You mentioned EU only, but the UK has kept lots of the EU's consumer protection laws since leaving. So this will also affect those in the UK as well as EU, and any other country with similar consumer protection laws (similar as in laws that would actually affect this case)
Possibly, but since Brexit is so recent, we could see the UK's consumer protection laws change in the time between now and the resolution of the lawsuit. Either way though, this lawsuit wouldn't result in payments to UK citizens since it's being filed with courts of the EU - at least, that's how I understand it. Hi, german gommehd player here. I used to start my journey with the mode build ffa and I can't state enough, how many of my friends and fellow bffa players lost their account over migration. This includes the number 1 player at the time and another top 10. Both have new bought new accounts. The fellow number is now number 1 again on his new account, but the player quit the gamemode and the version. Hes now 1.20 player
Funny enough, this happened to me more than once! About losing accounts and mojang refusing to let me get my account back. I wasn't even a rule breaker, I was just a kid at the time and had anxiety issues and deleted my mc account in rage. I messaged them 1d later asking to restore my account on the email I used to login, and they said no because didn't have the transaction statement and fully permanently deleted my account.
Thanks for the quick review, i've been so lost cuz everyones beating around the bush (or rather i dont care enough for that much backstory), but i like your style for these types of videos.
So, to recap: Mojang decided that they wanted to stop allowing guns, which are real world, deadly weapons, which are way too easy to access in some places, in Minecraft, a game marketed as for older children and teens, and actually played by young children… … and, before you start making dumb points, swords and explosives are much more difficult to access in the real world, and Mojang has specifically refused to put many real world animals in the game due to real world issues that could exasperate, and refuses to put ANY real world animal in as a hostile mob… … and some Swedish guy responded by suing them for gambling facilitated by servers made and owned by outside parties, and which Mojang have very little control over. Am I the only one who thinks that’s a bit of an overreaction?
as much as I can get behind the reason for suing Mojang, since I agree that the company has not been properly communicating issues to anyone really and there's some much needed action, I'm still unsure about how this lawsuit will move fowards... mojang is owned by microsoft, so I'm unsure if one singular person with a limited amount of financial resources could go up against it and win, I'm not from the US nor am I from Europe so my knowledge of law is based on my own country... but I'm still skeptical about the whole ordeal. Best of luck really, and let's see what comes from it, I suppose.
I've lost my Minecraft account twice once because of migration and second for an unknown reason that Mojang/Microsoft still haven't replied to for 2 years.
I lost my account because I didn't migrate it, you might think that there's nothing wrong with that. The only problem, though, is that THEY DELETED IT A YEAR EARLIER THAN THEY SHOULD'VE.
I don't personally really care about the gun thing, but the other one sided things are absolutely horrendous. I did also buy three minecraft accounts before the migration for my mom and dad and sister, none of them ever really used them, but they were all deleted.
you know, I never knew Mojang did all this. I just thought they made some terrible changes to the game. I only actually understood after Kian's video and this one, that Mojang is just terrible.
The "wasted so much money" part was soo realistic until the video showed the original dev apparently paying for a yellow twiter checkmark icon - Money thus was wasted even before EULA changed lol - Kinda on him payin a thousand a MONTH for a small svg icon hahaha
Would still have to comply if the end users are in the European Union. Same thing like Apple has to allow side loading for EU users even though Apple is purely American, since they dont want to lose out on the European Union Marketshare.

Nobody's paying me, and I think how Mojang conducts their business is scummy. *But.* After doing research of my own, I'm pretty reasonably sure that Kian has absolutely no chance of winning this case _if_ he actually decides to go through with it. The relevant section of the _Minecraft_ Commercial Usage Guide states that a commercial server may make money if, among other things, "all servers, entitlements, and advertising are suitable for audiences of all ages and they don't harm the _Minecraft_ brand". While they name some examples in that same statement - such as gambling and explicit lyrics - the wording is vague enough to give them more than enough leeway to pretty much decide anything they don't like could "harm the brand". In addition, there's a handy-dandy escape statement in the EULA which states: "We may change this EULA from time to time, if we have reason to; we'll inform you of the change before it takes effect, either by posting a notice on our Website or by other reasonable means." In essence, this means that so long as they make an attempt to contact a party that is in breach of the EULA, whether or not it's written on the website, then they can jolly well do whatever they want, whenever they want, because it's their game. And that's exactly what they did on May 30th of 2023 via e-mail. (Kian didn't get an e-mail because his server wasn't up at the time, but that's irrelevant.) It's very shady and scummy, but whatever one thinks, this is completely legal for them to do because of very clever wording. So, you know… I don't think Kian has a case. Also, I made the "until he cracks" comment because, if he's serious about this, I imagine the stress is immense. Were it me, I would not have pursued it this far because of how drastically this could and would affect my daily life. Maybe he's made of sterner stuff. Or maybe he's just having a laugh. Maybe we'll see. (But, I do think you're right that he couldn't possibly take the money and run without doing something ridiculous.)
I wrote a pretty lengthy reply, but either _UA-cam_ didn't care for it, or it's currently sitting in your "needs approval" inbox. If it's gone, though, my rationale is the clever wording of Mojang's EULA and Usage Guidelines basically means they can mostly do what they want and get away with it. Scummy? You _bet_ it is. But, it's also _legally binding_ and means, in my (not-a-lawyer) opinion, that Kian has no case. Also, the "'til he cracks" comment was because this stuff is stressful. _I_ couldn't do it.
