    Wait, if I earn $120,000 or less abroad as a salary, I am exempt from paying US taxes??? No kids or property. Just strictly income taxes I mean. I thought I had to pay twice, in the foreign country AND the US. 😖😖😖 this is the new tax law right? It got updated January 1, 2024

      Great question! It sounds like you're referring to the Foreign Earned Income Exclusion (FEIE). Here's how it works: As a US citizen living and working abroad, you may be able to exclude up to a certain amount of your foreign earned income from your US taxable income. For the 2024 tax year, this exclusion amount is $120,000. This means that if you earn $120,000 or less from your salary abroad, you can exclude that amount from being taxed by the US. Each year, this amount increases slightly!

      It is still considered foreign earned income as you are physically outside of the US doing the work.

You can get caught up on your taxes via the Streamline Procedure: www.myexpattaxes.com/streamlining/ It includes: 3 years of tax returns and 6 FBARs without failure-to-file or FBAR penalties. If you qualify, you will not be subject to penalties such as failure-to-pay, failure-to-file, or FBAR penalties-awesome! The program also allows you to file amended returns to claim missed returns on qualified foreign pension plans.

    If you are a retired US citizen, and a tax resident of Spain and your only income sources are US Social Security, a Private US pension and a US 401K distributions , all of which you are required to pay income tax to Spain on. Can you use the foreign Tax credit on your US taxes for these taxes paid to Spain to avoid double taxation? Or is there some other way to claim credit for taxes paid to Spain since this was US sourced income? Thank you.

    If one does have taxable earned income, does it have to total at least as much as the IRA contribution made in a year? Or can one contribute 7000 dollars per year with only 1 dollar in taxable earned income?

      Hi there, if you have a business operating from abroad, you will need to claim that as foreign-earned income on your US tax return. That doesn't necessarily mean that you will owe!     Can I file my taxes, claiming my nonresident alien wife and her son from the Philippines Do I just send in ITIN numbers and they will assign SS numbers. Think I read that somewhere. Sempre when she comes here, which we're working on, she will get SS card then. She will work.

      If you want to file and claim them (married filing jointly, with dependents), then they need ITINs. Otherwise, file marry filing separately, and no ITIN is needed, but you cannot claim them. You can model your return without them first on MyExpatTaxes, and if you need them for further deductions, look to change to include them and start the ITIN application process.

    I have always been on income exclusion, but I never filed taxes as a US citizen. I moved abroad when I was 18 years old and never kept residency in the US since. And I never knew I had to file annually. It took me so long to finally get a job and all, but I'm still on the income exclusion. Should I file anything?

      Hi there - if you have not filed your taxes since moving abroad, you are not technically under the FEIE. To use this option, you must file a return! We suggest you consider Streamlining to get caught up and receive those COVID stimulus payments if eligible.

      By using the Foreign Tax Credit! American families abroad should not be using the FEIE if they are due for a Child Tax refund! According to the IRS law, families using the FEIE cannot claim the refundable Child Tax Credit. There is a better, more different method to reduce US tax liability to $0. The Foreign Tax Credit is a straightforward approach. It gives US expats a $ for $ (or pound, euro, yen, etc.) credit from income taxes paid to your foreign host country against any US taxes owed. Generally, the FTC works best if you live in higher-taxed countries like the European Union.

    I am confussed, I married in the Philippines. My wife has never been to USA and never Plans to even visit USA. I filed my tax report as Married Filing Separate. Does she have to get a ITIN and file any tax reports annually ??? confused what forms and what to do.

      Hi there, it depends on his filing status. Assuming that he is a young person and single; if he did not earn more than $13,850 in wages (not self-employed!) then he does not need to file.

      @@FransceneJK98 Hi there! The need to file is based off of certain thresholds (Are you married to a US citizen? Are you married to a non-US citizen? Are you single? etc). Then there is the FBAR: if you have more than $10,000 in any combination of foreign bank accounts, you will need to file a Foreign Bank and Financial Accounts (FBAR) to FinCEN. This report is mandatory for those with $10,000 USD or more; and is not reported to the IRS, so you are not taxed on this money. Hope this makes sense!

