That’s bull and he knows that the delay coupled with a very delayed briefing schedule plus the fact there’s at least 4 justices placed on the court by the Federalist Society is an unequivocally clear signal that SCOTUS is putting its proverbial thumbs on the scale of justice.
No different than what they did in the 2000 election. For a conservative court that always bloviated about state's rights, that somehow slipped their minds when they decided Bush v. Gore. Never should have taken that case. And if they hadn't, Gore likely would have won the election and the US would be a very different place. Assuming Gore's re-election, no Roberts or Alito for sure. The big question is whether we would have elected Obama in 2008 or McCain (or perhaps W). I think probably the Republican, but who knows since we don't know if 9-11 still would've happened (but certainly, no wars in Iraq or Afghanistan). But I think on balance there would probably be a 6-3 majority the other way.
America would be much better off today if more people like Luttig, who actually care about our Democracy and upholding the Constitution had been chosen for the Supreme Court instead of people like Thomas, who are only interested in using the position to line their own pockets.

Everything takes time. They talked about the considerations for charging Gini. A reasonable prosecutor only goes ahead with cases he can win. There were challenges with this one and others; therefore, they decided to exclude it. That doesn't mean they cannot try it later when more critical cases are out of the way.

Yes. However, I have read Project 25 and noticed that a few of the Conservative Justices stated that they may leave the court if they don't receive a pay raise within the year, which is a strong indicator that if Trump wins the presidency there will no longer be a Judicial Branch as we know it.

There is a process to prosecute a president while in office. Its called impeachment and then conviction in the senate. Consider that the Supreme Court will not rule for absolute immunity while Biden is still President. They won't rule for absolute immunity if President Biden is re-elected. No, Judge Luttig is principled and has integrity, but he also has some draconian beliefs and is just as conservative as the sitting conservative justices. The Supreme Court nominations process should be changed. As it stands, the justices are nominated on a partisan basis by whoever is in office, with the understanding that bias would not exist in rulings. That has obviously not worked for many years. It is starkly evident in the past several rulings made by the present justices. It is no wonder why people do not have confidence in the highest court in our country. Previous justices were possibly less easily swayed. Considering those retired from judicial service have weighed in heavily in opposition to Trump, it seems that some of the present justices are lacking in knowledge of Constitutional law. There should be better way to avoid bias.

I think the thought is too make it clear for all time that any former President, any sitting President does not have immunity for all time. If they do not decide it now, there will be the same delay tactic by trump in the FL documents case.
I'm wondering if Judge Cannon won't postpone setting a trial date until after SCOTUS has ruled on Trump's total immunity claim. We probably won't get a decision until the end of June. Really, the Supreme Court's delay in hearing Trump's immunity claim will likely mean neither of the federal trials happen until next year, if at all. It is DOJ policy not to try a presidential candidate close to an election. It's too bad for voters, because having verdicts in these cases might help voters decide.
The charges against Trump don't "involve official acts" of his Presidency but from actions outside those responsibilities. Attempts to manipulate election outcomes and unlawfully maintain power are not "official acts" of the Presidency. Why did SCOTUS frame the question in an ultra specific, yet irrelevant way that doesnt even have anything to do with Trump's situation, either ruling by SCOTUS will not resolve the issue. If they affirm the President is immune "from criminal prosecution for conduct alleged to involve official acts during his tenure in office", thats great, now what about acts outside of the President's responsibilities? Such as attempts to influence the outcome of an election and illegally retain power? When do we get a ruling on that question?

I'm no lawyer, so perhaps that's why I can't think of one legitimate reason for not throwing this case out, and for not penalising the lawyers who have had the temerity to bring a case that can have no other purpose than to simply delay court proceedings until after the election. In more robust times Trump and his crew would have had their heads removed.

