    You know what I found? People can use footage from big corporations so long as they are not critical or against the mainstream agendas being pushed. So If post video reaction to Britain's got talent saying how amazing it is ITV leaves the video up. If I post a video reaction with criticism of the show or something I don't agree with, then the video is blocked by ITV. If say a boy dressed as a girl is amazing stunning and brave ITV leaves the video up, but I do a video saying I believe its wrong to push the idea that boys can dress like girls ITV blocks the video. I have tested this on a different channel, so be pro WOKE and you will be fine.

      Correct-ish. It’s most likely YT blocking the other things under their terms. But companies (unless pre-copyrighted on YT) are more likely to not flag you if the content is in their favour as it’s free good press. The rest needs to fall under fair use and you’ll have to be prepared to fight for it. Content of private users is less likely to be flagged

      I pretty much covered this in the video. Are you replacing the sound with your over voiceover and background music? Also short clips not one long one? Some content will be massively protected, but it depends how you repurpose it.

    Hi there,i only added texts and some effects on my videos,however,i got rejected from YPP as i have reused content,if i use voiceover,can i just use it at the beginning and the end of the video or must i use i voiceover throughout the whole video

      You need to add a good amount or new value or repurpose content. YT doesn’t want lazy content.

    If I use clip from movie and make it Rotate, Colour change also add overlay effect and voice over on it. Still be claim as original work?? Can owner still have rights to gave me strike for using movie clip reference?

      depends if it falls under fair use and if UA-cam is able to recognise the clips to tell the owner. Using clips for fair use in a different way and adding value is ok. just showing there content isn't

      @@shahadathossain1046 too many questions and variables for me to answer this. I mean can you afford a legal team to challenge? If not and you are unsure then don't use movie clips. The only way you can use other peoples stuff is under fair use. So if you plan to do this then you should start learning more about that.

    Can you explain how some you tube channels have only short movie scenes like 4-5 minutes etc? Just original movie scenes, How people get away with that? Is that still a fair use?

      If you properly repurpose and add value then it can be. but the more you use from a single source the more risky

      it may be that they got big enough that they are tolerated as free marketing now for films. it doesn't mean small channels will be treated the same. that said companies will normally be less aggressive against channels being positive to content

    I've attempted to use clips for under 4 seconds and maintain a gap of 10-15 seconds between different clips, but I'm still facing copyright claims. I've tried various techniques, yet the copyright issues persist. I would greatly appreciate your help.

      Just don't use copyrighted material unless 100% fair use and repurposed for review or educational purposes. but even then you may still have problems. It's not the length that matters. i cannot offer individual feedback as this is such a complicated topic. It's not beginner friendly.

      @@itsmyfood7076 this is not a simple question to answer. Some promotional footage may be aloud for review purposes, though not all footage. But that still depends from company to company and how hard they protect their IP. Best advice is to use footage other bigger review channels use.

    Hi, how bout like gaming content channel, for example mostly having a copyright issue (unable to monetize) due to songs.
    I had one which was resolve as i disputed for the reason being fair usage policy. But im not too sure how to ensure such a problem wont occur again and im confuse of why other gaming channels do not have this issue (based on what i have look at)

    I do documentaries on comedians where I use stock footage I myself collect. It’s a collection of six second clips about the comedian spliced together that’s all muted while I provide commentary and graphics on screen to talk about the comedian and what they’ve done. That would be fair use right?

      It should be by your description. But there will always be a chance it’s registered as copyright footage and YT flags it. It’s just depends how aggressively the TV company targets people using their content. The bigger the company the more aggressive they can be.

    Where you describe "be transformative" and "make it short", if someone were to use a clip of a tv show or movie, regardless of how long it is, but put a VoiceOver in place of the original audio, could that qualify as fair use?

