Why SONA (Songwriters of North America) Supporting The Music Modernization Act Was A Bad Thing
Recently I Tweeted the following:
"SONA supported and lobbied to pass the music modernization act, which does not require songwriters to get paid these royalties. Instead, they can be taken from them, and handed disproportionately to the majors. Why did SONA support that bill?"

    Yes, The MLC licenses and collect for downloads if they are licensed via the Compulsory. If I messed that up my apologies. That said, most downloads come via iTunes and those are not flowing via The MLC but under the prior agreements with distributors and labels.,

      What's off is things are the same as they were before The MLC only worse. That is, before the MLC Spotify etc was to license and pay songwriters their mechanicals directly. they did not in many cases. All that has happened is the MMA has inserted a middle man between spotify etc and you to pay you. Nothing in the MMA requires the MLC to pay you anything but does rewards their board of directors if they do NOT pay you by along them to take your money forever after a period of time if they do not pay you. And just like before, it's HFA behind the scenes not paying. Thats what The MLC has a purported $660 million in accrued but unpaid royalties sitting in its coffers. Now when they dont pay you they can take it forever. Before they could not.

    why is it that songtrust only does all in collection and doesnt allow their members to collect ONLY outside the USA? MLC is already collecting for free in USA, so why should songtrust commission those royalties.

      Then I would leave Audiam. I did. Almost 2 years ago. They are now owned by the Harry Fox Agency and Sesac. The same Harry Fox agency that was sued by Eminem eight Mile style for contributory copyright infringement And fraud

      @@JeffPriceArtistCore what exactly did they do, keep the money or co sign in behalf of artists rights with out their knowledge, cause Audiam is full of crap This Beth person sent dozens of emails to a friend because she posted a track on UA-cam before Audiam's site and it was an issue when she posted it on audiam, ok so instead of telling this BETH claimed that Audiam can not submit her music for monotization with UA-cam if she used a DAW, Loops or samples., after 11 crazy emails and 2 weeks past Beth continued to not admit that UA-cam indeed allows DAWS and if anything not loops cause they cause problems,, but this was not why audiam could not accept a new mp3-work from my friend, it was simply that UA-cam had it first and protected my friends copyrights after audiam claimed it... after sending this Beth info UA-cam shared to clear all this bs up Beth stopped replying altogether,....thats abusively manipulating., where they afraid that it would appear as if audiam claims the actual rights as owner in behalf of the artists and did not want my friend to know?? audiam later again wrote and told her about another track she posted on UA-cam before sharing a copy with audiam, this time audiam told her that she cant have a tunecore or cdbaby account or upload work to UA-cam PRIOR to Audiam if she uses their services, but its ok to do so with distrokid... so how is anyone suposed to sell their music or post it on UA-cam if Audiam says they cant cause it interferes with them submitting it for monotizaztion? what does audiam do I thought., they certainly did not submit anyones work to UA-cam as far as I understood. the author owner artists does. THEN she got one song flagged by UA-cam who said Audiam (label) and 3 publishing companies claimed it, making the video soundtrack inelgable for monotization., crazy..the audio is muted.!, audiam claimed that yOUTUBE mistakenly confused the title with another artists while UA-cam claimed they use audio detection software according to some standard that detects who's audio it is regardless of a title and its audiam who is claiming ownership, audiam says take it up with UA-cam because this track ( of all 150 songs submitted to audiam) magically did not contain composition rights as well as audio, total BS of course as my friend said all her tracks are her compositions and on audiam site under audio and compositions.. but this suddenly changed with out notice and audiam claims she has too contact UA-cam, so she did ad she got an email saying the copyright claim stands with audiam, now another track is ineligible for monotization and mute in a video. Audiam did not correct or suggest to if I t was their fault, instead they said they cant do anything about it but claim ownership and block. monotization which makes no sense but that they are controlling ownership here of this girls track. Quitting Audiam also takes a year btw

