Hey good afternoon this is Mr. Wilkes. I found a charger discrimination against my job and also found another one. I went to HR and told her that I was gonna file retaliation against him and had to show that they were doing final stuff key is the lady in HR. She was trying to get my documents that was. my evidence to prove that I am being retarded against so she’s tricked me and told me let me make a copy of that. She came back and sat down to the desk. She never made a copy. She took my document and draw a line in it and said she gonna avoid it out, so what are you doing? Why are you doing that trying to grab and she tried to turn into threatening I was on my route sent somebody up to relieve me when I went back to Dispatch. They told me to go home. They’ll call me on Monday. been out of work like seven days me and the union rep president met with the company today so he showed them how they violated my rights agreed to pay me all the days I would missed out of work And report to work tomorrow what I should do before tomorrow please reply back thanks
@leedslawfirm Question: I was falsely accused of being verbally abusive with a parking lot attendant at a work event at the university where I worked. Rather than conduct an investigation of the incident, my supervisor wrote a reprimand letter (based on false accounts) and put it in my permanent file, which killed every subsequent opportunity to apply elsewhere at the school. I wrote a rebuttal, which was placed in my permanent file, but not disclosed to my unit’s HR (just the university HR). Later, when I disclosed my rebuttal to my department HR and requested that the reprimand be redacted until an investigation was conducted, I was fired the next work day. Here’s the question … Is my rebuttal letter and the consultation with my HR considered ‘protected activity?’ My employer’s actions didn’t follow protocol, but they’re not illegal.
@@sjenkins8468 unfortunately protected activity is limited to complaints made about discrimination based on a protected class (ie race, age, disability, gender). If your complaint was not about discrimination based on a protected class than under the law it wouldn’t be protected activity. @@user-cj6hi2yv3k if you are fired right after returning from medical leave following an on the job injury and workers’ compensation claim, this could be a form of retaliation. You should talk to an employment attorney to find out all of your rights.
@@leedslawfirm ok thanks the way they have been acting seems like they are waiting for me to return to do just that then sent me a text to check my email to let me know with my restrictions they dint have a position for me they have never been that type of company

Are the laws different for federal employees?
TWC wants unemployment benefits paid to be paid back since I got severance. I mentioned to them that I agreed to waive my rights to sue the employer under all the things you mentioned for getting severance. The employer objected to paying unemployment benefits and TWC sided with them is asking me to pay back. I can appeal. How do I deal with this? Thanks.

I tried to get a lawyer no wood take it when I got fired the superintendent told me there's no laws he wouldn't joking no lawyer would take mine I didn't know about the EE OC technology what it is now and find out anything I got hurt on time went back I think it was 3 weeks and I was online duty nothing over 30 lb and he told me I had to break down truck tires or be fired go home or go to work so I went to work my surgery failed big time had to have another one plates and screws horrible I think I got PTSD from it

I reported the amount of my severance payment. Twc call to verify with my employer. My employer told them that for 18 weeks of pay. So I got an email stating that I will not receive unemployment benefits until July 2024. I was making 4000 months. The package is equal to a total of 483.00 a week . What can I do

I’m experience this for the 1st time ever. I have over 20yrs working. My situation seems to be an odd one…. My co. Was bought out by another company. The new company has laid off several staff. So far, we’ve only got a verbal notification that we all will be be eligible for severance if we work up to a specific date…. None of us have received in anything in writting yet… We are 2wks away from our last day and now this new company is opening positions up and wanting for people to reapply🤔…. Everything sounds suspicious.
Why lay-off people , then try to rehire them back with the same payrate?? We refuse to accept same pay, but are worried if the original severance offer or the ability to file for unemployment would be jeopardized if we don’t accept the position that magically was opened🤔
With forced arbitration agreements MOST eployees have very little grounds for any discrimination, retaliation or especially protected concerted activities. Arbitration has little to do with laws that SAY they protect workers, especially since the Supreme Court demolished our ability to make claims under those laws oe federal agencies.

I have filed an EEO complaint, which when doing so, I saved recordings, printed out documents containing threats, and even used the documents they tried to erase from history to rebut their statements which I proved all 4 written statements to be false. At this stage their attorney asked me to settle and I also have shared a video recording on UA-cam of their internal EEO investigator taunting me and even admitting to altering 6 of my statements as she laughs and says "it will stay that way too!" When I told her I recorded it, her boss calls me screaming. Lol😂 the 3 basis of my claims are: discrimination, reprisal, and adverse action. Strangely they didn't dismiss or deny any of my claims because each one has a video recording displaying the employees name and number as solid evidence with a time and date stamp displayed. I've been granted a hearing and have 3 attorneys reviewing my details as I've spent $16500 so far. The agency I'm suing even sent people to home. When they realized they were clearly identified by my surveillance system on camera and also told I made a UA-cam video showing who they are, and the exact day they were here at my home, again they've asked to settle but rejected every offer I've made. Do you have advice? I have recordings and even proved that management not only tried to erase the history of me filing an initial EEO before this one that's going to trial now, but they also lied about it on one statement, then admitted it on the 2nd as Ive printed both out from the ROI. The threats will not stop and I've turned recordings in to people from the NAACP, law students around the country, and even made several tapes, I'm giving out to random people to get my story out. This May sound crazy but I'll share it all with you. This is all proven and based initially on reprisal due to a protected act. They tried to erase all proof of my initial complaint but when they found that i printed it all out and even found the investigator, they're being very aggressive. Willl your firm handle my case? Again, they are not denying my allegations at all as the eeo portal documents show.