I.e.: - right of defendant to have due process - errors in judgement of lower courts - letting it be would have devastating impact on the country in the future (on the ability of executive branch to act swiftly and fearlessly) - it may result in questioning immunity of top officers in other 2 branches in the future which would have catastrophic impact on the country

You should read legal author and frequent NSNBC guest Eli Mystal's most recent piece on Scotus in the Nation Magazine for an answer to your lamentation. It's one of the best I've ever read on how we got to this point on our Supreme Court and what we need to do about it. No different than what they did in the 2000 election. For a conservative court that always bloviated about state's rights, that somehow slipped their minds when they decided Bush v. Gore. Never should have taken that case. And if they hadn't, Gore likely would have won the election and the US would be a very different place. Assuming Gore's re-election, no Roberts or Alito for sure. The big question is whether we would have elected Obama in 2008 or McCain (or perhaps W). I think probably the Republican, but who knows since we don't know if 9-11 still would've happened (but certainly, no wars in Iraq or Afghanistan). But I think on balance there would probably be a 6-3 majority the other way.
America would be much better off today if more people like Luttig, who actually care about our Democracy and upholding the Constitution had been chosen for the Supreme Court instead of people like Thomas, who are only interested in using the position to line their own pockets.

The Supreme Court nominations process should be changed. As it stands, the justices are nominated on a partisan basis by whoever is in office, with the understanding that bias would not exist in rulings. That has obviously not worked for many years. It is starkly evident in the past several rulings made by the present justices. It is no wonder why people do not have confidence in the highest court in our country. Previous justices were possibly less easily swayed. Considering those retired from judicial service have weighed in heavily in opposition to Trump, it seems that some of the present justices are lacking in knowledge of Constitutional law. There should be better way to avoid bias.

I first heard Judge Luttig testify and stopped everything I was doing, sat down and was transfixed that he told the absolute unvarnished truth…and was a Republican to boot ! A true American patriot.
I think the thought is too make it clear for all time that any former President, any sitting President does not have immunity for all time. If they do not decide it now, there will be the same delay tactic by trump in the FL documents case.
I'm wondering if Judge Cannon won't postpone setting a trial date until after SCOTUS has ruled on Trump's total immunity claim. We probably won't get a decision until the end of June. Really, the Supreme Court's delay in hearing Trump's immunity claim will likely mean neither of the federal trials happen until next year, if at all. It is DOJ policy not to try a presidential candidate close to an election. It's too bad for voters, because having verdicts in these cases might help voters decide.

If they affirm the President is immune "from criminal prosecution for conduct alleged to involve official acts during his tenure in office", thats great, now what about acts outside of the President's responsibilities? Such as attempts to influence the outcome of an election and illegally retain power? When do we get a ruling on that question?

I'm no lawyer, so perhaps that's why I can't think of one legitimate reason for not throwing this case out, and for not penalising the lawyers who have had the temerity to bring a case that can have no other purpose than to simply delay court proceedings until after the election.
In more robust times Trump and his crew would have had their heads removed.
Ther are several reasons. I.e.:
- right of defendant to have due process
- errors in judgement of lower courts
- letting it be would have devastating impact on the country in the future (on the ability of executive branch to act swiftly and fearlessly)
- it may result in questioning immunity of top officers in other 2 branches in the future which would have catastrophic impact on the country

The most aggravating aspect of the SC's delay in hearing arguments and rendering a decision is that I firmly believe they could accomplish all of this a lot sooner than they have decided to. It certainly smacks of blatant partisanship.

You should read legal author and frequent NSNBC guest Eli Mystal's most recent piece on Scotus in the Nation Magazine for an answer to your lamentation. It's one of the best I've ever read on how we got to this point on our Supreme Court and what we need to do about it. As much as I admire Judge Luttig he's a product of and a system insider and would never criticize the SC he was once being considered for. He'll never come foward with a critique of how they are breaking democracy like Eli does in his writings.
We SHOULD CONTACT OUR DEMOCRATIC LEADERS, ALL OF THEM AND INSIST THAT PRESIDENT BIDEN INSTALL 5 TO 6 LIBERAL DEMOCRATIC JUDGES, TO MAKE SURE THE CONSERVATIVE RIGHT LEANING JUDGES, DO NOT PARDON AND KEEP TRUMP IN OUR WHITE HOUSE, THATS WHAT THE DEMS SHOULD DO..FAST TRACK THE DEMOCRATIC JUDGES THROUGH CAUSE BIDEN HAS EXECUTIVE AND PRESIDENTIAL POWER TO DO SO..TRUMP DID IT?
