Fair Dealing
Source: www.gov.uk/guidance/exceptions-to-copyright#overview
Certain exceptions only apply if the use of the work is a ‘fair dealing’. For example, the exceptions relating to research and private study, criticism or review, or news reporting.
‘Fair dealing’ is a legal term used to establish whether a use of copyright material is lawful or whether it infringes copyright. There is no statutory definition of fair dealing - it will always be a matter of fact, degree and impression in each case. The question to be asked is: how would a fair-minded and honest person have dealt with the work?
Factors that have been identified by the courts as relevant in determining whether a particular dealing with a work is fair include:
* does using the work affect the market for the original work? If a use of a work acts as a substitute for it, causing the owner to lose revenue, then it is not likely to be fair
* is the amount of the work taken reasonable and appropriate? Was it necessary to use the amount that was taken? Usually only part of a work may be used
The relative importance of any one factor will vary according to the case in hand and the type of dealing in question.
Source: www.bl.uk/business-and-ip-centre/articles/fair-dealing-copyright-explained
The concept of fair usage exists within UK copyright law; commonly referred to as fair dealing, or free use and fair practice. It’s a framework designed to allow the lawful use or reproduction of work without having to seek permission from the copyright owner(s) or creator(s) or infringing their interest.
Fair dealing law is not only applicable to text-based works; it applies to musical, dramatic, artistic, literary and typographical works too. However, it does not cover the copyright of printed music.
As an exception to British copyright law, fair dealing is governed by Sections 29 and 30 of the Copyright, Designs and Patents Act 1988, which outlines three instance where fair dealing is a legitimate defence:
* If the use is for the purposes of research or private study;
* If it is used for the purposes of criticism, review or quotation;
* Where it is utilised for the purposes of reporting current events (this does not apply to photographs)
A statutory definition for fair dealing does not exist; it will always be a matter of fact, degree and interpretation in every fair dealing case. Nor is there a percentage or quantitative measure to determine fair dealing. The Intellectual Property Office lists the key factors used to determine the validity of whether a particular dealing with a work is fair as follows:
* Has the use of the work impacted negatively on the market for the original work? If the creator or owner has lost potential revenue through the re-use of their work, it is not likely to be fair.
* Was it reasonable and necessary to use the amount of work that was taken?
The Copyright, Designs and Patents Act 1988 also outlines the potential fair dealing defences that permit the use of copyright works without permission from the author(s) or creator(s) under UK copyright law.

Anyone who criticises the Chicken Song can speak to me
Fitting that Brian Adams is at 69 when he had a song about it 😅
Depeche Mode are the best!
'Achy breaky heart' surely should be there
His next single after that did ok in 2/3 countries and then i thought about that Old Town Road song from a few years ago and assumed people wouldn't allow him as a one hit wonder because of it, even as a feature. Cheers
Looks like Sweden, Germany and France dominates
Wow…Eminem and Coldplay!
Thank you for this video! You made me go back in time to a beautiful period in my life.
Thanks for watching!
Here to see George Michael and Wham!
You forgot two gems, All she wants is by Duran Duran and Love comes quickly by Pet shop boys, not all the songs you ranked are genuine synth pop
Buffalo Springfield should deffo not be on the list. Lots of bangers
Some of these sound so British
George Michael boyfriend girlfriend wants that when she comes out 🙂😷🤕 poor Alice hurting over Puch and of course my pens babe
Top 2000s songs by female artists part 1
Slide away its the no 1 with listen up, so underrated
Only Jay Sean is the only act or singer I saw personally. He is half-Indian actually.

Top 300 1900s songs ranked
There are some songs of the 80's not i ncluded but some of my favorites are included here thanks
Good video man, I enjoyed Have you considered doing the 2010s? Just curious since that's the decade I grew up in, so I'd watch a 2010s video for sure 🔥
Thanks! Definitely going to, probably going to do the 1970s first then the 2010s though
I don't think you can call Tears for Fears, Spandaue Ballet & Duran Duran synth pop
Some great English and Euro synth songs listed. I would like to add (3) from America: Van Halen's "Jump" & "Dreams" and Herbie Hancock's "Rockit".
