I don’t think twitch is right for making streamers meet stupid amounts of streaming hours but I do believe that streamers shouldn’t be allowed to sit in front of a TV and “react” to someone else’s hard work and then make thousands from it

It is interesting to think that Twitch brought it on themselves a wee bit by making contracted streamers hit huge amounts of stream hours as opposed to making the hours more flexible to allow for more unique, shorter content. Streamers with paid deals make up a tiny portion of the overall number of streamers but a higher % of them have opted to do this "react to TV shows" type of thing, probably because it's easy and fills those hours up

Just a small correction, Hasan was never officially copyright striked by Fox for his Masterchef content. Someone Sent in a fake copyright strike which Twitch mistook as a real one. Later when Hasan discovered it was fake, Twitch recinded the strike. Edit: Addressed in the description.
At least twitch tries to, you know, help creators with policy issues properly. UA-cam can’t even provide proper transparent explanations for how their guidelines work or properly roll out copyright issues.
Twitch helps their creators and therefore themselves to not get sued despite having done illegal things. UA-cam is trying to outright ban the content which is illegal, which can be difficult when the case law around copyright is still changing pretty frequently.

(copyright not being the only issue). But that’s not to say those streamers didn’t know they shouldn’t be streaming avatar for 10 hours. 🤣 Thats not a surprise avatar would be a copyright issue.
Several of my favorite UA-cam groups to watch have officially fully moved over to UA-cam and they no longer stream on twitch because of stuff like this.

Couple corrections, though: Twitch/Amazon DO have watch parties for any content in Prime Video (but everyone involved needs a Prime sub). Makes streaming out-of-prime shows more tasteless. Also Hasan's DMCA turned out to be fake, and Toast's was self-inflicted, not related to the show, and only for 2 days.
From what I remembered, as Toast's ban was a hoax. He asked his friend Lily to put a copyright strike in so that he was banned because he played one of her songs. This was for attention and as a warning to other streamers

Let's be real, until twitch actually has fair and consistent rules on what content is ok (ie. not favoring bigger channels with flexibility smaller channels don't get), I don't ever see twitch "growing up".

The reason why Twitch is reluctant to implement this is that livestreaming games is often a gray area. If they implement it for TV, litigious game publishers will immediately start filing suit in the hopes of carving off a big chunk of the revenues.

I am a streamer myself and when I post my vods to youtube, any minecraft stream for example, it IMMEDIATLY gets striked because C418's music is copyrighted. So now, the publishers can take all the money made via advertisements ON A 5 HOUR STREAM OF MINE when the music played in the background for less than 3 MINUTES.
The problem with the "delete your VODs" solution is that Angry Joe got a copyright strike and suspension over copyrighted music in a game he streamed multiple months after the VOD was deleted. This tells us that companies can somehow still issue copyright strikes after the content has been deleted.
Pretty easy to do that when VoD's aren't _actually_ deleted on Twitch's end. Whether it's something you 'deleted' yourself, or Twitch 'deletes' it due to banning you, fact is ALL of those videos still exist on their servers somewhere. (You can even find videos of Dr. Disrespect on there if you dig around long enough.)
A similar thing happened to Sneegsnag. He got a DMCA strike (can't remember if it was a suspension or what but I know he couldn't stream for a bit) for year old VOD's he didn't even have access to.

It’s clear that MatPat and Game Theory itself does not care about doing their due diligence. They’d rather point to the UA-cam algorithm and say they are victim of having to put out high-quantity content; and do not care about quality.
Why are we rooting for copyright law? Fair use is almost a joke, and the UA-cam system of copyright claims is outright broken. Remind me why we want more automated systems that take down videos because someone played a 5 second clip of a song.
Alright there's a difference between using a 5 second clip of a show or movie and using it in a tranformative mannor, and someone just basically allowing their viewers to pirate content, especially if the streamer adds NOTHING to the content.

Twitch definitely has had a lot of problems lately, especially for smaller creators theres been so many bot raids, hate raids, as someone who has streamed its constant stress thinking at any moment whilst you are online or offline you could have one chatter or one piece of music take away everything you have worked for. DMCA is the worst problem of all, I remember when cyberpunk first launched and so many ppl got banned simply because the radio was playing exclusively copyrighted songs. It sucks!

The problem with copyright detection bots is they don't recognize instances of fair use, like parody and commentary. Commentary in particular is hard to recognize because it's all in the context.

