Back in the 90s (and likely still even now) Disney had a contract for hopefuls to sign before they would even look at your portfolio. It stated something to the effect that you agree that anything in your portfolio could already be on the drawing boards. And that if it is (or they say it is) they owe you nothing So any idea of your own was up for grabs. That would include even a unique art style utilizing Disney characters. Just anything. I never submitted my portfolio after reading that.

I brought in character packs, outlines, etc. They informed me they were going in a different direction, and that was that. Four years later the live action film is released, and I was surprised to see my design for Marvin the paranoid android walking around on screen. I mean, there was a certain thrill that they'd used my design, but that was soured by the fact that I was neither credited nor paid for that contribution. I was young and dumb, so I hadn't used the poor man's copyright of sending my pitch package to myself via registered mail, so I had no way to prove that my design predated theirs. Not to mention being a civil matter, if I were to sue and lose, I'd have to pay Disney's legal fees. Just not worth it. I feel for you.

My idea was that, as a "blank" ball, the emotion conveyed would have to be through body language. I felt putting a sad face on it would ruin the joke that his personality was defective.

Netflix stole the story of an independent comic artist from my country, it's absurd and it wasn't inspired. the story, the characters, names, symbols, everything: it's practically the same, it's not an exact copy as it was in your case, but it's VERY similar and obviously nothing came of it
You’re a hero in my book, man. As an artist, I’ve been scammed, had my work stolen, and have struggled to find reliable clients. The fact that you put in all of this effort takes a ton of courage. Artists have been taken advantage of way too long by large corporations and greedy individuals. And all we want is to make a decent living, do what we love, and receive some sort of credit or recognition for our original ideas. Keep up the good work 👍👏
As you say, a Billion dollar company based on art cannot hire real artists. I had the same thing happen to me somewhat. Someone in New Zealand was stealing my dragon art and selling it to a card game company in Norway. DC Comics also stole a character of mine. I have learned to never, ever put my work on the internet ever again.
I've had Disney, Image comics, Lucas Arts, and several others steal designs from me... A couple of them I contacted, proved I designed it, and asked to be hired by them. A couple did it this way and made sure I signed an agreement that they now own what they stole. Financially worked out on some... Maybe try this?

An IP owner can keep an artist from making money off fanart, they can not then claim that fanart as their own. Although copyright holders on UA-cam can steal your ad revenue... Which sucks. Even in that scenario, they can't then take your video and repost it or sell it themselves.
As far as I understand they likely can retaliate just because it was made even if no money was made off of it. This is something most companies won't risk acting on because they will get hate for it but there have been cases where it's happened (like a my little pony fan game that was being made for free and was just really really good and real looking was shut down by Hasbro.) It's absurd and wrong but if people want to say no one can even draw their character for their own use I think they technically can unless at some point they gave permission in some way. That of course isn't the same as owning art that's made.

Yeah, in fact this is one of the reasons companies sometimes go against fanfiction. If something they wanted to do is too similar to a fanfiction may force their legal team to purchase the fanfiction rights. Fan works rights are very murky, part of them, like the characters the universe, etc is owned by the original IP owner, but anything original in the fan work is owned by the creator of the fan work. This means that the fan work is owned by both the company and the creator. And this doesn't mean that since it is shared by both it can be used by either, it means that it needs approval from both to be used by either. It has murky rights. Is like if you stole a coffer from someone and used it to store stuff you own and then the key was lost. The original owner owns the coffer but you own the contents, they can't have the coffer with your stuff. With physical stuff the answer is simple, open the coffer and empty it from your stuff. But with a fan work it is murk because the original work still exists, but the fanwork can't be separated on the parts that one owns and the other owns.
You shouldn’t sue them. You should make a bunch of stickers with your name on them and the next time You go into Disney World you should put your name on the bottom of the artwork you created.

One time a Disney animator followed my art account and kept encouraging my artwork, until one time I posted a story about someone completely ripping off my work and how that made me feel a little upset, and this Disney animator DM’s me that I’M the one in the wrong. I disagreed with him so he unfollowed and blocked me. 🤷♀️ the only Disney artist i know is a good person is Brian Kesinger and that’s because he is so creative he doesn’t need to rip off other people
I respect people who fight thieves using our legal system, like the countless people who have had their valuables stolen by cops using b.s. civil forfeiture laws. I have sold art I've made and been hired to make art, so I guess I count as an artist? I also write a little code, and feel that they share similarities in how work can be stolen when its shared. You can't just go to an open source repo and copy the code change the name and say its yours. If the original author allows then you can fork it and make a modification while still giving all the credit to the original author. If they don't allow forking you can see how the code works learn how it works, then write your own code with what you have learned. You don't need to steal. He should of reached out to you and included you in the process. Corporate only cares about money. They have 0 morals

