Patna high court rejected the verdict of enhancement of reservation. After conducting a survey by patna govt . It was evaluate that in that state the no of backward people are increasing day by day. So the verdict of enhance reservation by 65%. But patna high rejected the proposal of enhancement the reservation.

Patna government have extended the reservation list of backward classes, extremely backward classes, SC and ST which rouse to 65% but the Patna Court had put a halt on it because as mention in the Constitution only 50% reservation is applacable. But reservation is applicable when their will be some special criteria. My view to reservation is reservation should be their we can't change it but we can be modified.

Nitish Kumar regime's efforts to raise reservation for backward communities(bc) was struck down by the Patna high court as it is liable to be unconstitutional. It has clearly been mentioned in the verdict of Indra Sawhney, on reservation exceeding 50%.
The government of Bihar hasn't considered the proportionate representation to implement the reservation of bc to 65%.

The patna high court cancelled the reservation that was above 65% which was unconstitutional according to constitution which is overall 50% . This quata was based on caste like scheduled caste, scheduled tribe caste. It is above 50% some conditional situations like far- flung areas.
1- Recently, Patna High Court struck down the enhanced reservation application for several communities, which was exceeding the 50% benchmark.
2- It was a huge blow to the Nitish Kumar Govt. which had planned to utilise Caste Survey findings to expand its action programme.
3- It is only allowed to exceed the reservation ceiling in extraordinary situation like remote or far-flung areas.
4- It is hard pill to swallow, as Bihar is backward in most of the parameters of human and social development and still get denied to exceed the reservation.
5- This raises questions whether the Caste Survey has done properly or not.
The supreme court has strike down( cancel) to increase the reservation quota( fixed share) up to 65% as it is illegitimitate(illegal) in the constitution. there is no preamble( prologue) in the constitution. Why cm of bihar wants to increase reservation quota this is a big question. We have stymie( prevent) this type of decision

Bihar government decided to enhance the reservation of BC and EBC giving a castewise breakup of backward class population in bihar ....But patna high court refused to implement this reservation system in the state as it exceeds 50% of total reservation, which is invalid and can only be implemented under extraordinary conditions as said by "Indra Sawhney " I personally think that courts decision was right as they did not saw merit in the decision put forward by the bihar government and it might also affect those who are denied from the benefit of reservation .

Patna high court clearly taken down the decision of state govt to raise the reservation to 65% which is a good and constitutional decision not to cross the bar limit of 50%. However by this action of govt we can easily identify the govt motive of luring the backward caste votes.

The Patna high court refuses the order of enhanced reservation for various communities in employment and education, implement by bihar government, Because it violets the law of doesn't exceed the 50% of reservation of any communities. The government of bihar took decision on the ground of population its states, which is right according to bihar government but it must considered proportionate reservation before implementing it's policy or decision. The Nitesh Kumar regime's decision to increase the reservation of BC and EBC cross the 65% of the total reservation, which violent the law.
