      @Andrew_Warden Such powerful words from Ashley Judd, and they resonated deeply with me. As a 12-year-old almost 50 years ago I was sexually abused by my adoptive father during a weekend visitation. He claimed that I reminded him of my mother who at the time had separated from him and filed for divorce. That was the longest weekend of my life, and when I was safely home with my mother, I refused to go on any more court ordered visitations with my father. After being pressed by my mother as to why I was refusing to see my father, I told her what had happened. I had to see a child psychologist who advised my mother against pressing charges against my father, because his attorney would easily retraumatize me on the witness stand. Fortunately, the judicial system has made it easier for children to testify against their abusers, but I think it is still a traumatizing process to put any child through. I applaud the ones who are brave enough to testify, but I also feel empathy for those that choose not to face their abusers in open court. I wish them all peace and healing.

    Ashley....thank you for having the courage to speak so frankly and eloquently. I am sick of the language of the abuse of men being softened and minimised. I've never heard it stated better... it's a theft of women's autonomy, dignity, time, peace of mind and safety.

      Problem with Ashley is that she knew that girls under 18 who were interviewing for parts would be sexually abused or raped - and she did not warn them. She might have bailed out, but any responsible adult has a duty to report child exploitation to authorities.

Tragic that they were compliant at the beginning of the fame ride. Victims absolutely have embarrassment and shame. These are complicated situations and I'm not defending rapie Hollywood power players. This is not the life dream goal to have for Women or Men. Look at what Diddy Daddy Puffy Diddler has been accused of doing.

    We've heard enough of Hollywood talkng about Harvey now that he's been imprisoned. He's no doubt guilty. Still, everyone deserves a fair trial, otherwise the same precedent can be used against innocent people.

      @@v2krpl37dh The testimony of women who were not connected to the New York conviction caused the guilty verdict to be overturned. I blame the prosecutors and the judge for sloppy legal work. I wonder why these women did not simply file their own charges to hold Weinstein accountable? I hope it brings Weinstein's victims some peace of mind knowing that he will continue to serve prison time for his conviction in California, although it must be distressing to see the New York verdict overturned. Weinstein has grown into an old, feeble, pathetic man, and I hope all his victims will find peace in knowing that he has been put away where he can no longer hurt anyone else.

    Hmm. 7 judges. 4 of whom were women. Ruling was 4-3. Thus one of the judges who ruled to overturn the conviction was a woman.

    I'm sorry, if you can be charged with a crime 40 years (or more), after the fact why does sexual assault come with a time limitation?! It's complete and utter BS. 99.9% of victims across the globe do not receive any form of trauma healing during the time the mind and body is going through various levels of shock and trauma! Some victims carry this mental and emotional pain and suffering to their graves! Especially in cases where the victim was actually blamed for what occurred. These things are rarely discussed, and are hard to pinpoint if you are unaware of the victims history. Yet here we are with laws created to guarantee victims will not receive justice. It is outrageous.

      Because the legal standard is beyond a reasonable doubt. If someone can bring a case 20-30 years later, it is much less likely documentary evidence and other witnesses testimony exists. Evidence and memories fade. You would just be convicting purely on someone’s word alone and nothing else. That may not be conforming with the standard beyond a reasonable doubt. That gets much closer to an authoritarian regime, where you are purely guilty by accusation and nothing else. Examples of innocent men sent to jail over rape accusations: bryan adams, duke lacrosse team.

    I'd also like to say that this situation doesn't just happen with men... women abuse their power as well... read the book "women that hate other women." I and many other's had their lives tortured by corporate women... lives were ruined and careers were detrailed b/c of the abuse of power... thank you.

    Ashley and Jodi, as one of the millions of victims of this type of assault, I thank you for stepping forward to clearly explain the intricacies and nuances of the "Appeal" Court decision. The courts are misogynist and actively so. Yes, Jodi, women suffer the cPTSD (and from horrible domestic violence) much more than the men.
    Years later, the first thought in my head upon awakening is a reliving of the five incidents and the balled-up fist brutalizing me. This is my first time saying this out loud, online, and I hope other women persevere and come forward while benefiting from counseling.

      @@lisalivingston6473 Thank you for your healing support which is a lifelong project. You never forget the balled-up fist. I moved thousands of miles away. The "funny" thing is everyone thinks this guy is great, wrote him up in the newspapers, and don't even know that I was wife No. 1 and what he did behind closed doors. Not growing up with that kind of violence, I tried to figure out for years how I "attracted" it. There is never any excuse for this felonious, life-threatening behavior, most of which still goes unreported. This was a very important interview on this news channel and all 4 interviewers approached the topic very professionally and empathetically. Many blessings to you as well!