Good luck finding a lawyer willing to sue disney for you. They will drag this out for years and you'll have 100s of thousands of dollars in legal costs before you win. And then they will just appeal.
I've had my work stolen and sold several times as well (luckily just by one man shops, not a giant corporation) and it never really gets any easier. There's always a new thief every year--oftentimes wellmeaning people who literally just weren't aware they don't have the rights to sell it. But it keeps going on and on and having to stay diligent about this is exhausting.
It's just so unbelievably pathetic. How much would it actually cost them to make good here and pay you for your work? In their terms, almost nothing. Less than pocket change. And in return they'd come out with some great PR, looking like they care about fairness and justice and about their fans and fan artists. Sometimes it seems like these massive corps just get so comfortable being evil that it's their first instinct even when it doesn't make any sense.
I’m disgusted by this. I’ve always had Disney up on a pedestal for the wonderful films I grew up with, but also because they protected their copyright, which is something I strongly believe all artists should do. It’s so hard to do that, with them owning so much of the entertainment industry. Including _Marvel Comics._ I keep catching myself browsing merch for movies and heroes I like, before catching myself because “Disney owns that.” At least I can still buy random Batman stuff without guilt.
You may not have faith in the justice system, as many others, but most just don’t roll over and let it happen, either. Specially during “Discovery” sometimes not giving is the pivotal moment history could be made.
As someone who has also had artwork stolen by a big institution (an NDA prevents me from saying whom), I can say that the only way to get them to take you seriously is to threaten them with legal representation. I realise it's too late to help MCS, but if you are an artist reading this, here's my advice: 1. Back up your designs. Legal means are best if you can afford them, but a cheap alternative is to put them into a video and upload them to UA-cam (unlisted if you prefer), so there's an independent date stamp. 2. If applicable, exhibit your work in public and take pictures of the event, with people in shot. The more high-profile the witnesses, the better. 3. If a theft occurs, give the offender two weeks to show compliance. If you are not satisfied at that stage, tell them that if they do not make you an offer within another two weeks, you will seek legal representation. Do not keep waiting and hoping that they will do the decent thing -- they would prefer to run the clock down and hope that you'll chicken out.
This is par for the course for Disney, a company that literally stole Mickey Mouse from a toy manufacturer, and then sued that same toy manufacturer for copyright infringement. Disney is truly the empire of the evil rat god.
As long as they continue to ignore this and do not react... This is not a real problem they need to worry about. I would say lawyer up but tbh, I don't know that that would lead to anything...

You're the voice of every artist who sees your videos. Thiefs do not deserve an easy win. Reach out through a your UA-cam and ask for help, you will find it. I appreciate you making this video, but please don't give up.
I'd still contact a lawyer...I think in this instance they're contingency based pay, so they get paid out of what they "win". Part of the settlement agreement could be your name being correctly identified as the original owner of the product.

Retired my ass, disney management absolutely came down on him. Like they aren't going to own up to it but someone clear cut stealing like this is a public relations nightmare regardless of the fact that disney could have lawyered up and defended themselves from you easily. The point is they shouldn't have to, and that costs them tons of money they shouldn't have to spend because an employee was a shitbag. They 100% forced him out or fired him. funny thing about corporations. They are more of a citizen than you are with more rights than you have and they believe they also deserve more than you. They can steal from you but you can't steal from them. They can sue you but you can't sue them.
This is why you never release art free online unless you are ok with it ending up wherever, including commercially. It sucks, but the internet makes it too easy to take and remix stuff or just steal it wholesale. The 'CC attribution' tags on sites like Thingiverse are cursory barriers at best, all they can do it make it so you technically have a legal foot to stand on in the event you actually do try to go after someone. And as you point out, that is assuming the thief is someone you could reasonably challenge in court, and not an entertainment titan with more money and lawyers than God. And that's not even counting an overseas manufacturer taking designs and mass producing them (good luck suing a random Chinese firm that will just reincorporate under a new name in two weeks), or legions of smaller sellers at conventions who are 3D printing pirated models in bulk (so many of those guys try to pass off various generic flexi-dragons and all sorts of other Thingiverse classics as their own work it's honestly funny).
I may have been one of those guys who thought the studio owns fan art. Apologies. Ironically, I recently discovered my Flintstone fan art (including the lettering I created by hand digitally with its logo) across a few lazy t-shirt sellers. Because I try to be an honest person, I've never thought of exploiting others IPs for my financial gain; my T-shirts were all original. Frustrating to say the least but I agree not worth pursuing. The original owner owns the coffer but you own the contents, they can't have the coffer with your stuff. With physical stuff the answer is simple, open the coffer and empty it from your stuff. But with a fan work it is murk because the original work still exists, but the fanwork can't be separated on the parts that one owns and the other owns.

