No other comment mentions this, but if the allegations against Jay are true, then the statute of limitations against him in New York ran out in 2010. Meaning the reason why there was no criminal case was possibly because they tried and failed. They would only still be in play if the assault happened after 2019. If I can figure that out in a few seconds of web searching, ain't no way a billionaire's lawyers would let Jay make himself look how he looks asking about a criminal case.

I get the point about criminal charges, but for the plaintiff the burden of proof is way higher for a criminal case than a civil one, which is difficult for historic cases where there's no viable DNA, presumably no footage of the event, etc. So she's left with 2 choices (technically 3 if you include silence, which many women do), either lose a lot of money on a criminal case she as someone who isn't a billionaire probably (almost definitely) can't win. I don't know much about American law, but surely there's a higher bar for conviction in a criminal case? If her lawyers thought that the case had a better chance of achieving some form of justice in a in civil court, that to me is a good enough reason to pursue this avenue, especially considering the allegations are of events that occured 24 years ago. As I understand it, lawyers telling you not to make any objective statements like "I've never met her" is standard practice however, so I don't think that that is compelling in speculating about Jay-Z's guilt. That being said, I personally find certain parts of his statement kinda gross, and think that her account is credible. I hope she finds a resolution that vindicates her and helps her find peace

yes the response was incredibly tone deaf, but the fact that he responded so quickly and recklessly hints to me that he is not taking the case seriously at all. I think he’s calling their bluff in a lot of ways that aren’t completely obvious.
I could see how them adding Jay Z to this civil case retroactively could be seen as retaliation to Jay Z’s lawsuit against Jane Doe’s attny.

I'm pretty confident that no lawyers were present when Jay wrote that note. No other comment mentions this, but if the allegations against Jay are true, then the statute of limitations against him in New York ran out in 2010. Meaning the reason why there was no criminal case was possibly because they tried and failed.
They would only still be in play if the assault happened after 2019. If I can figure that out in a few seconds of web searching, ain't no way a billionaire's lawyers would let Jay make himself look how he looks asking about a criminal case.

If I remember correctly if it becomes a criminal case than its up to the state to find evidence. If it's a civil case, then it's up to the Jay-z to prove he's innocence.

Why didn't you make this a criminal case is not a good point. If the 15 year old girl didn't report the rape immediately, and get a rape kit and toxicology report done, then she'd have no criminal case against her attackers. It would be her word against a couple rich celebrities. It wasn't until the situation changed with Diddy's arrest until she woyld be taken seriously.
I get the point about criminal charges, but for the plaintiff the burden of proof is way higher for a criminal case than a civil one, which is difficult for historic cases where there's no viable DNA, presumably no footage of the event, etc.
So she's left with 2 choices (technically 3 if you include silence, which many women do), either lose a lot of money on a criminal case she as someone who isn't a billionaire probably (almost definitely) can't win. Or she can take the civil route where she could maybe wring at least a little good out of an awful situation and get her bag, and expose the predators in the process. So I totally get it

Its very highly plausible that JayZ was there and wasn't involved either. Its possible that the person claiming it was JayZ is either lying or mistook him for someone else. Its also possible that she is telling the truth and JayZ doesn't remember or that JayZ and he is lying.
But his letter reads like someone got emotionally triggered and immediate wrote a whole essay on text. Which makes me feel that he may be telling the truth. And i hope he is because I don't want yet another artist to have been involved in this shit.

I don't know much about American law, but surely there's a higher bar for conviction in a criminal case? If her lawyers thought that the case had a better chance of achieving some form of justice in a in civil court, that to me is a good enough reason to pursue this avenue, especially considering the allegations are of events that occured 24 years ago. As I understand it, lawyers telling you not to make any objective statements like "I've never met her" is standard practice however, so I don't think that that is compelling in speculating about Jay-Z's guilt. That being said, I personally find certain parts of his statement kinda gross, and think that her account is credible. I hope she finds a resolution that vindicates her and helps her find peace

Jay saying that they should press criminal charges is a really good statement and seems like a gotcha on it’s face ..but there’s a lot of holes in it. In a criminal court the burden of proof is much much higher. Beyond a reasonable doubt.. no pun intended .in s.a. Cases and especially in a case that’s as old as this is ,that’s almost an impossible task and jays lawyers know that. Basically all a prosecutor would have is witness testimony. The probability of a thirteen year old back then would have the wherewithal and fortitude to go get a rape kit is very low.. etc etc. I do like that he’s not settling but the jury is out. I hope it’s cap but hope don’t mean a goddamn thing
