I was really on the fence about this one, I REALLY didn’t want to come across like I was shaming or telling others how to do business, I think I said that enough times lol 🤔 but yes, after seeing more and more horror stories about other freshie makers dealing with the consequences of this I didn’t want to see those who really didn’t know be punished for it.
I’m glad you shared this info. I am an artist and this is what we learned first. Nowadays they are teaching it in school not to use other people’s work or materials or copy and paste someone’s wording in their essay. Some people just don’t care and don’t think they will get caught. But I’m glad you made people aware, whether they abide by it or not, that’s on them

You’re welcome!! I’ve slowly learned about the less obvious ones over time. It scares me a bit because I’m sure there are ones I’m not even aware of yet. Song lyrics and titles are the trickiest for me. If I haven’t heard the song yet then sometimes I just think it’s a catchy little phrase 😬
i worked for an Entertainment Company that was SUED for doing a purple dinosaur accused of stealing Barney - they were sued for $100k for a small CHEEK ART - after that no one was allowed to do a purple dinosaur even though it was NOT Barney - she didn't want ANY reason again. also as an airbrush T-shirt Artist - i ran my friend's shop in Downtown Dallas & he told me that a man came in and ordered a Mickey Mouse.... days later he got a letter from an eternity to pay $2500 or they'd pursue it more. he PAID and NO MORE Mickeys!

I'm seeing a bunch of people selling bundles of DTF's and sublimation designs with Disney characters and it's the same thing. Why would I buy them from Etsy or any other company if I can only use them for personal use. I mean I would use them for my two grandbabies, but I can get them on Google for free.

I have a small business, was just THINKING about adding freshies to our shop... My small business has caused a lot of issues...my marriage, my kids, etc. Friends🙄buh bye...everybidy wants something for free...and some of what we do is very costly...exception: I'll make anything for my kids and grandkids, but it's prolly thousands a year in free stuff...they don't understand. Also, friends will be like well what if I bought the shirt, or what if I brought you my own tumbler...I'm like dude, my time isn't free, my utilities aren't free, neither is my equipment, don't even get me started on supplies..geesh...no one understands that I'm trying to contribute to my household, and save for retirement...one of my daughters started her own small business...she's starting to understand (I asked for a free avocado pen, one of her gifts she ads to orders, and she bit my head off)...on the subject of copyright infringement...back a few yrs, when I was new I couldn't understand how people who made only a couple sales, were getting cease and desist letters...a lot of times it's bitter women in the groups that tattle, there is a lot of negativity and cliques in those groups so I wouldn't even join when brand new to crafting..it can make someone quit, I like UA-cam cuz people can't talk back...I don't read my responses all the time, I actually had a person on TikTok tell me they hoped my special needs son, 6 I think at the time, died...it's just so nasty out there...so there's that ..and Disney is HORRIBLE ...I only make Disney for myself now or my grandbabies, or as a gift. It's crazy out here...and those huge conglomerates will squash, ANNIHILATE, a small business. They don't care. Your video is very informative for the newbie and long term shop....more of the senior sellers should want to help those just coming up, the market for handmade items is pretty large, but there's just so much cattiness... Some people will just always be bitter. Anyways, new follower.🙋♀️
The only thing that protects you when it comes to this is permission directly from said brand or company. A crafter’s license wouldn’t cover all of this. I think those are issued through individual universities and would only cover the university that issued it….I could be mistaken about that but I think that is how those work. I’m sure you could Google it for a better, more accurate explanation 😊
I feel like it is hazardous to your health, when I watched all these videos and all people make Freshies, I was like that’s chemicals that are going into the air that you’re inhaling. You don’t know what’s in these oils, you don’t know what happens. If you heat up these oils, you don’t know what are in these beads, you don’t know what happens if you heat up these beads. Please be careful.
I’ve seen people say it doesn’t and Etsy giving warnings for listings written that way. In the scent description it would probably be ok to add “smells similar to (blank)” or “if you like (blank)” or “for fans of (blank)” I’m not 100% positive on that though 😬 sorry I wish I had a more concrete answer for you on this one. I would definitely leave any brand names out of the title of the fragrance though.
More than like if they aren’t listed as type they are ok but then you are trusting that LS or any other fragrance company is listing them properly. You can google if a scent name is trademarked. It will tell you by who and for what type of products so for instance if a candle company has a scent named “believe” trademarked it will specify if it’s for all scented products or just for candles, if it’s just for candles then you can use it for freshies as long as there are not other trademarks on it for car freshener type products. A liquor company could have a trademark for a flavor named “pumpkin delight” and a candle company could have the same name trademarked for a scent but sometimes brands, specifically designer, could trademark it against use in any other product no matter what. So since little trees is a car freshener product the oil companies may be ok with selling the oil under the name “black ice” but once it’s made into a car freshener product it now violates copyright/trademark laws.
While you are correct on something’s, you need to be clearer. You can buy all the Disney fabrics you want, make scrunches, potholders, anything….as long as your doing it for yourself and on items you are not selling. Also, you need to more about the law than you do! You can easily protect yourself & your assets by putting all of you bank accounts & property in a trust. Everyone should do this whether they craft or not. I also don’t give out any information! I don’t even have business cards. I limit anything I have that may even be thought of as an infringement. I don’t even try to do the “Disney inspired” theme. Changing the colors of the sprinkles and the icing around on the Little Debbie’s cake isn’t enough to be considered “your” original artwork. I’ve worked with the Veterans of Foreign Wars on their logo and posts that were in violation.

Like they don't make enough money already. Their prices are over rated when it doesn't cost that much in the first place to make. I would never buy a designer anything. Product not worth it. It's a rip off. You can change one thing about someone's copy write and it's yours. That's 10 % . it's like theirs but not like it's theirs.
Please educate yourself on copyright. It has NOTHING to do with money. How would you like it if you created something and everyone in the world was using your design, making money off of of your creation? Or getting credit for something you did? It’s not right. Give credit where credit is due.

I have noticed so many freshie makers that are doing Yellowstone and Wallen. I had customers ask me to do them and I say no 😖 Definitely not worth it!
I’ve done both of those in the past but after hearing so many stories of other makers getting into trouble I definitely took a step back and said “yeah…let’s not” lol

Do you rename the fragrances?
Only the ones that are connected to a brand, so black ice can be renamed to midnight ice or black frost.
