    A professional fiduciary can also be problematic. A St. Petersburg nonprofit, The Center for Special Needs Trust Administration, which administers trust funds for people with medical needs filed for bankruptcy in Feb 2024 after its founder took $100 million in an unsanctioned loan. Leo Govoni transferred the missing funds to the Boston Finance Group, a company he owns, using a line of credit he set up while serving as president of the center. The center administers trust funds for more than 2,000 people with special medical needs across the United States and abroad.

    This was a very helpful and informative video! I definitely enjoyed you explaining and breaking down each step and requirements for section 8. Because of you, I confidently now know a lot more about the Section 8 process than I did before when I signed up for low income housing five years ago. I'm actually in the process of moving to another subsidized housing and this info will be beneficial.

    Thank you very much for this advice, I’ve successfully have set up an CA ABLE account for my son, he has a Wells Fargo bank account with checks to give account info to a relative that wants to GIFT money to him. Is it ok to have relative ACH into his Wells Fargo bank account, then what is the procedure to link ABLE ACCOUNT in order to keep records of deposited monies into Wells Fargo with intended purpose to transfer into ABLE account would that be the acceptable to SSI and Medical/medicare ?     I receive $828 in SSDI/CDB and $135 in SSI per month. I was recently hired at a small, slow paced makeup boutique and would be making $10 an hour at 18 hours a week. So $720 per month before taxes, and still way below any of the ŵage limits. I understand that this would essentially cut out the $135 SSI, but it will not affect the SSDI/CDB? I've also heard that after 12 months of this, the SSI would be cut out permanently, which is terrifying as I have a progressive disease (and other ailments) and desperately need that safety net if I am unable to continue to work this job. I'd be hard pressed to find another job similar where I work alone only 3 days a week, can sit when needed, use mobility aids when needed, etc. I desperately want to take this job, but if it could potentially leave me in a bind later on, the few hundred bucks isn't worth it. Please help and explain what will actually be reduced in benefits, and potential pitfalls in the future.

    I'm on supplemental social security Since 2012 I did not have enough work paid ss by like three months work .I was able to work for a couple brief stints that paid me very well. Can I qualify for SSI now if I have had enough paid in ?

      I recommend you speak with SSA to see if you’ve contributed enough quarters to start receiving SSDI

    My neighbor has section 8 housing, she orders from GrubHub Uber eats, she gets all of her groceries delivered, she's driving a brand new 2024 Lincoln Continental, and she bribed to me the other day that she only pays $150 for a two-bedroom apartment. And she gets $130 a month for a light bill. My husband is a veteran, we're lucky to get 256 a month for a one bedroom apartment, and we get no allotment for lights. And we are living on $1,379 a month for two people, and we only are a lot of 23.00 a month food stamps

    Where I live...in Kansas...there is an organization called Arcare that does pooled trusts, and they tell me there is a way for me to set things up in my own estate planning now so that it can go into their pooled trust for the benefit of my son and It's not a d4a trust or a d4c trust. In fact it would not be a self settled trust because I would be setting it up...before my death...to go directly to the trust (bypassing any direct ownership by my disabled son)...and there would be no medicaid payback requirement when my son dies. Does this type of pooled trust sound at all familiar to you? Would LOVE it if I understood more... The person in Arcare's trust department who's responsible for informing folks how it works is either insufficiently qualified to fully inform me or I'm incapable of understanding her. Not sure which but I can't feel comfortable opting in to this pooled trust without a lot more info....or even some good "search terms" so that I can research this type of pooled trust on my own. If any of this sounds like a type of pooled trust you are familiar with, I would be OVERJOYED to see a video dedicated to it!

    There is a woman in my apartment complex that has Section 8 and lives 6 months of the year in Brazil! She has been doing this for years. So USA pays to subsidize her apt in New York State while she is traveling internationally. $$$ paid for an apt with no one living there.

    I would not trust to have a pooled trust run by a non profit. I would rather pay the money it costs to create a Special Needs Trust. The reason why a founder of a non-profit organization in Florida stole $100 million from the pooled special needs trust using it as collateral for a loan.       Since risk is at an all-time high right now, perhaps you should be a little more patient and return when it has decreased. Alternatively, you can consult a trained financial expert for strategy.

      Yes true, I have been in touch with a brokerage Advisor. With an initial starting reserve of $80k, my advisor chooses the entry and exit commands for my portfolio, which has grown to approximately $550k.

