All cases , criminal cases have Opening statements. A few trials happen where the Defense doesn’t present an opening, ( such as this one ) but any trial you see on UA-cam has Opening statements.....there are hundreds of trials you can watch on here. George Floyd was in Michigan. He would’ve gotten the maximum sense. It’s unfortunate that he’s in Minnesota which is the capital of Minneapolis. I think the officials need to be accountable.
The Defense will often reserve doing their Opening statement until after the State has presented its entire case ...so they can plan a better opening statement based on the State’s case, or they may opt to not do one at all. It isn’t a good idea to never present an opening statement for your defendant but it happened in the Joel Guy Jr. trial....sometimes the Defense think that the State’s case is so weak that they don’t need to do an opening statement and sometimes they don’t even present the Defense’s case. This also happened in the Joel Guy trial. That means that the Jury has only the State’s case to deliberate on. If the Defense feels that the State didn’t present a case that is strong, ie; the witnesses were unreliable or not credible ( jailhouse informants who get time taken off a sentence, or co- defendants who will get much lighter sentences for testifying against the Defendant, for example), or they didn’t provide any testimony that seems to “without a doubt” prove the defendant ‘s guilt, or there is no DNA evidence and /or eye witnesses, or that little crime scene evidence points to the defendant, or there is only very weak circumstantial evidence - then the Defense Attorneys may decide to not present a defense. It very rarely happens. In the documentary series The Staircase, about the trial of Michael Peterson, they have a scene where the Defense Attorneys and Peterson and his family all discussed whether they would or should present a Defense at all.
The judge should not be crying it shows bias. The defendant can bring that up on appeal. It just looks so bad. It's basically saying what you did was so heinous that I can't even control myself in my appearance of neutrality. The judge cannot even control herself that's how heinous this person is. He's basically saying you're such a monster that I can't be neutral and unbiased
what i can't understand is why didn't they arrest him when she made that phone call because that was malicious wounding charge/battery/assault with a deadly weapon...those are charges they could have charged him with that day she called and her hand was all cut up...these simple charges could have kept him in jail..Why after that accident was even allowed to be around, or why wasn't he jailed then when the call was made? This could have been prevented...
They walk around like that because it keeps the jury engaged, and also helps him think. When attorneys just stand at the podium it can seem static and boring and then the jury starts to daydream. Pacing is actually a tactic most attorneys use to keep the jury focused.
