      And dont forget that Wall street banks use fraud as a business model to gain insane ptofits, and ruined the world economy in the process (2008 financial crisis for example)
      The main point is that the biggest criminals are usually getting rich, while nonviolent drug offenders are in prison.

    I'm from Arizona, when I was 18, I had a small argument with my mom and broke a cup on the floor. Step-father called the police to get a police report for insurance to pay for damages for the floor. Even though my parents didn't want to press charges, the state is required to persecute anyway because it's considered domestic violence. I had to sign a plea and do 6 months of domestic violence classes and pay $500 + court fees to defer/dismiss the case. If I were to take it to trial I likely would have faced 3 years in prison and had a felony. I'm glad I learned when I was younger how the judicial system works here and not when I was older; looking forward to leaving the country.

    Making prisons being run by private companies is bound to end up in corruption, way too harsh sentences for menial crimes and innocent people being found guilty on purpose to maximize profits and to fulfill quotas. In my opinion all prisons should only be allowed to be run by the government/by the state.

      I am from France. My ex i wanted to dump told the police i was a molester whom i was not. She was a psycho with mental isues. State offered me 5 months of parole if no trial. i had all the proves. Even a signed testimonial from her and one from her own psychiatrist. My lawyer freaked out. Told me that now the state was prosecuting (herself had dropped the charges)and that even though our case was strong I might face jail Time. He begged me to accept the offer.
      So i said ok but i want no mention on my legal records. They called deal.
      There i was, guilty of molesting a woman i had never raised my hand on. Since then i know, there is no real justice. Being innocent will not keep you out of jail. My inner faithfull child feels betrayed for ever.

    I am literally in this position. After over 995 days my mental health is destroyed and watching just how bad the system is abusing people because they can and this is sickening and no idea how to help fix it.

    I went to visit a prison in the US with my uncle who was a warden there. I met an obviously mentally deficient inmate convicted of snatching handbags on 3 separate occasions. 40 year sentence. Ludicrous. As my uncle said, “He won’t be bothering old ladies for a while”.....not sure it counts as justice though.

      It really isn't that bad. Say you were charged with a crime you can go to trial and face the standard sentence or you can accept the plea to a lesser sentence agreed to by your defense and the prosecution. So if plea deals didn't exist and everyone went to trial they all would face the standard sentence. The trail granted to American citizens can be very long and expensive for everyone. The thing is we have a very high level of petty crime in the U.S. like dwi. So most first time offenders of dwi will face up to 1-2 years in prison but 99% will plead guilty to something like 6 months probation. Especially today there is so many different options as the criminal justice system has been pushed towards a rehabilitation philosophy in recent years especially with drug offenses which makes up the majority of crime. Also you must take into consideration that every state is different and every state prison system is different. The high plea rate is also due to a large amount cases that the defendant has no chance of winning at trail simply because the evidence of guilt is well established. Plea bargaining really keeps ALOT of people out of prison because most will plead guilty and get sentenced to probation.

      Tracey Hira its a sad reality but soon this will change alot of people are talking. the prison system was able to do all this shady shit because the people didn’t know but now with the internet we have the power thats why they are trying to censor it.     I know someone that got caught with lot of coke... Went to trial and got 4 and half years was out in 2. UK justice US justice are in different universes. 200 years? DAMN I think they need to find a different word to attach to the word system cause it most definitely ain't justice. Lol Mysonne said it perfectly "We can't end slavery.. Too many residuals..       my best mates cousin did 12 years for second degree robbery and while he was in there , he saw people trying to get out , 2 of them got shot in the yard because they thought guards wont see them while they went away and after that happend everyone started thinking about escaping or not , so yeah lots of people think about escaping but usually dont end up doing it because of death or getting shot.

      As an American I agree with you. The rich can literally get away with murder here. While the poor can spend decades in jail for far less crimes. This situation is not isolated to the U.S., but for a country that prides itself on the "equality and justice for all", that just makes it that more corrupt and full of crap.

    Shit like this just reminds me of why I’m glad I lucked out of drug dealing (I was in a position where I couldn’t have just said “I’ve had enough I’m not doing this anymore”) my partner got caught and because of my paranoia with being traced (using fake names, never having people at my house, using only pay as you go sims, using runners as much as I could, never holding at my house) they weren’t able to properly trace who I was and get to me. This was in England so of course I wasn’t facing a justice system such as this but it’s still one of the points I look at now in my life and realise just how lucky I was. Thank you for your videos Shaun, huge fan. Keep fighting the good fight mate.

    You hit the nail right on the head. I don't think it could have been explained better. It's what they did to me. I was young and they scared me into a a guilty plea on agg assault, but it was clearly self defense.

