Here is the paper is written by Adv Dumisa Ntsebeza www.anchoredinlaw.net/wp-content/uploads/2019/04/LAND-EQUALITY-AND-DIGNITY-Ntsebeza-SC.pdf. I also foresee a lot of organizations such as Afri-forum challenging the legislation limiting the right contained in section 25 of the Constitution as being unconstitutional. If they support this, why they are fighting left, right and center for not amending the Constitution? The second option, why Adv Ngcukaitobi never tried to interpret the Constitution that way as a siting Acting Judge himself or take a case and go argue like a lawyer? I fully agree though with the institutional crises he mentioned.

Land issue has nothing to do with the settlers. At the heart of it is the colonial master plan. It is a political question not legal. Afrikanners are not even real beneficiaries of the colonial master plan. I disagree with the Advocate with due respect. We need expropriation without compensation to undo the theft of the land by the European colonialism to benefit the European countries.
