist" trick, since the value of money is based on the Gross National Production ability of a country. We have now a GNP of less than 1%, but it can go lower, if we make arbitrary changes in ownership.Musa, this is NOT political ideology, just basic economics.
