This is all exactly right. If you use a model that has watermelon booba, you've created a much larger zone that you have to avoid zooming in on, whether on purpose or by accident, because having a camera focus on that area is against TOS. The watermelon booba have that trade-off where you draw attention but also have a massive risk zone.
Yeah, pretty much agreed. Now, you can complain that the rules are DUMB, or make no sense. You can not like the rules (because, personally, taking away the hips is a sin and makes me sad). But that won't change that they're still the rules.
accidental crimes are still crimes, accidental TOS breaches are still a TOS breach and you usually get a lesser punishment than someone who does it with intent, but if you don't like that still? then don't take risks that create said potential for the accident
I'm pretty sure that in her mind, because it happened by accident and only for a moment it shouldn't count, it breaks the rules, yes, but it's too small of a violation to warrant anything, a lot of people think this way, so it's nothing special.
I really think this ladies knew what they were doing and knew that they would get smacked on the wrist for it and still paid to have their models rigged like that anyway. If you have a problem with the TOS on Twitch WHERE CHILDREN ARE BY THE WAY, you need to move to a different site so you can stop getting heckled by the hammer. Like.. this is so wild to me that they say "Oh idk idk idk" Like shut up yes you do.
On one hand, Twitch OBVIOUSLY has a problem with vTubers. (So does UA-cam.) I'm not going to speculate as to why, but it's obvious that vTubers are going to get hit by ToS more than Real Life streamers. On the other hand... the two vTubers in the background have to have Nobel Prize-winning in (Jiggle) Physics to stay within theoretical range of the Twitch TOS.
Are some of the rules dumb? Yea But it is the way it is , and so you obey them . Also I think thing would go a lot smoother if Vtubers were not so hostile to Twitch its creating a us VS them situation and that can only get worse.
I just think you should either ban all of it or none of it, like literally just scrolling through Twitch I've seen irl streamers doing way worse things than these vtubers that are getting banned
TLDR of the tweet: "I know what I did wrong to get the warning, but I should be an exception" I ranted about this on twitter before I deleted it. I'm so tired of vtubers screaming they should be the exception to the rules because they're fictional. If vtubers become the exception then it's going to trickle down to the art category. Porn will be allowed to be drawn then next is that porn games are allowed to be played on stream. Then IRL streamers are going to yell about vtuber favoritism. BOOM! Twitch becomes a porn site and dies out faster than they're dying out now.
The obnoxious thing for me is these rule suck for the fact that if a Streamer with a Vtube model needs to get clothes that follow ToS standards its not as easy as a fleshtuber getting up and putting on some better pants or a top that covers more. Getting new clothing for a model has to be literally drawn edited and ridged to make the changes. This not only takes time, but money to do and its not cheap if you want high quality or need someone else to do it for you. I don't think the people making the rules understand this fact about vtubing and the time and effort it takes to make even small changes to clothing.
This is fair, except for the fact that attire rules haven't changed. Twitch has just been enforcing them more strictly. We as vtubers should read the TOS and make 100% sure that our models follow TOS so those things aren't necessary.
@@hexjuice I haven't looked at the ToS myself but I feel the idea of having a Paper Doll model with the bare minimum clothing coverage to show as reference that Twitch can have those enforcing the rules but those following them can both observe and reference when it comes to determining if a violation is being made. Words alone are up for interpretation and leaves enforcement and users only able to make guesses based on their own judgement and that is bullshit. Rather then a solidified and affirmed decree. Show users and enforcer's X,Y,Z and yes Users will absolutely push what they can for entertainment as well as preference of showing skin, but at least they will then be following the rules.
@@TundraCrow The TOS was pretty clear Like during the Nudity day on Twitch TOS said Artistic nudity was safe (Life-like painting and body studies etc) but a woman going full nude was still bannable INCLUDING Vtubers and Drawing porn was still banned Yet Vtubers still DID it , that is not pushing boundaries, that is going over the line
I mean, when they warn you not to run around the pool bc you can trip and hurt yourself, and begin fast walking and then trip, then that's on you 🤷♂️ Yes, TOS are unfair and are definitely going after vtubers in a very aggressive sense. However if you know that you will get an easier target on your back bc of having a vtuber model, then don't complain when you get any kind of warning or even a ban when said model has their chesticles out or when you zoom in on any explicit areas. And don't get me wrong, most of us like watching that, but vtubers and their viewership are pushing the TOS to the extreme. We shouldn't feel bad for a vtuber sob story of them getting banned for zooming in and taunting the private business that is letting them use their services under strict ruling; there is too much entitlement and lack of accountability (specifically with the new wave of creators in all platforms)
One pic I saw recently was a gameplay stream dualcast(?) Onto the streamers butt using a greenscreen (guessing) or it was maybe entirely faked in Photoshop and while distracting, not really what I'd want to watch a gameplay on. 😂
Bans are scary. From long ago I get bans with no warnings at all just straight up ban. Even I wasn’t sure what rule I broke or was aware that I broke any rules cause nobody told me. So I am forever confused on what did I do to deserve a ban without given a warning. My bans were from discord servers and Mirc servers. I am just telling this from my experiences. So yea bans are scary.
