I need your help and advice please. We met and lived together for 4 months (same home, in Japan). She then moved to Australia on working holiday visa. I had to move back to my country in Europe, I lost my job. I got a new job in Australia, but her visa is expiring, so I would need to bring her as a partner. We lived together for 4 months, the 9 months long distance. Do you think we can get the de facto?
I have some confusion regarding the documentation requirements for the partner visa application. In a previous video, it was mentioned that the officer would review the documentation from the date of the application and that sufficient evidence is necessary. If a couple enters into a civil union a year after submitting their application, could this pose an issue since they were not considered de facto partners prior to the application?
It is not mandatory to have a civil union certificate before lodgement to waive the 12 month rule, however, it is advisable that they do so, so that it can be assessed as part of 'Time of Application' facts. The best way to look at it is that these are all separate things: - Waiving the 12 month rule - Showing you are defacto when the application is submitted - Showing you are still defacto when the application is ready to be granted
Hi Martin, my boyfriend stayed with my family and I for a year on a WHV visa, i couldn’t add him on the lease due to working rights (lease is under mine and my sisters name) but i added him on the internet bill and he paid it monthly and he would help around the house chores/ buy groceries. He and I also opened up a shared bank account. I’m wondering if this is enough to classify us as a de facto relationship or will we still need to register our relationship?
Simple rule of thumb...always register when you can (i.e. you live in a State/Territory that you can). It means you only need to prove you are defacto NOW, as opposed to 12 months ago. Big difference in risk and documents required :)

My GF is an Australian resident and we are moving to Melbourne in February 2025. Because we have not lived together due to rental issues at home in Ireland, would it be a good idea to do the civil union as soon as we arrive, and then almost a year later when my WHV runs out to apply for the partner visa? Are you sure (SA) South Australia isn't on the list for registering a relationship? Most places I have looked it is only WA and NT that isn't on the list. Please confirm this if you could. Much appreciated.
Hi, i know this is not relevant to the 12month rule directly but we will apply for 820/801 as well. So, on the gov website it says if the applicant is not on a substantive visa, has to meet additional criteria. In my case, my gf got her bridging b visa and visa refusal for the student visa application on the same day. We appealed it and she is still on the bridging b visa. I know we can still apply for the partner visa during the appeal process but wondering what would those extra requirements be.

The length of the relationship as a whole (i.e. how long you have dated for) would also be a strong factor (i.e. couples that have dated/been in a long distance relationship for multiple years would be in a better position 12 months of that could have been defacto). Me and my partner has started dating but live separately on February 2021 but since she got pregnant then we decided to move together on April 2021 (our de facto began). Now, we have our little precious one but our de facto relationship doesn’t meet 12 month minimum requirement. My current visa is Work and Holiday Visa (462) and will expire soon on February 2022. However, even if i wait untill my current visa expired and apply for 820 it still not meet the minimum requirement. Can someone help or give me an advice or any of you has similar circumtance like me ? Any help are much appreciated ! Thank you and cheers

Hey Micky - let’s simplify this: Registering a Civil Union in order to waive the 12 month rule? You can register anytime up until a decision is made by the DHA (ie after lodgement is still accepted) Registering a Civil Union in order to waive the 12 month rule AND strengthen your facts at TOA? Then you should register before the visa is applied for. Hope that clarifies!

Civil union, yes! Waiting 12 months to apply? That may not necessarily be required. Civil Unions waive the 12 month rule :)
