Please, if I am submitting the I-130 concurrently with the I- 145, is it necessary to include the evidence of boni fide marriage again in the I-145 packet even if I have already included those evidences in the I- 130 packet. I am referring to other evidences such as photos, joint lease etc, apart from the marriage certificate, Again, in terms of the order of arrangement in a bigger packet, which one must come first. The I-130 or the I- 145?
Hi there! Each form has its own list of supporting evidence, but you wouldn't be repeating it twice. The bona fide marriage evidence needs to be included with I-130 only, but items such as your marriage certificate will need to be attached with multiple different forms. Hi there! It is a USCIS requirement to include your current marriage certificate and any relevant divorce decrees or death certificates from previous marriages when filing Form I-485. The I-130 has it's own requirements and you would want to follow both although it does appear to be redundant.
@@davidjin8147 Did you submit it together with I-130 or the I-130 was submitted online? In any case, they will issue an RFE if they need it, but you can also be proactive in creating your USCIS online account after they accept your case and you will be able to drop it there!
@marriagegreencard I submitted i130 online and enclosed the i-797 in the 485 package. I thought they could pull the marriage certificate from i130 online so I didn't include it in the mail
Hi there! You generally just need to include one. In the past we actually included both because the USCIS had a tendency to "miss" it and request it again the RFE. We haven't been seeing much of it in the last couple years, so you should be good to go. Good luck with your upcoming immigration journey! When are you submitting your application? Good morning and thank you for your comment! If you've already filed your application for Adjustment of Status before your I-94 expires, you are generally considered to be in a period of authorized stay by the USCIS while your application is pending. This means you do not accumulate "unlawful presence" even though your I-94 has expired, as long as you filed your adjustment application before the expiration. Plus I would imagine everyone's I-94 expires before they complete this process since it takes a while to get a green card. My answer would change if your I-94 expired before you filed your adjustment application. So has your I-94 expired yet or will it expire after your submit your application?
Hi there! Sorry to hear you're struggling with this requirement. There is really no way around this. In our experience from working with couples through many of these scenarios, you either have to wait for your spouse to qualify based on income or secure a joint sponsor. You could consider using assets, but that's also risky. We've seen couples who had to wait for a year or so before applying, but it was an ultimate success when they qualified. You aren't alone and you got this!

Question, why does i485 adjustment of status needs proof of marriage assuming the status has been established through I130??

Thank you for responding. The I485 was submitted in Jan2023. And the I94 expires may 2025