      Okay, gotta call some BS on something you said. Claiming the courts are misogynistic is just not supported by facts. If you're talking criminal courts women are routinely handled with kids gloves where a man facing similar charges would be hung out to dry. How many female school teachers molesting children only to get probation or even community service do we need to show that isn't the case. Family/Divorce court is even more favorable to women, and that is such common knowledge I won't bother with examples.
      Yes, it can be rough for a SA victim to testify, and I applaud those with the courage to do so, but that hardly qualifies as labeling the court system misogynist. If anything our court system would probably be mysandrist.

      @@virtualselfie6899 I feel bad when victims of abuse blame themselves for "attracting" it. You did nothing wrong. No man has a right to ball-up his fist and hit his wife. You were right to protect yourself by moving miles away. I hope the distance provided you with a sense of security and safety. I feel bad for women who have children with abusive men and are forced to continue interacting with them for the sake of the children, i.e. visitation, managing child support payments that may come late or not at all, etc. My best friend married an abusive man and had a child when he gave her a black eye. I urged her to leave him, but she felt financially trapped in the marriage because he forced her to pay half the household bills even though he earned twice as much as she did. I encouraged her to hold her ground and only contribute what she felt she could while saving some money for herself in case she decided to leave him. Around that time her mother died and left her some money. I'll never forget the day she asked me to help her and her child move out. We spent 6 hours moving her things into an apartment while he was at work. It was the scariest 6 hours of my life, because I felt certain he would come home early from work and go berserk. She still had to deal with him in managing visitation and child support for their daughter, but she got therapy, and with the help of family and friends she was able to cope and eventually thrive. I wish you peace and happiness as you continue your own journey to healing. Stay strong!

    The attorneys and judge clearly messed up. He should be in prison. However, he DESERVES, like everyone else, a fair trial WHICH HAS NOTHING TO DO WITH POPULARITY or HATRED IN THE MEDIA.

    Important point made by Judd stating that the courtroom being a place of trauma for victims....even for those who have to testify. Police get used to this, but for most people, is too difficult. Reason to continue on this case with other court actions........doubt he will get out of prison......

    His conviction was rightfully over turned due to rule 404 in criminal procedure. “Evidence of a crime, wrong, or other act is not admissible to prove a person's character in order to show that on a particular occasion the person acted in accordance with the character.” EVEN though a BAD DUDE - no one want prior acts to come into their trial. A person must be tried on the charges they are charged with ONLY.

    Years ago I was a bartender in Lexington, KY. One random weekday about 3pm, Naomi Judd came in by herself and met a man in the upstairs bar. She was so beautiful! Tiny, polite, and distressed. Was he her lawyer? Accountant? Tax man? They drank iced tea. I worried about her for 20 years.

    Procedural mistakes, that doesn’t take away the feelings of injustice these women are feeling. I think the point is that institutional misogyny is pervasive and a mindset that’s so set. So many people don’t report abuse because what follows can be as just traumatic, if not more so, than the abuse itself.

    The courts are to blame. Everyone does deserve a fair trial. It should have been done from the beginning, so they do not come back with an excuse to let a guilty man get away with such serious crimes. Much justice and support to the victims. .

    You can’t break the law and stack on just because your want to convict someone. This is a process! A legal process and when that process gets jeopardize you have results like this. Ashley is emotional about it. This is legal! Not emotional!
    And both women they were able to get Harvey on ADMITTED having a consensual relationship with?!! I mean…. Cmon!!!!!!

    Ppl are pi$$ed that Harvey Weinstein is getting a new trial in NY-
    Evidence is a course in law school. Evidence is one of the few law school classes that helps you prepare for both the bar exam and for the actual practice of law.
    It governs fairness in a trial.
    Questions for the outraged re: their thought process:
    1.) Do the ends justify the means in your mind?
    2.) Is it okay for judges/prosecutors/courts to violate evidentiary rules to gain a conviction?
    a. Would you want it done to you, or your family?
    3.) Is it acceptable for attorneys/judges to ignore what they were taught in law school?
    4.) Is it possible to win a case without violating the Rules of Evidence?

    I understand how angry Ashley is and should be. However, the ruling doesn't exonerate Weinstein's guilt, but prosecutors have to follow the law, procedure and protocol. Several criminals are being released based upon overzealous prosecutors over reaching. This happened with the Bill Cosby case and now Weinstein.

    The sad & tragic thing about this is that there will be another trial and he will be found guilty but women will have to step forward and go through this again. So they will be traumatized again. I hope this does not stop survivors to decide to remain silent.

    I want criminals convicted, but I want it done by the rule of law, not b/s convictions... didn't your parents ever teach you to play fairly, to win fairly and not cheat to win, to get a conviction. Someday a rouge justice system will effect you or someone you love... learn to see the big picture, this is NEVER about just one person.
    We don't have a country if the laws do not apply evenly to everyone. I am tired of emotionally disturbed ppl throwing our country into chaos...
