Even if they pass a law getting rid of rosters doesn't mean they're going to delete them or follow the law. California is famous for not following constitutional law
But if this allows for Californians to purchase oos, we’d be able to travel to another state to buy.
New York has had a long history of ignoring the supremacy clause, even going as far as harassing and attempting to arrest federal agents for state crimes like magazine restrictions.
CA will simply pass a new law requiring residents to purchase inside state lines. Then the lawsuit will start all over again (for us Californians)
You can still private purchase guns from someone not in the state. but have them shipped to a ffl to actually do it. You can also do this gifted.

I just did an out of state. Had to pay for the gun, my county tax and a credit card fee. Then when it hit the dealer I had to pay the 11% tax on everything I just paid plus the firearm safety certificate I had to get. They taxed everything @ 11%. Even the tax 🤬taxing, taxes 🖕🏻

In San Bernardino County in California it adds up to 18.75% tax on a firearm or ammunition purchased out of state. The FFL charges $55. to receive a firearm + $35. for paperwork/background check. A $500. gun ends up costing $683.75.

I have a house in one part of the state and I work in another part and keep an apartment. Generally the coasts, SF and LA are blue and the rest of the state is bright red!

There was no federal roster ban in 1791 when the 2nd Amendment was ratified.

It is not about the state you live in it is what country we are in.
California will simply ban any resident from bringing an off-roster firearm into California. So, a California resident could travel 4 miles across the Nevada border to Cabela's and buy an off-roster gun, but would not be able to take it home.
True but they've done that with ammo and guess how that is working.

Yeah, one little catch... CA will prohibit "importing" the firearm because CA doesn't think they're a state in the United States. Good luck with that.
If it ever does get corrected, the states with the rosters should be made to pay restitution to the citizens who bought during the roster.

I don't understand why I have to live in the state to purchase a firearm. It is our constitutional right and the unconstitutional 4473 form is the same in every state so I really don't get this crap. I do believe that the United States Supreme Court needs to just rule that states can not make their own laws, rules or provisions for any of our constitutional rights and stop wasting time by kicking crap down to lower courts. Just make a final ruling that says no state can ever infringe on any constitutional right period.
I thought the US Senate had introduced SB1224, the Modern Firearms Safety Act that was designed to accomplish this same end by prohibiting states from requiring loaded chamber indicators, magazine disconnect mechanisms, and microstamping for handgun sales?
I often wondered why I could only buy a gun in my own state (jumping through hoops not withstanding). Thank you.

California history on two levels is always consistent: 1. California ignores Federals laws and SCOTUS. Calif has validated this by passing legislation which ignores Federal law and SCOTUS decisions. 2. If it's in litigation California has the 9th District Court of Appeals in its back pocket. Nothing will happen in Cali....they will ignore the law with IMPUNITY as they always do. Everyone said SNOPES was a shoe for SCOTUS to accept this term. How did that work out for you? It might help take down the state rosters, and state import laws but that will still take lawsuits and time but all the help we can get the better

As someone who has lived in California and held an FFL License in the 80’s. I could buy guns from suppliers from out of state without a problem. But California changed the laws and when I went to renew my FFL it was not renewed because California changed the laws and I no longer met the requirements they set. Removing the roster would eventually allow Californians to buy the guns no longer on the roster because manufacturers would start shipping guns that were not available because of the roster to California gun stores and distributors! But it no longer matters to me as I am one of many that has decided to leave California.

I’d goto Nevada just to get around the 11% excise tax. Between transferring to a local FFL plus the excise tax the cost of acquiring new guns has gotten insane.

Seems like 10 years ago there were videos titled, “END OF THE CALIFORNIA ROSTER” or “10 DAY WAITING PERIOD OVERTURNED!” I’m still in ca and have spent two months trying to buy a gun thanks to “undermined delays”. I’ve never heard of these before it happened to me for the first time but things are not getting better any time soon.
You might consider getting a UPIN in order to identify better and not get undetermined status.

Places like NJ also need to have mag bans overturned and huge costs for carry rights. $400 for a two year carry license. $20” to the local/state government and $200 for education/qualification. We The People shouldn’t have to pay this much for a so called right.
Well California says 'here hold my designer beer'. My costs have been $1,000 per year for the last ten years here in California for a CCW (renewed every other year). My Utah non-resident CCW (useful in more states) is $75 every FIVE years.
If states can defy Federal laws, maybe Federal government should have conditional rules wrt to Federal funding.
Early 1900s is pretty old. Predates like 4 or 5 states being part of the country soo...to consider the last 100 years unimportant to our legal system for the sake of firearm transfers is pretty crazy
As a Comifornia resident I can say with certainty that even if this did go through, there is a no "ghost" or "cold" gun law preventing us from having or owning a gun in the state that is not registered to you. Yes, obviously they wouldn't know but trying to stay law abiding would mean that even if you were able buy a gun in a state, if that state did not have a firearms registry that was attached to California no one would know you had the firearm and therefore if you were caught with it in California you would lose your right to bear arms. Obviously, this would be a huge step forward but unfortunately for us in the unfree state it would probably change very little. P.S. We are no longer required to have the micro stamping for our rostered handguns, so we are slowly getting new guns put onto the roster.

