In Lowe v. Peers, if Peers would have promised that he will only marry Peers, and if he is unable to do this, then he will pay a sum of $2,000. Then what is the status of this agreement? Is it still void?
He would not give 2000$ to lowe on two grounds first, this amount was not to be given to marry in accordance with contract rather than it is to be given for not to marry any other person other than lowe and second, Court cannot enforce these kind of contracts "specifically" as they require independent choice of parties because of which lowe in this case at maximum claim the actual or tangible loss suffered to her, for instance, she might have given a contract to some contractor to offer arrangements for her marriage which has created an obligation upon her to pay him. She is entitled to recieve this money from peers. Exemplary damages can also be granted if she was a victim of sexual activities in the name of marriage on several grounds like her dignity was hurt, social stigma, mental and physical pain , along with all these things her feelings were also hurt . Laxminarayan vs Sumitra 1995 MP is as case where exemplary damages were granted.
Ma'am, you gave example that lawful restrictions like aperson promises to give money if girl restrict herself from marrying until 18. But it is already there in Indian law, so she cannot marry even if she wants. So how can a restriction be lawful if it is already a law
Mam one think about what i m not clear is how a contract even form when it is already declared as void ab initio as when they make an agreement they must get this contract legally registred under law?
A's father enters into an agreement with B promising him that his daughter A would marry him for 50,000 . A is 19 years old and B is 2 years younger to A. Is the agreement void?
There are two cases. 1. B is a minor if she is getting married at that age or below 18 then it is void. 2. If B will marry at the age of 18 years or after, she has an option to make it voidable.
