      @@PeterRaiblais Our NICER standard operating provision living trust administration Trusted Advisor refused to use the estate plan trust saying it was dangerous, and we needed the Latin Law Crime Interdiction administration being installed on UA-cam. With Notary Index Crime Enforcement Regulatory 837PC Citizens and Sheriffs on call to arrest trust warned, permission ledger tracked and NICER exposed Will, Trust, and LLC forgers, counterfeiters and embezzlers.

    Thank You. I had a Living Trust with Will established legally this year. My wife suddenly passed, and I realized that my 3 Grown and Married Sons would be my inheritors? It was
    something I learned over the years of watching my friends and associates heirs fight about
    family estates. I am not rich or wealthy. I do however have sufficient funds, property and
    valuables making it necessary to avoid any hard feelings or even departures of my heirs. Your explanation between just a Will or a Living Trust with Will was easily understood. As I get older (Now 87 yrs, I find my mental abilities and even daily routines getting more and more difficult. Rick

    Great content, it doesn't take a recket scientist or our family whose Trust cost 50% in Billable Litigation hours and related costs to tell you they are both made out ofpaper and need to be Probate or NICER validated to avoid inheritance hijackers.

    My wife and I just inherited the farm. Now what? Maybe you could do a show on 'I just inherited the farm. Now what?'
    Everyone advises..get an attorney. That's not easy in Nebraska although I know they must be out there but we don't even know the questions to ask.
    Think about it.

    So will a living trust allow me to distribute my wealth to certain family members for certain emergency needs upon my discretion? but in most cases the wealth in my trust will first go to my immediate family needs first, so in other words can a living trust take care of those who are listed in it or whomever I decide needs the help at the present moment?

      This old man says once you're gone your successor trustee is the boss if they're a greedy trustee they get it all and the Estate planner who promised peace of mind litigates it for 50% in Billable hours or refuses to help like our Santa Cruz CA EP.     Do you recommend using an elder care lawyer for silngs of an elderly parent.

    WOW!!!!! accidentally came across this video. Amazingly informative. Am watching your other videos and learning. I have question-a lawyer made up my will years ago with my brother as only beneficiarry as well as executor, power of attorney, no heroic measures etc. etc. I own nothing and my only asset is my investment portfolio which was set up with him as sole beneficiary at TOD. So at time of death all the investments go to him. This avoids probate?

    When should I use a Blind Trust and what are the pros / cons of them?

      Typically, this is not a strategy that we implement in our structures. There are certain types of trust that we do implement that are similar to a "blind trust" in that we have a separate nominee trustee or separate entity to act as the trustee, in order to provide some anonymity. Often with blink trusts, there is a separate trustee with complete control. We typically create structures where there is not a separate third party involved as our clients prefer to maintain complete control of their assets.

    Toby, I’ve been enjoying a lot of your content and it would seem we have a lot in common.
    How does a living trust work if you wanted your property (personal home) and rental properties to be owned by a land trust whose grantor is an LLC in Wyoming? Not sure if that makes sense or not. I’m thinking of a recent video you did where you were talking about privacy and having properties owned in land trusts. How do living trusts and land trusts work together?

      Quite well actually. The thing to make sure you get right is which entity owns what and who the beneficiaries of the trusts are. It is possible to have one trust as the beneficiary of another trust. So as soon as you have what you want to be defined it isn't very difficult to get the structure implemented from there.

      If the beneficiary of a Living Trust lives in a foreign country or is not a U.S. citizen, the Trustee may be required to withhold additional taxes from the assets that he or she transfers to the beneficiary. The beneficiary, in addition to paying extra taxes to the IRS, may also be required to pay taxes based on the foreign country’s tax and inheritance laws.

    Is there provisions in the living trust to take back our Cest De Que Vie trust funds. The living trust as the creditor?

      Generally, with the living trusts that we create, you are the grantor, initial trustee, and beneficiaries simply have a future interest. All of the assets in the trust are your assets so there is really nothing to "take back". If you do not want a certain asset in the trust you can simply revoke the trust or remove the asset from the trust.

    What happens if my husband died and the home mortgage is in his name only ,but the home insurance, deed of trust ,property and looks like title is in both names .What if anything can I do to get mortgage in my name .I have paid the mortgage payments sense day one never late,also the mortgage has been sold to 4 mortgage company's? ?

    In we leave our house to our children in a living trust ( we are 70 years old), and one of them has something tragic happen and we’re to be sued, is our house considered theirs and therefore can be taken in their lawsuit?

    I am the product of an affair, the man I have called Dad all my life died last year. My half sister talked him into giving her his POA irrevocable. She put him in nursing home, convinced him to write me out of will. She took everything. When she sold the house, the title company found the trust that him and his wife had drawn up 20 years earlier. Now I am named in there as an heir of one third. All I got was one third of the sale of the house, NOTHING ELSE. When I asked her if the trust included just the house, or everything. She said just the house. Don't push it she said. So the trust takes precedence over the will. Is it her decision?? What can I do.

      What a tough situation, we are so sorry to hear about this. It sounds like it may be a case of elder abuse or fraud, and you would want to speak with local counsel well versed in probate and estate litigation. Please be aware, that this can be a very expensive route and doesn't guarantee success, but at least an initial consultation will allow the attorney to delve further into the facts than we can here and evaluate your case accordingly.

    I am confused. I own a home but want not only my two boys to have access, but two minor granddaughters too? I really don’t want the home sold. I want all of them to have equal access to live in the home! Rather then them all cashing out since homes are so hard to buy and pay off. I want them all to keep and share the home? I don’t care if they don’t get along they can learn to deal with each other! How would I do this? I have a one sided Trust currently where one Son is responsible the other is on State Aid? The granddaughters are minors! I would rather have everyone share the house!! And not sold!