    1hr 43 minutes and this is the reason why becoming the 4th major label is a long stretch to obtain. Looking at it with my street knowledge, the 3 major labels are the mob and 3 separate families... so I'm building my family and funds. I have a lot of growing and work to put in and accomplish, but its going to happen. I understand and respect the game, shit I love the game and I play to win, play hard and work harder til the very end. respectfully Im going to earn a sitdown with the families and I will continue climbing up the ranks until that day comes to pass, my goal is to be a boss, not a capo or underboss not forever at least. Yea I know I can be shot for it, but it wouldn't be the 1st time, and I never move in fear. I'm not being cocky or boasting or being disrespectful towards anyone or organization. I just believe in my cause and willing to fight and die for my cause whether with a million people or by myself.... not one successful person made it to where they are alone, and I'm grateful for this knowledge and will absorb it, study it, continue gaining learning and using my instinct, book smarts street smarts... etc 😆 (for all those saying wtf does this guy think he is?) I AM .... two things I came into this world with and leaving with that's my word which is bond and my most valuable possession and my balls, some big ones at that too... peace and blessings ✊🏽

    Great material. In my opinion, the big 3, around the 2010s may of observed their spreadsheets losing major capital when services like napster and torrents made music available for free on the web and we're at the ends of their ropes, when vinyl /cd's stopped moving. It wouldn't surprise me that the nmpa, fox, and the big 3 worked like shadows, blurring rules to create the platform, to tame the wild west of mp3s. Rather than it being a $B dollar company, like radio, is one of the more popular means to promote music. Radio -artist 'hey our song is on radio top 10. Spotify - artist 'hey our song has x# of plays. More attention more tours, better deals, magazine placement, etc. As an 'ad driven service,' maybe revenue can return to normal like it was during Bmg, Cd era!

      No, there is no relationship between TuneCore and Audiam. I would not suggest using TuneCore publishing. TuneCore does not actually do they job. Works like this. You-->TuneCore--->other entities that do the job -----> places using the music. So layers of middleman that do a mediocre job taking your money.

    Jeff, thanks for the great content! I want to be sure of something. If an independent label wishes to record one of my compositions (one that has previously been recorded and released in the past), what does the label have to do if they only intend to distribute it through interactive streaming platforms? Do they still have to send me an NOI as laid out for compulsory licenses? I believe so because 17 USC 115 www.copyright.gov/title17/92chap1.html#115 states: "(2) Digital phonorecord deliveries.-A person who seeks to obtain a compulsory license under subsection (a) to make and distribute phonorecords of a musical work by means of digital phonorecord delivery- (A) prior to the license availability date, shall, before, or not later than 30 calendar days after, first making any such digital phonorecord delivery, serve a notice of intention to do so on the copyright owner (but may not file the notice with the Copyright Office, even if the public records of the Office do not identify the owner or the owner’s address), and such notice shall comply, in form, content, and manner of service, with requirements that the Register of Copyrights shall prescribe by regulation; or (B) on or after the license availability date, shall, before making any such digital phonorecord delivery, follow the procedure described in subsection (d)(2), except as provided in paragraph (3)."

      no. If a recording of your song has been previously released, it means there is a "first use". This then means the license for the composition does NOT have to be obtained or paid for by the record label. Until Jan, 2021 the burden is on the streaming music service. After Jan, 2021 the MMA kicks in. At that point, the music services get a license to all the compositions in the world (past, present and future) not have to know whose music they are streaming and not ensure anyone gets paid. They hand all the money and info to the MLC. It tool does not have to know whose music is being played and also does not ensure anyone gets paid. For anyone that does not get paid, they can take your money and hand to the board members of the MLC that also work with the NMPA.

      Audiam works for and is paid by the music publisher. HFA works for and is paid by Spotify. HFA looks out for Spotify's interests. Audiam looks out for the music publishers interests. This explains why HFA was named in the Spotify copyright infringement lawsuit for colluding with Spotify to commit infringement. The complaint alleges HFA worked with Spotify to infringe on copyright, hide the infringement to protect Spotify.