Unfortunately, I live in MD and we have a roster and a 1 week wait on handgun purchases. The state police do the background check for handguns, not the FFL. They look deeper into the background, like checking to see if the pistol is reported stolen and checking if you have a medical marijuana card.
WA uses the WSP for background checks and a 10 business day wait, plus a permission slip.

Unfortunately, you're wrong regarding HOW states implement background checks. There are several states that do their OWN background checks, that includes checking NICS but is more comprehensive. I don't see this going through without some major issues that are likely to make it fail. This MIGHT get applied regarding handguns in those states that use NICS only though.

People from NY and Massachusetts can't buy long guns here in Maine, because of the laws from those states. Over covid lockdowns a friend from NY was staying here, and he had to change his residency to Maine before he could buy the rifle and the shotgun he wanted.
California will simply say " Yes, you can buy it, BUT you cannot possess it or bring it into California unless its on the roster! In fact we will extend this to any non roster firearms." This will ban anyone moving to California from bringing all of their firearms with them and eliminate person to person transfers.

What sucks is if your home state has wait periods. It should be pretty simple to do a background check in any state and just query your home state. Or allow a special exemption for ccw holders.

Not sure abut other States, but here in CA it is against State law to bring any off-roster handgun in from outside of the State, regardless of the source.
Striking down the Federal law on buying a handgun (or any gun) in another State will not affect this.

Out of state purchase and the handgun roster are two different laws. I can go out of state and buy ammo and fireworks. But its illegal to bring them into California. This will be the same thing.

I wanted a colt 1911 .45acp and when I went to search for one, oh hey they are banned in Cali, one of the most iconic handguns historically by brand as well, I have an me garand so having a colt would really be nice, I had to settle with a rock island armoury 1911, still a good handgun

All roster lists either need deleted or registered and allowed. If not, anyone accessing that list is personally fined $25k and 1 month minimum jail sentence.
Then the individual nanny states create state-level bans on importing weapons and require all firearms to be transferred through an FFL within their own borders. The CA legislature would zip that through in a day, maybe two.
Even if this lawsuit is successful, CA will still ban the possession of the firearm purchased in another state once you bring it back into CA ...

This is amazing! But it seems too good to be an eventual truth. I think states, like California, would just make a law to criminalize a California resident from bringing a gun purchased elsewhere back into their state.

Being able to purchase out of state would not only nullify handgun rosters, it would also nullify 7-10 day waiting periods and 1 gun a month laws that some state have 😊

The best part of this lawsuit is how it cites the Mance decision directly and uses its own findings of fact against the Nonresident Handgun Purchase Ban. So the 5th Circuit Court of Appeals ruled in 2018 that while there was nothing in the text of the Constitution that allowed the ban, and there was no law before the early 1900s showing a tradition of interstate bans, it still found there was a government interest that outweighed citizen's rights.
We now have Bruen ruling a "two-step test is one step too far", so the 5th Circuit will have to eat their words. Muah, chef's kiss

I am not so concerned with the roster itself because where I am, handguns or semi auto rifles have to be reported and put on your license anyway. What I want is the ability to make a purchase somewhere. Currently, if I am traveling and legally carrying and my firearm is lost, stollen or somehow fails, I would have to fly back to NY to get another and then head back out - totally ridiculous. What if I went somewhere for what I thought was an overnighter and then something happens and I found myself stuck there for a week or month.... I could not legally purchase something so my 2A rights would not exist unless, again, I fly back home to purchase something. If a background check is done and I can legally purchase then what difference is it where I purchase.
I'm skeptical of what you propose. If your primary residence is CA, but you have a secondary residence in AZ you spend time at (dual residency), you can get an AZ identification card, provide utility bills as proof and purchase an either on-roster or off-roster handgun in AZ and that would be legal. You CANNOT bring that pistol or any high-capacity magazine over CA state lines. CA could continue with the roster and while those without dual residency could buy in AZ, they would not be legal to bring those firearms/magazines back to CA. That isn't a win.
Register your vehicle in AZ 😉...much much cheaper too. My buddy did this and has his AZ CCW, so he carries in that vehicle while in CA. I spoke to a CHP friend, and he said if he ever gets pulled over, the cop won't even care. Just be courteous to the officer. I have my AZ CCW and live in CA.
