Lorient Visit to ORC Outremer (Keel broke off mid-Atlantic - Marsaudon ORC42 Catamaran Part 2)
This is a follow up to the video that I put out 2 weeks ago, about a Marsaudon Composites TS42 Catamaran which lost a keel (ua-cam.com/video/d19_JsCDjEU/v-deo.html). It details a trip to Lorient, at the invite of Grand Large Yachting, the new owners of the yard where my boat was built. We also take a brief look around the area to understand the character of the sailing community there.

    It's a sad story and you explained the situation perfectly. MC went bankrupt, the assets were sold and the liabilities were not. The receiver has the liability and the proceeds from the sale of assets. Like a vulture, they think they can swoop in, strip the dead company of assets which they then sell, and avoid the liabilities. That's who you need to go after. The new owners of the assets only really want to disassociate themselves with the previous business. That's how I see it.

    Tough situation! Seems the current did not purchase the company that manufactured your boat, they bought the production assets. Did they assume any liability for a boat built by the company that built your boat it appears not. If they have offered to repair your at a very reasonable cost, that may be the best way out. With a good lawyer, you should bring legal action against the actual builder. The case would rest on the fact that they built a life-endangering product. Good Luck!

    What a mega- heart aching injustice. I guess this could only get more heart renching if you can't pay your power bill and you can't stop the authority cutting off your utilities. How will you make your kids next dinner? You're so self unaware that it's puke making

    If possible get all your money back and walk away… Don’t get entangled in a partial settlement to keep your boat unless that’s the only way to get clean? If you can get out fully alive do it…I would never buy a new production boat unless it was a truly Blue Water ship. Your catamaran does not qualify. Good luck?

    Take the money, then buy your old boat back at scrap price( it must be very hard to sell... )and repair it.

    I saw your 2nd video before the first. This answers many of the questions I posted. Those keels would surely be intended to be sacrificial? It would be very risky to have them made strong as that would threaten the hull integrity during a grounding. Certainly the laminating faults should have been picked up and dealt with during build ..... but unfortunately commercial pressures (greed) come to play to avoiddelays in the production line and completion date. Many resin infused boats suffer from this problem , some only being picked up on a pre-purchase survey, perhaps 5 years after build. I am a surveyor. I strongly believe that new builds should be surveyed by the customers structural surveyor during the build and prior to completion .... However I know some yards strongly resist this.

    I suppose I will find the answer to these questions in the first video .... but 1 how did your boat become the property of the receiver? 2 when did the faults first become apparent? 3 did you pre-purchase survey cover the structure? What was their opinion? 4 are there proved failings of design? 5 was the build as specified in the design? I am a chartered naval architect (CEng MRINA MIMarEst). I survey ships and yachts. I also own a 1988 Crowther Catana 40 .... which is built similar to the early Outremers.

    Heartbreaking tale. I understand that it's very much a first world problem but that doesn’t change the fact that you are the victim of a series of injustices and that your plans and retirement dreams have taken a severe blow. I hope that you will eventually receive the compensation that you are owed.

    Don't even consider anything but taking the money. You can express your thanks to Outremer but you have no obligation at all. Buy a smaller boat and do more pleasant sailing in the region is my advice. If you want trans-Atlantic crossings, do deliveries of someone else's yacht as you already are.

    This is soooo wrong!!! This man works his entire life! Buys a product to now be ?? Left with what? Ask for his yacht back, spend 100’s thousand to fix poor laminate and end up with a boat 10-20% heavy from intended. I’m very sorry for your loss

    1- Take the money 2- Rebuy the boat ( value is probably very low) from liquidator 3- Repair it from GLY

    Damn, terrible story, A friend of mine is working for marsaudon, i know also people from Gsea Design, and even know the president of the Lorient court. I visited the constuction site last year, from what i see, Infusion look good on newer boat. But first TS42 were probably crash test sadly. Marsaudon was near bankrupty for a long time, so it explain a lot of thing. Everyone are dedicated and passionnate but well, it's hard thing to build boat properly.

      The receiver still has the boat and he's still refusing to talk to us, so we'll need to wait until after the appeal judgement. That court still has not set a date and it seems like it will be next year :(.

    Take the money John, don't risk it? You owe it to yourself and your wife to take the money and more on. Find a builder that appreciates and looks after their customers. Maybe get an aluminum cat, much stronger and durable.

