    If people want to take negative points out of this issue of wali they can do so but I am so happy to say that daughters are precious that’s why they are protected that’s why they are taken care of so no one can harm them that the person a fathers gives his daughter to is able to take care of her, he’s a respectful man for their daughter to be with this also proves the love of a father or brother for their daughter/sister Subhan Allah it is so beautiful.

    May Allah help our single men and women to find happiness and the coolness of their eyes through marriage, especially single women who are 35+ years old that never been married. I think their case is most of the time skipped from any conversation regarding marriage

      What's going on? Why would 35+ women be single? Did they want to live the single life and now regret it? Why don't they get married as second wives? Nothing wrong with that. Allah allows it.

      @@alphauno6614 What’s going on!? The same thing with men, who in this present day, don’t want to get married, let alone take on a 2nd, 3rd, and 4th wife. Look at the whole picture, not just your bias side. It’s two human sides involved, not just one. It takes two to tango. SubhanAllah!

    It was reported from Sälib bin Kaisãn, from Näfi' bin Jubair bin Mut'im, from Ibn 'Abbãs, that the Messenger of Alläh # said:
    "The guardian has no command over the previously married lady, and the orphaned girl is asked.
    And her silence is regarded as her consent." (Sahih)
    Does this interpret that wali is not mandatory for nikah if women is divorcee?

    What I don't like about scholars like Yasir Qadhi is that they are more loyal to their particular sect than Islam. They act not as apologists for Islam, but apologists for their particular sect. Just consider this particular issue, the whole Salafi opinion (Yasir Qadhi is a Salafi) rests primarily on a single Hadith, which is not even Sahih. The Hadith is reported through Zuhri (a prominent scholar who died about 100 years after the Prophet), but Zuhri himself ruled that women do not need a wali to marry. Imam Abu Hanifa, the earliest of all of the Imams, also ruled that women do not need a wali to marry. But here, our great Yasir Qadhi, living 14 centuries later says they cannot. Clearly, the Tabieen gave women more rights than our 21st century "Imams". No wonder so many new converts to Islam in the West leave Islam within a year. They embrace Islam by getting inspired by the Quran, and then they come into contact with nonsense like this, and leave.

    Why should someone need to change the Shareeah in this regard?
    Scholars must preach people to stick to Qur'an and Sunnah and
    It's the people who need to change their ways of upbringing their children according to Islamic values so that they don't face these kind of dilemmas. Or migrate to Islamic countries. No one forced us to live here. If this society is doing harm to our Deen and values, just migrate. Allah will provide you inshaAllah.
    Change yourself not the Deen....

    Where is the evidence for that Wali line-up when the Father/Guardian is not living? I have read and listened about this topic but haven't found a very simple point ever being considered: Don't the verses and traditions cited all ASSUME a Wali? For example, the verses of Quran speaking about treatment of parents, assume we have living parents. It doesn't apply to someone who grew up without one. A "Guardian" has a defining role in one's life. We can't just drag the next male relative and say "you are it". The scholars are very strict when it comes to citing evidence for a particular position but then go down an almost arbitrary list of "Wali's" when a father is missing that is completely culturally grounded. Islam is supposed to be adaptable to all backgrounds. Imagine a Western convert who is now told that her second cousin is her "Wali" with veto power without a shred of Evidence from Quran or Hadith.

    I still can’t figure out after listening to the whole lecture whether if a nikah is done without a wali , is the nikah halal or that person is doing zina ?

      A nikkah without wali is invalid. Therefore, the couple will be committing Zina

      @@adamkhan8723 Astaghfirulla fear Allah. He explicitly said nikah without a wali IS allowed if you follow the Hanafi Madhab. Don't contort just to push your own opinion. Fear Allah

      ​@@alphauno6614The students of Imam Abu hanifah(RA) were against this rulling, because hadiths and Quran is clear about the concent of wali.. Prophet Muhammad Sallallahu alyhiwassalm Hadith said it is invalid invalid invalid do you consider Imam over Prophet and Allah?by the way I am woman and I will never go against the Shariah and Prophet..

      Sunan Abu dawud Book 5,book of marriage Hadith Number 2078:
      Narrated Aisha, Ummul Mu'minin:
      The Apostle of Allah (peace_be_upon_him) said: The marriage of a woman who marries without the consent of her guardians is void. (He said these words) three times. If there is cohabitation, she gets her dower for the intercourse her husband has had. If there is a dispute, the sultan (man in authority) is the guardian of one who has none.

      @@shahzain5717 Given you're an anonymous person on the internet, I'll take what you said with a grain of salt especially given the fact that if this wasn't a ruling in the Hanafi madhab then the shaykh in the video would've mentioned it.
      Also you should know our Deen is more than just one Hadith taken without awareness of tone or context. However having said that, I will investigate.
      May Allah enlighten us all to the truth and makes us steadfast in our righteousness.
