Having an affidavit is different from being caught red handed. An affidavit is a sworn statement which can be used as testimonial evidence in court if verified by the affiant by taking the stand. People should really be careful talking about these issues violating the principle of due process that is even enshrined in the Shariah. As a lawyer, there are so many cases of affidavits that has been later proven to be false or the affiant recanting on his statements. If he is proven guilty, then he should be punished but we don’t have the right to pre-empt that by claiming he has been caught red handed. If you don’t know about the details and technicalities of the issue then please have the humility to stay quiet about aspects of it you don’t know. May Allah guide us all.