Tears for fears deberia estar más arriba, y la canción nro 4 primera vez que la escucho, probablemente no sonó, ni fue conocida en Latinoamerica.
Only about half these songs were cheesy. Glad to see Madonna didn’t make the list.
I mean cheesy in a positive way anyway really, these are all great pop songs in their own right. Thanks for watching
Gary numan should have been higher
Donovan was Oirish
I saw that he was Scottish and moved to England as a kid? Maybe of Irish descent though. Cheers
Wow. What a precipitous drop in popularity of UK acts from the 80's video. While still a major player, the UK music industry has never reached the level of international popularity it had in the 80's and the numbers on this video compared with the same one for the 80's proves it. 74 UK acts in the 80's video vs only 20 in this one.
INXS, SNAP,
It's actually the Original version of Walk This Way from 1975 that has over 500M streams. The Run DMC ft Aerosmith version has 274M
I saw that at first too, but if you go on Run-D.M.C's main page on Spotfiy and see their top 5 songs, the 7" single version with Aerosmith does have 540m. Cheers
I knew all these were British. Pop music isn't American.
The 70’s best decade of my life. Thanks for the wonderful memories.
A brilliant decade! Thanks for watching
The only real surprise was The Pixies at 36. I'm not saying they don't deserve it or anything but they are an alternative rock band that never had huge commercial success, so how did a song of theirs get to 36 in the top 200 most streamed songs from the 80's? Is it in a recent popular movie or tv show? I know that's probably why Kate Bush is in here. Again, brilliant song but it's probably only in here because of Stranger Things.
Yeah it does have more streams than you would think actually, the only thing i can think of is Fight Club? I guess that gets a new generation of fans every few years, that could be part of it. Cheers
Bring me to life by Evanscence was not on this list. Google it’s Spotify streams, it should be high on the list.
Perfect list. I’d also add: Janet Jackson- Rhythm Nation Violent Femmes- Blister in the Sun Kris Kross- Jump Tears For Fears- Break It Down Again
Thanks, definitely plan to do other kinds of versions of this in the future
My top 10 1.slide away 2.supersonic 3.morning glory 4.hello 5.live forever 6.cigarettes and alcohol 7.some might say 8.don’t look back in anger 9.stand by me 10.songbird
oh man you really nailed it, but where its listen up?
@Jorgelabarra i hadn’t heard listen up before this video put just listened to it and I’d say it’d go 5th or 6th in my opinion
33 down to 1 really got ESPELUZNANTE! Got my teen years flasbacks... Thanks👍
Lol thanks for watching!
Most of these songs stink 🤷 jimmy eat world had more than 1 hit so lick my boom boom Down
These are some of the most well-known British acts ever. Where would anyone think Culture Club and Duran Duran were from? The Police and Eurythmics are as British as it gets.
My only gripe is that She's Electric should be on the list, and Slide Away should be higher. Otherwise a very good list!
Thanks, yeah it turns out i have a pretty unpopular opinion on She's Electric then, i have had quite a few comments about it lol. Ididn't realise it was that well liked by other Oasis fans. I don't actually dislike it at all, just not one of theirs i ever really think to listen to
I wonder why it is called "streamed"? nobody is making a transmission or live of what they're listening.
72%
83%
Todd in the Shadows has at least 100 songs for his series
Brilliant video! Please, please do the 70s if possible
Thanks! Definitely going to, i think ill do 70s next, then 2010s
FAIRYTALE OF NEW YORK DESERVED ONE AND ALWAYS WILL
Unless you're British 😂
College & Electric Youth at No. 18?! Seriously?
Should be higher or lower for you lol? Cheers
I thought mark Morrison was born in Germany?
If you are going to make the 70s lists, songs in Spanish that could be on the top 200: José Feliciano - Feliz Navidad, Oscar D'Leon - Lloraras (from 1975), José José - El triste (1970), José José - El Amar y el Querer (1971), Santana - Oye como va (1970), Vicente Fernández - Hermoso cariño (1971), Cadetes de Linares - Los dos amigos (1974)
Oh cool thanks ill add these to my spreadsheet now actually!
Roxette ROX!!!