I think Hex is really just not understanding the issue that's been happening. The problem people have been having is the unfair application of rules and feneral favoritism by twitch. The easiest way to point out tge imbalance is hot tube streams; numerous female irls will blatantly wear skimpy clothes for obvious sex appeal. Twitches response isn't a mass ban until it threatens advertisement dollar, but despite that it's a feature highly promoted on Twitch. As for Vtubers they're explicitly not allowed to show off their hips let alone anything remotely lewd. In terms a favoritism it's not Twitch has shown large leeway to high channel earners despite having infinitely worse actions. Easiest example is Hasan who has blatantly broken rules and promoted terrorism. The only time recently we've seen punishment was when his mods performed a live Arab to jew tier list on a twitch panel with sponsors lining the back, and obviously the reason being it threatened sponsors dollars. It's the mere fact that any streamer is being treated unfairly which is the problem. Rules need to be enforced equally and fairly.
I do understand issues of uneven moderation. However, if you break rules, you can’t be shocked if you get punished. You can be upset about the unfairness and advocate for that, but acting surprised while knowing why you got punished is… in bad faith to me. I do sort of suspect that vtubers are more likely to get reported by viewers for these things than irl streamers, and that it contributes to how uneven it feels. Twitch has shown that user reports are a big factor there. I’m unsure.
@ that's true. It's very likely many do use this inequality to cover for their blatant wrongs, but just like how specific cases have nuances so does general over arching issue. Your statements are not wrong but also dont indulge in the complexities which is more or less the purpose of my commentary. Also yes there's likely a discrepancy in hatred towards vtubers and subsequent reporting. I personally have experienced it for just having a personalized anime pfp. It could also mean statistically Twitch does have staff with irrational hatred. Bottomline i think the reality is money. Twitch is a company that is reliant on sponsors and viewers, but their actions have allowed for growing competition. So id wager this is more of a profit bias lending way to favoritism and unfair treatment. Vtubers are just coincidentally the victim to the imbalance which is short sighted for Twitch success but that's nothing new. If Twitch was smart they should've promoted the every living hell out of vtubers since their marketing gold. Even the Vatican has an anime mascot, and at no point should the pope be ahead of the game in marketing. Also it's fun to say "Anime has hit the Vatican"
the problem is that irl streamers just straight up don't get punished when they should. Even if they do get reported, they either still don't get punished, or they get the lightest sentence possible. And then you have Vtubers getting banned at every feasable opportunity.
Though I will say some Vtubers just don't use their brains, but honestly in any group of peopls you have the dumbasses who don't read or follow the rules.
@ there's plenty that do get in trouble but they're not the more notorious members. It's primarily favoritism and the members favored by Twitch are given leeway because of their popularity aka money attraction. If you need an example just look at Hasan. Man quite literally promotes TERRORISM without repercussions.
because the zoom in was only for 5 seconds, the rule about not zooming in on "intimate body parts" is only if your doing it for long periods of time because it was meant to combat a Twitch Meta where face cam streamers were green screening their boobs or butts and using as their game play window. Ms Hex you're looking at this and saying "well if they were bonked it must be for a good reason right" when this is clearly Twitch judging vtubers with more scrutiny than face cam streamers
There is both validity and downplaying going on here, which isn't hate, just my own take. As an example "These are human reviewed" - pressing X to doubt so hard I've broken the button. They are auto flagged and mismatching copy pasta notices emailed out regularly, and when appealed, the 'review' happens far faster than humanly possible, and occasionally even results in worse punishments. There's a middle ground where many people are definitely pushing the TOS and then crying when they get slapped - but there's also compelling evidence to suggest that Vtubers are hit more often, harder, and faster than IRL streamers; and pretending that IRL camgirls didn't get those 'exception' categories created almost exclusively to enable them feels willingly ignorant. That said, not following the TOS is gonna result in a slap on the wrist or worse, regardless of how 'unfair' or 'stupid' those rules are. Personally, I wish for more clarity. Define what a vtuber is before doling out specific rules for them. Define what "focusing for too long" really means and entails. What duration is too long? How much of your screen must be tiddy free/how much of a your stream can be taken up by "no no parts" before it's considered "focusing" - Is that duration in total amount of time, or time at a time? Do consecutive peeks still count? Etc. They did this for ads and sponsors, they can do it for booba and hips.

Finally a honest take
To many vtubers are blindly siding on the side of "Vtubers are always right"
There is no critical thinking going on
vtubers are perpetual victims. They think the real rules dont apply to them because they hide behind avatars. It's insane.
accidental crimes are still crimes, accidental TOS breaches are still a TOS breach
and you usually get a lesser punishment than someone who does it with intent, but if you don't like that still? then don't take risks that create said potential for the accident