    Natalie how can the IRS violate the 4th amendment by demanding our foreign bank information. We are exempt up to $110,000 in foreign earned income but the IRS wants us to report if we have $10,000 or more in our foreign banks! How can this be? It actually makes no sense

      Hi there! The FBAR is not reported to the IRS, it is reported to FinCEN (Financial Crimes Enforcement Network) "is a bureau of the United States Department of the Treasury that collects and analyzes information about financial transactions in order to combat domestic and international money laundering, terrorist financing, and other financial crimes." We can understand that it is frustrating, but it is mandatory.

    Thank you for your video. We are doing our taxes with Myexpattaxes. We are self-employed and residents in Chile, one of your employees told us via chat that Chile wasn't in the list of countries with the Totalization Treaty, but watching this video I actually found we are. We were ready to file our taxes. I don't know if I have enough time to get that paperwork here, I am pretty overwhelmed 😭

      Let us know your email with MyExpatTaxes. You don't need the certificate of coverage to file, but we need you to confirm you were registered as self-employed there to invoke the treaty.

      @@MyExpatTaxes hi! She confirmed that Chile is part of the countries with the treaty. We both are registered in Chile as self-employed, we have been paying for our health here since we moved here two years ago. We were able to get the "certificate of coverage" that you get for being registered, however, that certificate doesn't show any amount of payments, is just a certificate showing that you are registered. My question is (we emailed this, with no answer yet), If we have the certificate of coverage, that shows that we are registered, but doesn't show the amounts payed, is that enough for the IRS to invoke the treaty? We already filled our taxes with you and payed FICA taxes. Can we fix that and get our money back? Thanks

    Hi there! We are using MyExpatTaxes this year, but we just learned that as self-employed individuals, we still have to pay FICA taxes, which is a 15.3% of our income (ouch). We have been full time residents in another country for the past two years and a half and we were definitely not expecting to pay such a high tax bill, for something we don't even use (Medicare). Other than claiming business expenses, is there a way we can reduce the huge amount of taxes? Thanks

    Hi Mam, I am working in USA having employment visa. However my wife is living in India together with my 2 kids and she is not working in India, however all of them have the USA dependent visa.     Hi! In 2023, had an accountant file my U.S Taxes as an expat, going all the way back to 2020. What would be the easiest way to know if they claimed the stimulus payments and that they filed FBARS in those years?       Hi there! If they were filed, you would have needed to sign off on the FBARs. For the stimulus checks, you would have either received a check in the mail or a direct deposit from the IRS.

    So great to find you. Thanks for this fantastic information, so clearly laid out. Is there anything in the US tax code that would reduce federal income taxes on US-derived W-2 income earned in dollars from a US company while living abroad full-time, working remotely, and coming back to the states about 12 weeks per year to visit prospects, customers, and the home office? We are going to sell our US residence, domicile in South Dakota (where, I understand, you can rent a mailbox and pay zero state income tax without owning or renting a primary residence, or, for that matter, any real estate). We are planning to buy abroad and school our two teenage kids there, so we will really be living there.

      Hi there! The Foreign Tax Credit could work if you're paying Foreign Taxes on your income. AND, if you're visiting customers & projects in the US, this would be considered US-sourced income and might require state tax returns to be filed (depending on the specific states we're talking about).       US Expats are required to file a US tax return even while living abroad if they meet the threshold for their applicable filing status. Thankfully, due to tax benefits, most expats will not end up owing the IRS!

      If you own more than 10% of a foreign corporation, you will need to file Form 5471.

    Hi, I am retired now, do I have to file my Canadian registered retirement plan on 1040 or is it possibly reported on line 5a and 0 on line 5b

      If the RRSP plan is employer related, then you cannot exclude it via the Canadian/US Tax Treaty. Normally only Old Age Savings pension income is seen as social security benefits and possibly excluded. In any case Form 8833 is needed to claim treaty benefits, so you basically need to still do a full reporting. Sorry!