      Maybe. it's more about you adding more additional value than the video clip brings to your content. if the video wouldn't work without out that particular clip and you are making money from it, then it probably won't be fair use. The more you repurpose, add value and opinion or education. The more it is transformed. So either transform it or use it out of context (like when people use memes). Fair use will always be a grey area and carry risk. But the reward can be better videos and faster growth.

      it's not so much about the clips but how you use and repurpose them. You need to research and understand fair use for this. But even then with movies and music you will still have the odd issue, it's part of the game.

      Hmmm never really thought about something like this. It would probably be ok as you've repurposed it into an art form separate for the original use like "Cassette Boy" does.

    Let's say for a challenge, you want to use footage to show a pro sports match. The challenge would be if you can beat the pro. So you show a little of the pro footage then you make your attempt, obviously adding commentary, entertainment value etc. This, to me, sounds sufficiently transformative enough because you're adding a whole new level to the original content that it was never originally intended for.

      This sounds fine to me and falls under fair use. Even better if you have graphics or drawing on the screen to show what the pros are doing. There will still be a chance that a sports brand decides to make a copyright claim if they are aggressive, but YT may back you.

    ALWAYS submit counter-notifications explaining how your content is fair use and that's it, if they want to make the strike stick, they'll have to sue you, which 100% of cases won't happen.

      100? Be careful giving advice like that. Some companies will sue you depending on how you use it. If you have a budget for legal advice on videos then all good, but most UA-camrs don’t.

    Since I plan to do a review channel, if I use clips of a show that's within 5/6 seconds and the source is from archive and unofficial animation sites and not legal streaming services like Netflix, is that susecptible to copyright claims or is it just the matter of how it's used and where you find it?

      It’s more about how it’s used and if you are directly profiting off their content. Does your commentary stand alone as the main part of the video. Have your repurposed and added enough value for the video to be something new. It also depends how aggressively they protect their content, some see it as free advertising and others see it as stealing intellectual property

      @@channelprofits I'm still doing research on that; it's more to do with reviewing shows and movies like a sort of bucketlist thing, but that's some good pointers to consider. When you say repurpose and add new value, can you give some examples about those two?
      Just want to get a clear idea of what to expect.

That would be new and not about showing the game. Best to look for examples of successful channels doing what you want to do and see how they are doing it.

    Thank you for the advice! In my 15-minute video, I intend to incorporate 4 distinct video clips on various topics. These clips will each range from 30 seconds to 1 minute in duration. I'll be weaving them into a presentation I've carefully crafted. To enrich these segments, I plan to include subtitles, feature my brand logo, and even have my mascot engage with the viewers on the presentation video. The majority of the video will consist of my original contents, such as the initial first 3 minutes, Then, I'll introduce a 30-second to 1-minute presentation clip, followed by another 3 minutes of my content, and so forth. Additionally, I've included credits. With all these modifications and the transformative nature of my work, does this fall within the realm of fair use?

      You could be, but I would still add graphics and other things to the video to make it more original. The more you stop to talk the better. You want the educational part to be more important than the clip itself if possible. Look at how the channel "charisma on command" uses clips to educate.

      This means it won't get pushed out in all countries due to certain copyrights. The content you are using may be partly copyrighted. Or if not the content is of a nature that some places don't allow it. This is why you want to repurpose as much as possible so it falls under fair use.

      @@alwaysavestheday No shouldn't be a copyright strike. You would be told. This is more similar to a video getting age restricted. But you want to working out what the issue is. Repeating this too much can lead to account issues down the line.

      uploading will show which parts are filed on UA-cam. Technically they could register everything at any point. So best to always just work with fair use as best you can. You see people do all sorts of things from flipping the video, adding different voices and audio. Try to use stuff that others are using

      Sorry I cannot comment on individual clips or what is and isn’t copyright protected. You have to repurpose and use under fair use, otherwise technically it’s not.