I think there’s two sides to this issue on one side you have twitches terrible and inconsistent rules while on the other you have the streamers that exploit these rules. Honestly it is surprising how Twitch hasn’t gotten sued by companies for not enforcing copy right and letting streamers do whatever they want. Only stopping when they are forced to which usually results in bad changes that only effect smaller streamers. Now the big streamers are also to blame as they know they will not be the ones hurt by it. How many times has Poki and Hasan gotten banned for breaking rules and not gotten perma banned? While small streamers have broken one rule and gotten banned for months or permitly? Big streamers also create metas and still aren’t punished as bad while eliminating those who follow their metas.

After recent controversies surrounding Japanese companies Toei and Shopro and their responses to a select few UA-camrs within the past few months, as much as I respect MatPat, I can't exactly disagree with Twitch's desire to not want to police copyrighted material. I myself honestly lean more toward copyright protections and the pursuit of them being outdated in this day and age and needing to change to reflect modern media.

The reason why Twitch is reluctant to implement this is that livestreaming games is often a gray area. If they implement it for TV, litigious game publishers will immediately start filing suit in the hopes of carving off a big chunk of the revenues.

I am a streamer myself and when I post my vods to youtube, any minecraft stream for example, it IMMEDIATLY gets striked because C418's music is copyrighted. So now, the publishers can take all the money made via advertisements ON A 5 HOUR STREAM OF MINE when the music played in the background for less than 3 MINUTES.
The problem with the "delete your VODs" solution is that Angry Joe got a copyright strike and suspension over copyrighted music in a game he streamed multiple months after the VOD was deleted. This tells us that companies can somehow still issue copyright strikes after the content has been deleted.
This means that Twich is just straight up misleading it's content creators. Wow.
Pretty easy to do that when VoD's aren't _actually_ deleted on Twitch's end.
Whether it's something you 'deleted' yourself, or Twitch 'deletes' it due to banning you,
fact is ALL of those videos still exist on their servers somewhere.
(You can even find videos of Dr. Disrespect on there if you dig around long enough.)
A similar thing happened to Sneegsnag. He got a DMCA strike (can't remember if it was a suspension or what but I know he couldn't stream for a bit) for year old VOD's he didn't even have access to.
Or they just scanned the VOD and issued the strike later, or they scraped the VOD immediately and scanned it later. Don't jump to conclusions.

Why are we rooting for copyright law? Fair use is almost a joke, and the UA-cam system of copyright claims is outright broken. Remind me why we want more automated systems that take down videos because someone played a 5 second clip of a song.

Twitch definitely has had a lot of problems lately, especially for smaller creators theres been so many bot raids, hate raids, as someone who has streamed its constant stress thinking at any moment whilst you are online or offline you could have one chatter or one piece of music take away everything you have worked for. DMCA is the worst problem of all, I remember when cyberpunk first launched and so many ppl got banned simply because the radio was playing exclusively copyrighted songs. It sucks!

The problem with copyright detection bots is they don't recognize instances of fair use, like parody and commentary. Commentary in particular is hard to recognize because it's all in the context.
Especially since commentary can generate a ton of interest in something.

I think there’s two sides to this issue on one side you have twitches terrible and inconsistent rules while on the other you have the streamers that exploit these rules.
Honestly it is surprising how Twitch hasn’t gotten sued by companies for not enforcing copy right and letting streamers do whatever they want. Only stopping when they are forced to which usually results in bad changes that only effect smaller streamers.
Now the big streamers are also to blame as they know they will not be the ones hurt by it. How many times has Poki and Hasan gotten banned for breaking rules and not gotten perma banned? While small streamers have broken one rule and gotten banned for months or permitly? Big streamers also create metas and still aren’t punished as bad while eliminating those who follow their metas.
Yeah I remember that guy that raided pokimane was supposed to be suspended then she used her power over twitch to get him banned. Yet she's done so many dumb things yet hasn't been banned 🙄

After recent controversies surrounding Japanese companies Toei and Shopro and their responses to a select few UA-camrs within the past few months, as much as I respect MatPat, I can't exactly disagree with Twitch's desire to not want to police copyrighted material. I myself honestly lean more toward copyright protections and the pursuit of them being outdated in this day and age and needing to change to reflect modern media.
Until you realize twich streamers are entitled babys who copystrike youtubers because their videos arent "transformative" enough when those same streamers watch without saying a single word for 8 hours copyrited material.
Instead of trying to evade the law, why not change it? Pushing for a copyright law reform is one of the main internet affair congress has to attend.
