      In many instances, it appears they won't be enforceable. However, you will want to consult with an attorney to review your specific agreement to be sure.

    I like the discussion, but as a Director of Laboratory Services and a former I.T. Director, it seems the focus is not where I would have it. Pre-Analytical is where we lose time and have errors. we auto verify 87% of testing already in Chemistry. But if you've seen 1 lab........you've seen 1 lab. 😂

      In many instances, yes. However, it will depend on their employment status as mentioned in the video (ie: whether they are a contractor, etc.)

      @@LighthouseLabServices I’m an independent contractor. I work as a real estate agent. I signed a non compete with my team lead but now I want to go off and be a solo agent. The non compete says I can’t stay at the same company but I don’t want to move to another brokerage. Do you think I can say “sorry I’m staying here as a solo agent. The non compete I signed is no longer enforceable and you cannot tell me which company I can and cannot work for”

    Insurance companies add no value to medical care systems. Negative value in fact. They take money from employers and employees in premiums. They take more money from employees/patients in the form of deductibles and co-pays. They don't reimburse providers at their full rate. They have vast amounts of power to set rates low and deny claims. They are a parasite on healthcare.

    My two cents, becoming a scientist is hard, the undergrad courses are tough and align with PA school or AA schooling. Many students end up just going into those fields hearing and seeing that the earning potential is much better in those fields vs lab positions.

    I see many leaving due to low pay vs going into say PA, LIS, even nursing. Also having a lack of one unified organization for scientists not being licensed in all states etc.

    Between Stark Laws preventing self referral and EKRA laws preventing any payment for referred lab services, and the fact that all Medicare and Medicaid HMOs go after Physician Owned Labs for fraud and essentially shut them all down from 2018-2022, and the fact that the vast majority of commercial payers laboratory reimbursement policies flat out say they will not reimburse a POL- I am frankly surprised to see this video. I would encourage anyone who is thinking about opening a POL to seek out the Best attorneys in the business. Red Flag Caution. Big time no-no.

      Thank you for your comment, Sean. The in-office ancillary services rule explicitly allows physicians to add lab services to their practice. But you're right to highlight the complexity of opening a physician office lab (POL). There are many rules and regulations, a few of which you cited, that require careful navigation. This is the primary reason why physicians partner with Lighthouse Lab Services. We provide end-to-end guidance and help new labs avoid potential missteps. And while there are reimbursement challenges in your home state of Ohio, where Ohio Care Source isn't doing physicians any favors, there are many areas where compliant labs can thrive.

    There is a false premise fallacy that a DCLS cannot learn or apply deep scientific principles that a PhD learns. If the argument is that a DCLS cannot be a high complexity lab director because of the lack of research experience, then why is a MD with no laboratory research experience allowed to hold such a position? The answer is because CMS does not require a high complexity lab director to have research experience. The “lack of research experience”, is not only a flawed argument when discussing the qualifications of a DCLS as a HCLD, but it’s also an outdated one. While research for a DCLS is an important conversation, this is simply not the place for it. Don’t worry, the patients will be in good hands!

    Medical Laboratory Scientists have contributed alot and it unfair see some healthcare providers standing on the path of career ladder of DCLSs. Are there plans to have College for DCLSs where all practicing DCLSs will be registered as Fellows? There is need for DCLSs Fellowship. There is need for DCLSs trained in different institutions to be sharing information and making contributing to a membership college. Am not comfortable to see DCLSs using MLS as if they only have undergraduate degree. It's time to register all practicing DCLSs as Fellows. Fellow of College of Advanced Clinical Laboratory Scientists (FCACSc or FCACliSc) Or Fellow of the College of Doctors of Clinical Laboratory Science (FCDoCliSc).

    Professional doctorate degrees alone do not provide the skills necessary to be a clinical laboratory director. The programs I looked into focused more on advocating laboratory services to medical doctors. It would be nice to see a PhD program developed to train clinical laboratory directors... but needs to be free of the ASCP or NAACLS trying to control the program or certification process.

    Hire one or two DCLS to be lab managers. That would be a good idea because you need a professional scientist on the floor into the lab. Someone who understands the science behind what's happening at a certain level. DCLS can do that. They would /will be a great asset cause technicians are always in need of someone with more scientific knowledge then themselves to better understand what they are doing etc. Plus their management skills will help. In terms of medical direction, I think that the best thing to do is to pick a person who is a full blown lab rat biochemistry PhD, who's published papers as a researcher etc and bring this type of candidate into the medical field by training that person as a clinical chemist on top of his PhD. Because if you don't do that, the person you're gonna put in charge of the lab will not be able to do any technology transfer from hard core academic scientist labs to the patient. Plus, other types of candidates will lack that edge in mathematics that PhDs are kind of forced to develop at some point and that is required to perform and develop new quality controls for new methods. Oh! And of course, students will go for a DCLS instead of a PhD if they can become a clinical lab director without getting a PhD. OF COURSE they're gonna do that. Why?Because getting a PhD is very hard... so to me, I'm sorry, but recruiting someone with a bacchelors degree, giving this person more classes and thinking he's gonna be an asset to the medical field as a lab director is just dreaming awake. Leveling down.

    I love the idea of increasing the programs to get more workforce but majority of the focus should be on current workforce, they are holding down the forts. We need better work environment, better salary and most importantly RESPECT. other professions forget that without us, their professions are in trouble also. They can’t work without us !!!

    This I think has to do with competition more than anything else. Many pathologists are really not equipped to direct a lab technically. Their expertise might be in diagnosis and even in test selection. I was part of a group of a group pushing for DCLS for many years. The DCLS has the requisite body of knowledge, the technical expertise and the experience to direct a clinical laboratory. I go so far as to say that if I had to choose, the DCLS is often times MORE qualified to direct today's laboratory than any other doctorate. As I said, this is not based on logic or facts; it's a reactive knee-jerk reaction to possible competition.

    Hello Dr. Bell … you mentioned that you went up the ranks and served once as a lab director before you receive your DCLS. I’m sure your doctorate degree is very much an advantage but do you feel your experience and your degree at that time was inadequate to be be a good admin lab director?

    I am in support of DCLS as lab director. However, the current criteria to enter a DCLS program is for generalist only. I personally do not feel a generalist DCLS is qualified to run a molecular lab. However, a molecular CLS specialist who were to graduate with a DCLS would be. I think there needs to be more discussion regarding this degree option and how it can help the field and I think it doesn’t need to be limited to only generalist. I believe having a specialist field option would be extremely more helpful in the industry.

      There are clinical fellowships for molecular scientists. Molecular specialty labs most likely won't even consider to hire anyone who hasn't completed one of those clinical fellowships as their LD. Those fellowships are only offered to MD/DO pathologists or PhD graduates. I don't ever see them allowing DCLS graduates to be part of those.

    Thank you for putting out this crucial update in a timely fashion. Ann - I have done registration with MolDx in past but didn't have to go through technical assessment. About how long it takes for them to perform the technical assessment for a mid-size ID panels ? Thank you

      You're welcome Ahmer! It's big news. To answer your question, TAT for the technical assessment is around 6 weeks, but could be longer depending on bandwidth. Labs should keep in mind that every ID Lab in a MolDX MAC will most likely be submitting/working through this process, so there may be backlog.