      The issue with these channels (as a small channel) is that you won't have permission to use the footage of the new tech. If you are talking over the top then it may be fine in terms of repurposing. But it's a grey area

    hi, in the correspondence section (video), I noticed that two UA-cam channels have the same video as me, (where I don't have the rights to both videos) as they are (public content). Could I always request removal from these channels? or I risk committing a violation too. A thousand thanks

      if someone is directly using your content then yes you could request a removal. I generally send an email via UA-cam first. That works most of the time. But i personally don't like to flag every channel as this will give them a strike and most people just don't know what they are doing. If they aren't getting any views then I'll probably leave it. if they are getting views from 100% of my video and didn't respond to the email, then I'll I'll request removal.

    I want to make movie recap channel and videos but i keep getting copyright claim...can you help me . Why can i make videos like other movies recap channel as my videos are edited every 5 seconds and mirrored with filter on top of it and layer of motion video on top of it with 5% visibility...
    But still i get claim?

      You are using copyrighted content. So YT will block it. You need to heavily repurpose (e.g. for educational or review). Recap will not be fair use as you are making money directly from someones content without adding value. Even if channels are getting away with it, they probably won't for long

    Okay. I would like to make a crack video for my favorite fandom. I normally download the clips from UA-cam and re edit them, but my music video was already taken down (a multi fandom thing). How do I get around copyright? Do I record the clips myself? And if so, how do I even get the clips?

      I’m no expert on movie trailers, but I’m sure it’s a case of it depends. Some companies may be ok and others not. You are best to react to trailers as this makes it fair use

    Hi i have a question! I use movie clippings or interview clippings of celebrities from youtube for the upper half of my video and the lower half i add my own video with the corresponding food items or recipe. I uploaded one and got a partial block copyright. how do i avoid that? i se many other channels doing it and they all are doing do well with million+ views

      Not sure what you are doing. but you would need to repurpose more. It's also good to test and change what get's flagged when uploading. So do a daft upload and then cancel. if requests are coming in later it's a choice of the owner to flag your channel

      Do what the other bigger channels are doing and try to follow fair use. It’s not very beginner friendly lots to learn in terms of what you can and can’t do. And some stuff you just need to test

      Needs to fall under fair use and none protected content. Normally you can use certain clips for review and promotional reasons.

    hi! not sure if you're still replying to these comments but if I use clips for a movie review that are of the actors in different interviews and some clips from the movie that I cut and move around- all 7 seconds or less- with a voice over of my commentary is that fine? ive always wanted a UA-cam channel but I never wanted to show my face online. I have a few slide images breaking up the video, but the video itself is mostly the actors interviews (all soundless) and movie clips (also soundless) with my commentary spoken over it.

    hi i was wondering if u could talk about thumbnails and image copyright ? because what if say i use someone else thumbnail will i get copy strike? and i mean literally screen shot the thumbnail and use it as my thumbnail. if not can we just adjust the thumbnail a little bit after screenshot and use ?       Hi there, great to have you here. Technically you can’t buy channels. But you can buy businesses that own channels, so just be careful. If a channel is getting views and is still active and relevant then it can be a shortcut. But it depends how much it is and if you could but the money to better use in a new channel.

However at a glance I can see that they have posted many videos over the last 2 months and grown very fast. But it doesn't look like they are monetised, so not sure what their plan is for making money yet

    Hi, Thank you very much for the video, extremely insightful!
    I just started UA-cam where I make short videos (5 min) on sports' champions biographies (i.e. planning to do one on Mike Tyson)... I include my own voiceover in Arabic throughout the video, would it be fair use to include small clips of youtube videos around NY in the 70s to showcase where the character was born and a couple of 5-10 sec clips (still from UA-cam) on the character's successes? Overall the video will include mainly images.
    I believe this process would be highly transformative and it would be repurposing all these clips that are already out there?

      Original ideas are the best. But there's a reason there is a meme culture in our society. Iconic moments in culture visually convey messages quickly. the arts are responsible for most of those moments. unless you go viral no one knows who you are yet.
