      The plea agreement was for a lesser charge. If he goes to trial, it will be on the original charge, CSC 3rd. So he’s risking more jail time, not sure how much.

      Yes, his lawyer seems to be out of touch with what harm his client caused. Even with great therapy she'll live with the effects for her entire life. Hopefully she can find a healthy outlet. I feel so badly for her. Sex offenders are just that and will always be predatory. Nothing fixes them! Brave child to speak up!

He even says, “I’m not trying to diminish the act”. That’s no different than a defense attorney that is trying to get a murderer a life plea, instead of the death penalty.

      He gave him the max allowed by law for the act he pleaded guilty to as part of a plea deal..sometimes plea deals are made so the victim doesn't have to reluve it in court

      Re-victimisation is not limited to sexual offences or just women
      Unfortunately, though, child sexual abuse survivors were much more likely than those in the control group to be re-victimised in what are considered medium and high harm personal injury crimes.
      For instance, they were five times more likely to have been victims of sexual assault later in life, twice as likely to be victims of physical assault, four times as likely to be threatened with violence and twice as likely to be stalked.
      We also found the increased risk of re-victimisation was not just experienced by women. For example, male survivors of child sex abuse were seven times more likely to be the victims of a further sexual assault than the men in the control group
      Maybe read before judging or just be kind.

      I am not victim blaming, especially since we don’t know all the details of both sexual assaults. But, it is outside of normal statistical variations for one person to be a victim of two sexual assaults by the age of 15. I thinks it’s fair to ask whether the victim was engaging in particular behaviors that opened herself up to being more at risk of being assaulted. I think this is also what @dredarrough6385 was getting at.

      I get why there are plea deals but in cases like this the prosecutor should put the work in and get the conviction at trial and put them behind bars for the rest of their life

      In most cases like this, the prosecutor will seek the permission of the family to make the deal. This is often done to spare the victim from having to testify.

      We have a judge where I live that has done it more than once and I love it. I live in a small community and the lawyers seem to have these deals worked out all the time. I love when she tells them no way she is approving it. I vote to retain her Everytime.

    We all know the real reason why he doesn’t want to go to jail. It is because he is scared for his life. The crime he committed, makes him a walking target in jail, and only a matter of time before the other inmates get their hands on him. Such as but not limited to by accidentally leaving his cell door open or accidentally putting him in general population. Or just turning a blind eye in general. A lot of accidents happening.

    He isn't that slow. He provided her with things she couldn't obtain on her own because of her age. He was setting her up. He alluded to having a gun so she would go along with the rape. He understood he had to take her to a secluded area to carry out the rape. I'd say he understood exactly what he was doing.

    I feel so sorry for her. I was sexually abused from the age of 3 until I left home for college. All of my childhood I lived in fear. I will never forget the painful rapes. I will never forget the shame, embarrassment, and guilt I felt.
    Fortunately, my faith in God was strong and He enabled me to carry on. He made me strong and gave me the Will to live. I became a professional singer /songwriter and musician. I have traveled the world.
    I forgave them a long time ago, but my mind cannot forget. When I was a little girl I dreamed of growing up and having a family with children of my own, but as much as I have healed, I am so unlucky in love. I just can’t seem to find love . I hope love will find me one day.

    The judge felt his hands were tied and I don’t blame him. The defendant literally confessed to the crime to the police even before the plea! Plus the ridiculously short sentence offered by the prosecutor would have him out before the victim was a full adult and able to cope.

      A couple of times, you say: 'He doesn't have anything to lose' in regards to going to trial
      This guy was being sentenced on a plea agreement - usually referred to as a 'plea bargain' or 'deal'
      In order to save the court the trouble of a trial, they're allowing him to plead guilty to a reduced charge
      If he doesn't accept, then he's gonna have to go to trial on whatever the original charges are
      Just listen carefully to what the judge is saying

    This is so triggering for me , but also so glad there is some form of justice for this young lady . So extremely brave she is. It took me until I was a parent myself to be able to seek help and speak the words out loud. I relate to her self harming. God bless you. Young lady with prayers always from CANADA. You are brave, you are a hero, for speaking up for those of us who are afraid to use our voices. Please do not let him take anything more from you, fear, loss of confidence, self harming, all these things are giving him power over you that he does not have. You are brave.       But the crime has a range of sentences, but because of the judge overrules the state, the suspect was allowed to redraw the plea deal.