    In my opinion the plea bargain system is necessary because if everyone decided to go to trial the system would not be able to function let alone go bankrupt. If you go to trial and are found guilty the judge is ultimately the on who sentences you within the specific charges. I can see were it can get alot of people screwed when they are facing alot of time but it really helps keep a flow for the large amount of minor offenses. Especially with the creation of drug courts were drug offenders are put into a rehabilitation system rather than the criminal justice system. Plea bargaining keeps the majority of first time offenders of nonviolent petty crime out of prison. Its in the newspapers everyday "dwi pleaded guilty to lesser charge faces 6 months probation". "Sale of a controlled substance" pleaded guilty to attempted sale of a controlled substance faces 6 months probation". If nobody pleaded guilty we would have to be building a shit load of new prisons because if everyone served their sentence as written in the penal law the prison population would skyrocket. Look at the numbers there are around 2.5 million people incarcerated and their are around 4.5 million people on parole or probation. Now add those numbers. That would be your prison population.

    as someone whos interested and knows a lot about history i can tell you justice is something very few societies get right, it can be flawed in so many ways and since the first societies people have been getting fucked by whatever system theyre part of, its some scary shit and has countless flaws almost no matter what

    The plea Bargain is a bullying tactic used by authorities to avoid giving people a fair trail and results in innocent people going to prising everyday it’s a perversion of justice and with out these plea bargains the entire us criminal justice system would collapse in on its self its causing people to not get a fair chance at proving their innocents in court they turn around and say sign this we give you 10 years go to trail and you get 30 its intimidation everyone should get a chance at proving their innocence

    Shaun you should watch TV series called "The night of" its about guy that was charged with murdering a girl,but he denies it,rejects the plea bargain and goes to court, and there are bunch of scenes of him in prison surviving,joining gang,smuggling drugs inside etc.

    A plea bargain is a way for the state to save money and hand down a sentence that they’d more than likely got in trial. People hardly ever get the max unless you are a menace to society. I’ve been called that soo much as an adolescent.

    Plea Bargains.... We need to change the "Pledge of Allegiance" to "liberty and Justice" for some, not all. Drug dealer arrested for a "Hit and Run" of a child on a bicycle. Child in coma. FBI gives drug dealer immunity to nearly killing a innocent child in exchange for testimony against his big drug lord boss. Father of child in coma kills the man responsible for hitting his son and goes to jail. No plea bargain for the father but letting a criminal loose was ok... There is no justice in America, just deals to be made with criminals.. Yes, this was a TV show but this is the way your justice system works in this corrupt f'ing nation. We need a new government, every last one of them. They should all be prosecuted as the criminals they truly are......

      After 14yrs in Arizona DOC, I HAVE THE RIGHT TO MAKE A JOKE ABOUT DOING TIME, PS, three jury trials when i was 18 and almost a year in the old pima county jail, i could tell you more about the system than anyone wants to to know, but il leave that to Mr. Attwood.

    Shaun, lo ve you videos and have seen you explain, in podcasts etc,a little how you ended up in that situation and by the grace of God that could easily of been me. I patrtied so hard particularly in the early 90s rave scene. Fortunantly I ended up crewing for gigs etc rather than taking a route which would of defo ended in jail time, had I carried on. I think its great the way you have obviously helped so many people out when mainstream society would of almost Definetly 'let them rot'. Also its a great cautionary tale, I mean I consider myself quite street smart but the conditions etc that you describe about the jails in the states plus their completely unfair legal system scared the shit out of me! What is your legal situation now? And is it legally allowed for you to profit from it all? Cheers

      Shaun Attwood. Thanks for the reply. That clarifies a couple of things for me. Glad you're able to educate and get an income presumably to help you do so. Also I feel you about the travel situation, I love travelling but there's a good chunk of the world I'll probably never be legally allowed to visit. Simply because of relatively minor charges when I was young and dumb! I think its great you educate young people like this because when ur young you really don't think about the ramifications of what you may consider fairly minor shit. But that shit can stay with you and effect you for the rest of your life. I know didn't fully understand the seriousness at the time. Is there one of your books that you might particularly recommend for me or shall I just start at the beginning?

      Something many people don't know or understand is the whole planet earth has been made into a prison system where countries are different sections of the prison. Hence no free roaming. It doesn't feel right somehow.
      Who signed us up to ridiculous rules? It wasn't our choice to be born on a piece land riddled with policies.

    I heard when ur involved in a crime with other defendants they only offer a plea to one of the defendants who is told to turn on the rest of them? And the remaining defendants are forced to go to trial? Is that true

    i took a plea and only got 1 year probation for something i could have gotta up to 4 years for. I was being charged as a juvenile so thats probably why but i did spend like 2 months in the halls while i was going to court and stuff

    Hi Shaun. What happens to all your stuff once you're arrested? Does it all get reclaimed? Do they confiscate your money? Does the state sell your house and your stuff on your behalf or what? Did you have the money for your lawyer from elsewhere?

    There are other channels on UA-cam with guys talking about jail/prison, but I have to say Shaun Attwood's channel makes prison seem much worse than the other channels. (Maybe it's because of the facilities he was at in Arizona)

    Shaun, did the 26 months you served get deducted from the 9 years? And if so, is that usually the way it works (hence an incentive to negotiate).

      fortunately its not. non of the UK judges have political connections. you can probably murder someone in the UK and still get a shorter sentence than a thief in the US. also in the US you have to be found innocent not guilty. in the UK on the hand you need to be found guilty such as having finger prints at the crime scene etc
