      I studied law and this is often the case in law.
      I find it funny how suddenly everyone in the comments is a law expert... possession of stolen items through purchase under the false conception that its not stolen makes you the lawful owner of the item.
      If you buy a house for your kid under THEIR NAME, and you live in it. The court will most likely determine that the house is yours despite being under your kid's names. There are a few cases where it happened

      @@ryanb6614 it depends on the circumstances, but yes if one buys an item from a reputable source and does all the required precautions to assure that, they can be eligible to keep the item.
      Now this is a rather weak clause in the sense that if the court finds it right to assume the person could've known or shouldve know they'd loose the case.
      Also regarding studying law, I did law as part of my accounting degree, during which I scored first out of 255 people, so while not fully a lawyer, I know my shit in law relating to possessions.
      In the case of this women I do believe she didnt take precautions and isnt eligible for the car. But it is right to say that possession of an item does play a giant role in law

      If she doesn't know it's stolen, there is no crime. The difference between it being a crime and not being a crime is if she knows it's stolen. The only crime was the person selling something they didn't own and fraudulently obtaining the BMW and $15k in cash.

      @@daexion it really depends on a lot of factors. 99% of people who turn in stolen property after finding out its stolen are given a thank you, maybe a cash reward. But if they hold onto the stolen property after learning it's stolen then thats operating a motor vehicle without consent of owner. which is a felony. So if you learn the car is stolen...just turn the car in...

At that point, she's knows it is stolen, and is trying to claim it as hers and saying she won't give it back and will foght in court. That's when it becomes a problem.

      And if the victim was unaware of the item being stolen and bought it thinking it was not 8 out of 10 times they get to keep it
      (with buying a stolen house theyd loose all their money)

      Not unless you're unaware of it.
      Say you enter a small watch store and buy a rolex watch, you think its a credible shop, you later find out its stolen but the store is now gone.
      Not only are you not guilty to any charges but the watch is now lawfully yours and you are not required by law to hand it to its original owner

      Thats largely untrue in context. To face any legal issues resulting from possessing stolen property, the state has to prove you "should have known" it was stolen.
      With cars, if you didnt personally know it was stolen, and the vin doesn't flag it as such, the state generally can't meet that burden, and unless you do this a lot, they're almost certainly not going to even attempt to bother charging you.
      Now, should you buy something without verifying it well beyond that point? No.

    Literally no real attorney would say: "Possession is 9/10ths of the law." That's something someone heard on a law show on TV. Receiving stolen property is a thing. Once notified that the vehicle was stolen, all they can do is hand it back.

      It depends on where they are. If you have a lot of familiarity with how the courts work and you happen to be somewhere that doesn't really investigate or prosecute car thieves this could be true.
      Possesion is 9/10s of the law because most people cannot have the police come and intervene everytime they have a dispute.
      In most places car theft is a serious crime and would at least be reported and probably result in the registrations being flagged in their system so they would notice if they came across them.
      If someone steals your favourite jacket, they're probably not going to do anything about it. At that point, while the law says you still have a right to your property, without any means to get it back you simply need to take it back off the thief or accept that its gone.
      Often there's just not much that can be done when property is stolen, if they're not expensive goods.

      Hey Ed! Wow, I figured you’d have some crazy out overseas story that would top this as your craziest car experience. Also scratching my head trying to figure out how someone managed to sell his rented Ferrari. Like, how do you explain the aftermarket gps (if applicable), lack of appropriate paperwork & the car fax owners names not matching the list goes on & on. Buyer must have not done an ounce of homework & is someone I would refer to as a “smart idiot”...tons of em out there. Book smart but lack common sense and general life experience. Most people know a few, I knew a bunch in college.

Once the guy said it was a stolen car, the lawyer should know hands are off because she is now knowingly in operation of a vehicle without owners consent. This is because of the legal ramifications that can follow something like this. Say, for example, our “lawyer” friend goes for a drive and wraps it around a single mother of fours soccer van and dips, the whole sale wasn’t legal or legally binding because it’s stolen property,thus our guy still owns it, and because us law states a car *owner* is solely responsible for what their car destroys regardless if they were driving or not. So now it’s a MASSIVE liability for both ends and not fair for the lawyer to sit there and play “possession is 9/10’s of the law”

Trace of drugs on the money. Which based on studies show any currency that has been in circulation will have trace amounts of drugs on it. That is the loop hole that the police/federal law enforcement uses to confiscate paper currency.

      The law says in most counties that its legal if under the perception its not stolen (payed full price, no signs its stolen etc).
      In addition she'd get to be the lawful owner of the stolen item and not be required to give it back

      Why dont you tell me what the law says? … because the so-called owner still has to prove the property is theirs & you need a search warrant to inspect my car. Also there is this little thing about allowing people on your property to conduct business under your businesses name which makes that business liable just as if it was their employee.

      It says for you to get into trouble, the state has to meet the burden of "should have known", which, unless the vin numbers flag as stolen, or they can prove you have knowledge it was stolen, the state will almost never be able to do (and they won't bother unless this is a pattern or they're using it to get you in custody for charges in something else)
      Additionally, him telling her it was stolen doesn't even meet that burden so long as there is no report saying it was stolen, because she could run a check, see its NOT listed as stolen, and assume he was the one lying.
      Im assuming he knows the actual legal process to recover that vehicle and is trying to work with her informally before he has to use said process, because it can take a significant amount of time depending on where he is.

    I was storing a car for the winter in a shop of a guy I knew and I paid the agreed price in advance. When I went to pick the car up in the spring he started telling me I can't have it back amd pulled that "possession is 9/10th's of the law" shit. So I said "well, I'm reporting this car stolen and calling the cops, and then I'll press charges." He ended up letting me get my car and after some nice new names I gave that POS I never saw him again.

      Let’s use some logic here ... how many advertisements have you been forced to watch while watching shorts? So far I can still skip ALL advertisements while I’m watching shorts.
      There is NO revenue generated if viewers are not forced to watch advertisements. If you watch a video (long or short) and you saw no advertisements then NO revenue was generated for that channel. Simple.

    Back in the 80’s a little north of Boston there was a Corvette dealership that got shut down (eventually) because people buying were actually signing lease agreements. I guess the paperwork looks amazingly similar because it took years for it to catch up with the dealership. People were making outrageous monthly payments only to find out (36 months later) that they don’t own it and it gets repossessed. 😮Good times.

I just Googled it and found a group chat dated Feb '99 talking about the owner's divorce & tax evasion.       I’ve been hit by one of those scams myself. On a sound system installed in my car. I paid off the 1600 in 6 months like the agreement said, only to get a letter nearly right after making the payment that said I’ve just been renting the sound system for the last 6 months….. a sound system isn’t rims. This wasn’t Rent a Wheel... You can’t just take the sound system out. There’s all kinds of intricate wiring and basically it said I owe them another $1600 if I want to keep it…. I’m anxious to know what they would’ve done if I told them to eat the peanuts out of my shit….