. 4 years straight I was made to come in while extremely sick and be around food or id be fired. I finally got so sick and caught covid while working there and they ended up firing me for being sick because I followed the quarantine rules during covids "hay day". which was against the law and to get around what they did, they offered me my job back and apparently thats remedial action which absolves them of their crime (or at the very least no lawyer would take my case because of the remedial action) even though it cost me tons of money among other things. now my most recent job, Kroger; has done something similar while also breaking more laws. a little taste of said "iceberg" is as I was in contact with them the whole time, they put down I abandoned my job even though they knew it wasn't true and the person who signed and made said document was in contact with me the whole time (which I have proof) and the boss would not put me back on schedule to work. I even have proof they knew I was trying to contact them, but they ignored me even when I would go down there in person. "my" union rep who was working for them was working against me even though I paid my union dues. told me I had two options, either drop my grievance which I am not even sure she filed because she won't give me any of the paperwork that I never once saw or was asked about anything at all and when we had the "meeting"(which I believe was just them fishing to see what proof I had concerning what they've done) I was told I wasn't allowed to record or the meeting was mute. so, after they berated me and tried to blame me for everything, they told me to leave and continued the meeting without me which wasn't due to anything I did because I was corgial and polite the whole time. when I got their decision, I was told I had to either drop my grievance or be forced to resign. I told my union rep I want to appeal the decision and want copies of everything including the grievance that they stated was filed and we were in a meeting for among other paperwork which she wouldn't give me and said I had to choose out of the two options she gave me and that she would only send me krogers "offer" I mentioned above. resign or drop the grievance. just a taste of the bs they pulled. not to mention it wasn't just me who was sick, it was my 1 year old daughter who had a fever of 104 to 107 and was throwing up so much she wasn't able to breath. of which they were given doctors notes for my daughter and myself. do I have a good case ?

I am being harassed from a Walmart manager and I am an independent contractor. This manager has been harassing me for three weeks. I’ve gone to corporate I’ve written letters, but this Manager continues to harass me, denying me the right to work.
Unfortunately most of the employment discrimination laws are limited and only apply to employees who work for employers with a certain number of employees. As an independent contractor unfortunately the federal and state laws that deal with harassment in the workplace based on a protected class often don’t apply. I hope your situation improves or that you get another work opportunity where you don’t have to deal with this manager anymore!
What about exploration of misclassification of employee employer relationship? My non profit has engaged in racial slurs, banned from building, and supervisors tell other employees of color that they can not speak with Me. I have evidence recordings for one party state in Alaska with no help due to private contractors status.

It could be potentially, if other employees of other races have no call no showed and not gotten terminated. That may show you are being treated differently under the exact same circumstances (the only difference being your race). Yes unfortunately that can be the case sometimes. That’s why it’s always important to put your complaint in writing (even a text message will work). And be as specific as possible. You never know what could happen in the future!

I didn’t get terminated but they definitely hit me with multiple write ups leaving me to not be able to receive another and one of the write ups was 2 for the same reason
Yes, we see this a lot too unfortunately. Although a write up by itself may not be considered an adverse action under the law (like termination or retaliation) we all know multiple write ups can lead to termination. If you are getting written up unfairly and you think it’s based on discrimination, it’s best to report that in writing immediately!

Sorry to hear this happened to you! If you think you were a victim of retaliation you may want to contact an employment lawyer directly and see what your rights are. We see retaliation cases based on a report of race discrimination happening often. Story goes, black employee reports race discrimination, less than 3 months later they're fired for some bogus alleged performance issue or something like that. Thanks for watching!

Sorry to hear this is happening to you. It is not uncommon for employers to discriminate in this way, trying to force you out. You can make a report to HR and let them know that you feel like this treatment started once you notified you were pregnant. Keep in mind, that you have more legal rights if you are fired then if you quit your job. Working remotely can be considered a reasonable accommodation for a "disability." In this situation since breast feeding is not a disability, it would be best if you could show that other males are allowed to work remotely and you were denied as a breast feeding mother. Then this might be categorized as gender discrimination. Unfortunately, this is very often true. But if you don't say those words you may have no recourse after you are fired. The company will often claim they had no idea such discrimination was happening.

What if you signed a contract with the company about not getting in more trouble which I did not,however I reported my supervisor for harassing me to H.R I got back to work 3 days later my supervisor personally escorted me off the property without telling me why..that's retaliation the very mere fact that's not his company to tell me I'm fire that was h.r job to do so,they investigated 3 weeks allegedly,however I felt I was aslo discriminated against the fact he was working while the company was investigating the whole matter...
Under the federal anti-discrimination and retaliation laws, your complaint about your supervisor harassing you would also need to include that the reason you believe the harassment was targeted towards you is because of your protected class (ie. your race, disability, gender, sexual orientations, religion…) The EEOC has some helpful guidance on its website that further explains what protected classes are and how that relates to a retaliation claim.