    This judge is insane. I can assure you I was molested, not raped but molested and I required therapy for years. I had nightmares, I had poor relationships with others, I had control issues and was overdependent. It is insane for the law not to presume maximum psychological harm from a rape let alone a childhood rape.

For some reason the last few sessiosn when I was about 70 truly did the trick. I think it was when I stopped focus on the molester and realized that my true hurt and disappointment was from my mother not protecting me even when I told her what was going on. Once I realized that I really was able to let the trauma at the physical stuff go. She is dead now and that really helps even though it sounds cold. I hope you find peace.

    I've watched several programs about what happens to sex offenders in prison. They have to be in a special sections of the prison because they would be murdered by someone in general population. Many gangs in prison will make a new inductee kill a sex offender to become a gang member. If our justice system fails us, unfortunately, prison justice becomes our only hope for real justice.

    This is my hometown Judge; he is also the Circuit court Judge for the next county over. He's strict but fair, I watch his Court on a weekly basis and he has had some wild cases over the years for being such a small town.

Her mother is not going to be much help, she is and was pretty weak herself. She should be showing the girl how to stand-up and be strong, and how to avoid this happening again...

      I agree it is highly unusual for a 15 year old to have this happen twice...... And from what I heard they must have been hanging out prior to this not just the day of the incident..... I'm not blaming the girl because no one deserves to be sexually assaulted, but how do we know how she was acting towards him, was she tempting him, wasq she flirting making him to feel she wanted him?       It’s 23 months (min) up to 10 years (max). With time served, he would meet the min requirements, and thus be immediately eligible for parol. Chances are he wouldn’t be granted parol until probably 5 years.

      I'm sorry, I missed the part where it said the mother walked her over to his car and let her get in... /s she's 15 not four stop blaming the mother for the criminals actions. If you listen to it he carefully groomed her until he was able to isolate her. I guarantee you he didn't do it in front of anybody that would stop him like her mom. He tricked her into being isolated by offering her things like vape pens, she's not going to be telling her mom about her 20-year-old friend that gives her weed / nicotine. 🙄

    I really want him to take it to trial for what he put her through. I mean let's face it he has already admitted it .
    She was very brave to stand there a couple of feet from him . My heart broke for her and her mom.
    I wish her well I really hope she can move passed this with the right therapy. She is stronger than she thinks she is. She stood in front of the judge and made a statement she's a survivor.

      @@nicolataylor8135 the way our system is set up sucks for victims. Trials can take years. Some victims can’t handle the retelling their trauma over and over. Evertime they start to heal there’s another hearing. That’s why they plead some people out. Also sentences aren’t long enough for sex crimes against kids or adults. I’m sorry you went through it.

    23 months to 10 years with almost a year time served?! So he can get out in a year. WTF is wrong with our system?! The man raped a child threatening that child with a gun! Wtf?! I know a guy who just sold a lot of weed and got 17 years! So what they are saying is they care more about weed than they do children. And then they wonder why the inmates kill these guys. Cause they know as well as most people do that these guys get almost no time for their crimes. Absolutely rediculous. I have zero faith in our system.

    Very brave of the victim to face her assailant! I hope this helps her on the long and arduous journey of healing…. As far as the defendant. If it was up to me they’d get the death penalty, or better yet, taken out back after court and put down. But I would settle for a life sentence, considering the damage these animals impose on their victims lasts a lifetime.

      100% I agree with you. Their testimony broke my heart. I have a daughter who is the same age as the victim was and I couldn’t imagine how heartbreaking it would be if my daughter was in so much psychological distress. I commend the mother for having the strength not to lunge at the scumbag who hurt her daughter because I don’t think I would exercise the same restraint. They should bury him under the prison. That girl is going to have a lot of issues going forward and her future relationships with men will always be affected because of what she endured.