Disney artists love to steal. One time a Disney animator followed my art account and kept encouraging my artwork, until one time I posted a story about someone completely ripping off my work and how that made me feel a little upset, and this Disney animator DM’s me that I’M the one in the wrong. I disagreed with him so he unfollowed and blocked me. 🤷♀️ the only Disney artist i know is a good person is Brian Kesinger and that’s because he is so creative he doesn’t need to rip off other people
I respect people who fight thieves using our legal system, like the countless people who have had their valuables stolen by cops using b.s. civil forfeiture laws. I’m with you though: I don’t have faith our legal system will give justice to the little guys, but even when it does, the process exacts a disastrous toll.

I have sold art I've made and been hired to make art, so I guess I count as an artist? I also write a little code, and feel that they share similarities in how work can be stolen when its shared.
You can't just go to an open source repo and copy the code change the name and say its yours. If the original author allows then you can fork it and make a modification while still giving all the credit to the original author. If they don't allow forking you can see how the code works learn how it works, then write your own code with what you have learned. You don't need to steal.

Good luck finding a lawyer willing to sue disney for you. They will drag this out for years and you'll have 100s of thousands of dollars in legal costs before you win.
And then they will just appeal.
I've had my work stolen and sold several times as well (luckily just by one man shops, not a giant corporation) and it never really gets any easier. There's always a new thief every year--oftentimes wellmeaning people who literally just weren't aware they don't have the rights to sell it. But it keeps going on and on and having to stay diligent about this is exhausting.
It's just so unbelievably pathetic. How much would it actually cost them to make good here and pay you for your work? In their terms, almost nothing. Less than pocket change. And in return they'd come out with some great PR, looking like they care about fairness and justice and about their fans and fan artists.
Sometimes it seems like these massive corps just get so comfortable being evil that it's their first instinct even when it doesn't make any sense.

I’m disgusted by this. I’ve always had Disney up on a pedestal for the wonderful films I grew up with, but also because they protected their copyright, which is something I strongly believe all artists should do. I feel so let down and angry that they are doing something so wrong to a fan, how hypocritical can you be?! I’m sure Walt would turn in his cryochamber if he knew they were doing this. The fact that they just blatantly ignore you is the icing on the cake. I can’t imagine how proud you are to have your artwork for sale at the parks, but how frustrated you are that they blatantly stole it to make profit from it. This has really upset me, a lifelong Disney fanatic for nearly 55 years. Disney are the whole reason I learned to love to draw, paint and sculpt.

You may not have faith in the justice system, as many others, but most just don’t roll over and let it happen, either. Specially during “Discovery” sometimes not giving is the pivotal moment history could be made.
As someone who has also had artwork stolen by a big institution (an NDA prevents me from saying whom), I can say that the only way to get them to take you seriously is to threaten them with legal representation. I realise it's too late to help MCS, but if you are an artist reading this, here's my advice:
1. Back up your designs. Legal means are best if you can afford them, but a cheap alternative is to put them into a video and upload them to UA-cam (unlisted if you prefer), so there's an independent date stamp.
2. If applicable, exhibit your work in public and take pictures of the event, with people in shot. The more high-profile the witnesses, the better.
3. If a theft occurs, give the offender two weeks to show compliance. If you are not satisfied at that stage, tell them that if they do not make you an offer within another two weeks, you will seek legal representation. Do not keep waiting and hoping that they will do the decent thing -- they would prefer to run the clock down and hope that you'll chicken out.

I'd still contact a lawyer...I think in this instance they're contingency based pay, so they get paid out of what they "win". Part of the settlement agreement could be your name being correctly identified as the original owner of the product.

Retired my ass, disney management absolutely came down on him. Like they aren't going to own up to it but someone clear cut stealing like this is a public relations nightmare regardless of the fact that disney could have lawyered up and defended themselves from you easily. The point is they shouldn't have to, and that costs them tons of money they shouldn't have to spend because an employee was a shitbag. They 100% forced him out or fired him. This is why you never release art free online unless you are ok with it ending up wherever, including commercially. It sucks, but the internet makes it too easy to take and remix stuff or just steal it wholesale. The 'CC attribution' tags on sites like Thingiverse are cursory barriers at best, all they can do it make it so you technically have a legal foot to stand on in the event you actually do try to go after someone. And as you point out, that is assuming the thief is someone you could reasonably challenge in court, and not an entertainment titan with more money and lawyers than God. And that's not even counting an overseas manufacturer taking designs and mass producing them (good luck suing a random Chinese firm that will just reincorporate under a new name in two weeks), or legions of smaller sellers at conventions who are 3D printing pirated models in bulk (so many of those guys try to pass off various generic flexi-dragons and all sorts of other Thingiverse classics as their own work it's honestly funny).
I may have been one of those guys who thought the studio owns fan art. Apologies. Ironically, I recently discovered my Flintstone fan art (including the lettering I created by hand digitally with its logo) across a few lazy t-shirt sellers. Because I try to be an honest person, I've never thought of exploiting others IPs for my financial gain; my T-shirts were all original. Frustrating to say the least but I agree not worth pursuing.