    Can you do a video on what happens if you are on medi-cal and you either inherit or get a large pay check during one month only... Do they stop medi cal for month? Do you get bumped off completely?

      Since Medi-Cal doesn’t look at your assets anymore, if you inherit a lot of money, it shouldn’t bump you off immediately. But if that money starts generating income, that can interfere with your Medi-Cal or lead to a large share of cost. I recommend you speak with DHCS in your area to get more specific information for your situation.

      Medi-Cal eligibility rules for skilled nursing facilities is a little different than Medi-Cal in the community; you might want to check with an elder law attorney to answer your specific questions about what your SNT can pay for

    Hi Ellen! I just wanted to thank you for sharing very informative videos. I just a have a question. Both my parents are retired and has Medicare benefits. They’re both receiving sss benefits with approximately $1500 a month and my mom is collecting from IHss about $2400 as she takes care of my grandma. We recently applied to see for Medical benefit to see if they can help for some bills since my dad is going dialysis. Unfortunately their share of cost is 1600 a month. Is it better for them to purchase a supplemental insurance and drop the Medical? I’m a little confused about what Medicare cover. Thank you in advance if you reply.

      The share of cost rules are changing for the better in January 2025, I’ll be doing a video on that! In the meantime, you might want to talk with a Medicare specialist to see what Medicare covers.

    When set up 3rd party SNT, should we set up as IRREVOCALBE or REVOCABLE Trust? I heard 3rd party SNT has to be a IRREVOCABLE trust. I am in California.

      When you first set up a SNT, it usually can be revocable or irrevocable. However, once it is funded, it typically needs to become irrevocable.

    Hi Ellen, I just found your page and I’m hooked! Thank you so much for the creation of this content. This all such important information that all parents/ families should have access to and information IRC should be providing to their families but unfortunately that is not the case. We as advocates for our children have to comb through so much misinformation to find what we’re looking for. I unfortunately have not had a good experience with IRC and I believe it’s because I’m an informed consumer and a fierce advocate for my 14 month child. Knowledge is power.     My son had heart surgery at six month old. His med. file is 3 inches thick now! he got ssi in two months after we filed! He is on meds for life and was told to llive within one hours drive of a major hospital!!I.E. Leboner childrens. They even filmed his first heart surgery as he was one of the first! at 18 his ssi stopped ! and after covid delays and three years they said he not only get no ssi but owes 25 000 dollars because he got money during the appeal. He is still disabled and he could not graduate high school due to covid!! in fack R.S.V. and covid are major threats to him and he only goes out when the threat is very low or even not at all!95% of his time is in isolation as he was in quarinteen as a child!

      If you live in California, you should set up a CalABLE account for each of your boys, at www.calable.ca.gov. In this way you can avoid a Medi-Cal reimbursement upon their deaths.

    Is the $2,000.00 in bank account max includes the $943.00 monthly payment so you really only have $1,057.00 in your saving to not go over the max.

      Haha, I hear you! But don’t just dive in headfirst-trust me, I tried that. Before you start playing with your $125k, maybe consider getting some advice? I had a financial advisor who saved me from a few bad decisions. You’d be surprised how much a pro can help, especially when you’re just starting out!

    I moved to Texas..before I moved there I was getting 1058.00 Texas took money from me i am not even making..people on SSI get more than me..i get about 728.00 in social security disability and SSI gave me 333.00 but Oklahoma never gave that back I am not even making it i don’t know what to do I’m homeless because of this my friend has been letting me stay with them

    Do you have to be living with the parent at the time of death to avoid reassessment, or do you just need to make the home your primary residence after the death of the parent?

      No, I don’t believe you need to be living with your parent when they die to get the $1 mm exclusion from reassessment; however, you do need to move into their home within 1 year of their death and file a homeowners exemption form.

    I have a question about the sophistication trust explain to me how the social security office can give us a social security number and on the back of it has red letters on it in which it’s a card credit when we was born, but we do not know nothing about it until we look up information and find out we actually worth millions and millions of dollars because we withdraw this money from there because the red letter is like a credit card on the back of our Social Security card but the government don’t tell us about this and it’s a lot of people didn’t find out about this, but I’m asking you could you answer this question we have to do with the Social Security office and letters for the back of the Social Security code and they supposed to release that money, right?