Being slow isn't an excuse rape, especially a family that opened their home to him and his brother and this is partly why people don't want open their families up to older kids in foster care because it opens their family up to whatever that kids biological parents have wrong with them or whatever they may have done to the child and that puts your family in danger

      He got the maximum based on the charges he pleated guilty to. Before the DA gives a plea deal to a suspect, it is discussed with the victim.
      For most victims of abuse, recovery start after the trial. A plea deal is a strategy to quickly go to the proceedings. However with a plea deal also comes with a request from the prosecution for punishment. Because the judge overruled this request with the maximum for the charge, the suspect has the option to revoke his plea deal. The fact that de pleaded guilty in a plea deal cannot be mentioned in a jury trial, but the suspect also confessed against the detectives. 10 years is a long time for a sex offender, but a jury trial can it extend with a lot more years. The DA will try to get the 2nd degree felony back on the table and that carries a 10-25 years sentence (if proven). Juries don't like sex offenders in general, but almost a hate when it involves minors, so the is a real danger that juries already have made up their minds before the trial even begins and at that point the defense attorney needs to prove your innocence, which of course is a uphill battle with a (taped) confession.
      In some states this crime even would qualify as a 1st degree felony as the victim as underage, the offender was a member of the household, armed with a weapon and penetration occurred and can be punished with life in prison. But then the question of mental capacity (IQ) also comes around the corner. If IQ is too law, the intent factor for 1st degree might not qualify.

    I cant imagine the pain this young lady feels,I was a victim of an assault walking home when i was 17 Luckily i got away before he got his way with me, im a completely different person sinse that happened,I used to be very outgoing now im just anti social and traumatized,and i was not assaulted sexually,thats how much these things have an affect on the victim!

    Also Mandoo I’m not sure how victims services work state to state but here in Tennessee I received counseling free to my family (I was 12) but this mother needs victims services for her PTSD and the trauma she suffered and continues to suffer from because of what was done to her child! The psychological damage is not plateaued yet and no timeline for when that may happen. The mother needs these services made available to her and any other family members who live in the home with them because it has to be seriously affecting anyone else witnessing the cutting or drinking and the mother so scared must affect everyone.

      Yes same, I was able to get counseling for a certain amount of time, but my dad definitely needed some too. I think that's the only time I've heard him cry with such grief.

    Plea agreement are between the prosecutors and defendants, not the Judge, they usually tell the defendant that the judge can overturn the plea and go to a higher or lower sentence

      Pleas for this kind of crime should not exist. They hide the severity of the crime and are too advantageous to the criminal. Children can and will be strong if supported through this process. They have already survived the worst in life.😢

    This judge is great. He was a victims advocate before becoming a judge. He has really turned around justice, especially in terms of women and children in this county.

    Every state justice has a system. Points are determined by crimes: with weapon, hate crime, kid involved and add up and determines time

    Child predators and rapist should be in prison for life and if they get parole should have to wear a ankle bracelet. Also if a woman get a restraining order the person should get a ankle monitor so he would know where he is at all times.

    If he goes for a jury trial the judge said he will go for the original charge, not the reduced charge, so he has a lot to lose by going to trial.

    You mentioned Louisiana in your comments. This is a Michigan court case. He faces 15 years if convicted at trial on the original charge. Next court date is May 9th.

      @@Mandoo_TWO I think they should have prosecuted this as forcible rape since that's what happened. The survivor is clearly willing to testify and did a good job with her statement.
      This plea bargain makes it seem like this was an illegal relationship rather than a rape. That's frustrating to me because that's not what happened. He straight up violated this girl. And he should be looking at 10 years as the _minimum._ Not as the top end. If I were the judge, I'd probably reject this deal.

      @@Mandoo_TWO If I understood the judge correctly, he was looking at a minimum of 2 years in country jail. Since he'd already served 347 days, that would mean another year in county rather than state prison.
      Now if this had been a illegal bf/gf relationship, maybe that would have been appropriate. But as the judge noted, this is rape. And the DA seems to have been cool with this guy getting 2 years in country jail and probation for that.
      That's bullshit. Now maybe for the girl's sake - since she's clearly been through hell over this - not going to trial is the best option. But letting him to plead to sexual seduction (what it's called in Nevada) is not what he did. So bravo and the judge for insisting on state prison time.

      @@Mandoo_TWO First degree CSC carries 25 to life in Michigan. Occasionally a judge will do a downward departure but he would still face at least 15 to life if convicted of the original charge.