    So the case you fought was civil. With regards to the risk of drowning, is a criminal case perhaps still possible? And yeah, i'll never buy anything off these idiots, not even a Garcia. Frauds the lot of 'm. They should be held responsible immediatly! Let's flood their social media!

    After watching your post and also Parley as well as being involved in repairing a Cat. I’m sceptical of all Catamarans. The stresses imposed on the twin hulls by the rigging is too critical. I think the older Cats that are built from a mold glass laid were pretty strong and stood the test of time and sailed well. However, good sea keeping qualities that they have, came at the cost of comfort and domestic ergonomics. I wouldn’t touch a glassed over ply boat with a fifty foot pole. I’m definitely a mono hull man. But even then, some of the production monos are duds. But there are some fabulous designs out there in mono hulls, you just need to research them. My advice, get out of Multihulls.

    Thanks for the information, John. Personally I will never consider any of the Grand Large Yachting brands, not Outremer, Gunboat, Allures, Garcia... none of them. They must be shunned until they do what is right and proper, and make things right.

    Hi John, unfortunately your experience is more or less standard in the (multihull) industry, which is very disappointing and frustrating. We have owned 3 'production' catamarans before and they all had minor and major issues. It is a shame that the former owner and especially the administrator does not treat you correctly. I know the former owner(s) from MC and GLY quite well. The first time I met Xavier they just took over Outremer. I have a lot of respect for Xavier and his team. They make great yachts and they also have many isues with their launched boats. It is mainly the way how they solve these issues, they stand behind their product and I am convinced you can reach an agreement with the new owners of MC. We now have a custom made performance cat and this boat has also many issues(due to quality and incorrect design) but the yard/brand stands behind their product and solves all issues. I would opt for the refund and restart your life together with your wife, enjoy life on a new boat(well conditioned second hand). Stay strong, perseverance wins, respect!

    Sorry to say it but to answer your question; Yes, you are nuts to still even be contemplating having anything to do with the boat when you have the option to take the money and run. Your original video has 150k views. Who in their right mind is ever going to buy that boat from you when you're done with it now that it's infamous?

      IF it can be properly repaired, can pass a marine survey with flying colors and has been documented to have crossed oceans without breaking - then why wouldn't someone want to buy it? I'm however only a layman at this stuff and can of course not say what the price may be at such a hypothetical future sale. But as always: Due diligence and all that stuff...

      @@angela1984a You're buying a car. You have a choice of two, they are the same model, age and mileage. One was a dud from the factory with extensive damage that had to be repaired and the other one isn't. Which one are you going to buy?

      @@MonstaMunch101 What if all of the cars from the factory had a design flaw, identified by a court expert, and it looked likely that all of the cars left the factory with the same poor build quality? Could the one car that has documented repairs and redesign be an interesting choice? What if the cost of buying and repairing it enabled a sale price that was well below the price of all the cars with unknown histories?

    First you must figure out if REALLY all dry spots can be found, not just the easy relatively superficial ones. (Acoustic hammer, scans). Else the repair is simply not an option. Imagine a structural beam ripping apart in a storm after some years of silently cracking, just vecause it had a big air bubble in the laminate. Excellent behavior of the GLY leader

    I'm very glad to learn that you have the possibility to make a recovery. It is striking how many specialist boatyards and their guarantees have a short life. My own boat was built by four yards with a production run of 19. For sure, it would be interesting to see a log of the repairs, but I believe it would be wiser to bring this story to a close and to start afresh.

    Fair play to Xavier. John - u have had enough stress. Your wife & you will never have 100% confidence on the old boat (even if you got it for a bargin) - resale will be effected by repairs. Take the money and move on enjoy life. Prehaps Xavier will do you a deal on a Outremer.

    Do you know of youngbarnacles here on UA-cam? Shane Young and his wife owns a ~30 year old Catana 42 that they've been fixing up and modifying. He seems to be a pretty knowledgeable guy. Has for instance changed his steel chainplates to carbon fiber ones. According to him a cool thing about plastic boats is that they can be fixed if they brake... I'm however just a layman at this, so due diligence and all of that stuff...

    i hope you are able to get the boat back and get a partial refund that will more than cover the costs of the repairs, and i hope the new company has made the changes necessary to properly fix the damage, and that they are putting out boats of only the best quality. i would definitely be interested in seeing a series on how they go about the repairs. you got my subscription
