My friend got a DUI in TN a few months ago. He drives a semi truck so he has a CDL and he lost alot of money. His bloodwork came back months later super clean. Somebody should investigate

Because the test do not come back instantaneous. Some even go to court before or right as they are made available. The story did not present that fact. They did not present data on the pattern of results of that led to the arrest and collection of blood sample. I live in Texas, and I had this happen to me. I spent 3 days in jail waiting to get bond. I had to pay a lawyer 10k. It took 2 years for my bloodwork to finally come back to prove my innocence. The officer who arrested me was at the trial, and he still insisted I was guilty. I don't know what I would have done if I could not afford my lawyer
The game is to make you plead guilty, maybe for a lesser charge, pay a fine, and get their conviction records up. You didn’t play by their rules: you challenged them and you are depriving them of what they think is their revenue. Th problem is that for two years at least, the DUI arrest is going to show up on countless commercial databases. Moreover, many of them will not delete their records after your acquittal. You have to hire someone to go after these companies to clean up their databases. I did this recently for a friend: the DA kept on moving the court date the day before the trial, making it more and more expensive. And the DA would offer a plea deal.

Well in the video they are showing that over 100k blood tests where submitted between 2017 and 2023 and of those just over 600 came back negative thats less than one 1%. I would call that limited still sucks tho

Request a blood test,lawyer and then sue for false arrest. As a cdl holder, I was told to refuse any field sobriety test and require a blood test be taken immediately.
I hold a CDL as well and worry about things like this. It would affect us in so many ways just being arrested for it. Even after being dismissed the damage will be done.

My nephew was falsely arrested for DUI. He was held in jail over the weekend, denied access to his medical devices and daily medications. He lost his job because of the arrest, and lost money for his car impound and court fees. He, his wife and two young children were evicted from their apartment. So many people are just scrapping by, and then you have to deal with something like this! This can ruin a family and there is no restitution!

Can't speak to your nephew but most people that face those consequences of an arrest like this are habitually making poor choices. They are skipping work, spending money on recreational drugs, alcohol and tobacco. Spending time doing recreational things when their personal business needs attention. You get the picture. It took a couple of my kids many years as adults to figure out that their poor planning was not an emergency for anyone else. To a degree, I think we all have to learn that lesson as adults. Remember: You do not have to submit to a roadside sobriety test. Make them take you in and give you a breathalyzer. Roadside sobriety tests are up to the discretion of the cop. Breathalyzers actually go on the record.

How often do you make errors at your work? In 2023 for example the number equates to 1 in 341 cases being wrong. This doesn't include the idea that some of them may also have be close to the limit but not exceeding it. Yes it's terrible, and there should be things like breathalizers but if it's really 1 in 341 it means the officers aren't randomly picking people, they must be using the driving of the person to assess the situation. The issue becomes it's difficult to determine sometimes distracted driving from DUI especially if the person denies using their phone. Roadside sobriety checks are difficult but still if it's 0.5% error rate that's overall pretty good, especially given a blood test is used to determine the case afterwards. What should happen though is that formal charges shouldn't apply until after they confirm though.

A 400% rise statistically is not limited. Imagine someone trying to hammer DUIs NOT downplaying an issue their cause might be affecting. It doesn't happen. MADD is mothers against drunk driving, a couple hundred get screwed by their policies, "Eh, not really a problem, just a little overblown." The proposal of creating a public database doesn't answer the scope of the issue at all. When someone is arrested for a crime, that goes in the national database maintained by the FBI. Once it does, the state and local courts no longer even have control of it. Even if they acknowledge the innocence, false arrest, and order expungement, federal agencies are under no obligation to abide by state and local orders. So the very fact that they were arrested for this can show up on any background check for a job or for leasing a home, etc., from then on.

Funny part is I had a neighbor who was a massive drinker early twenties and he got pulled over one night did the sobriety test and passed them and never had to blow a breathalyzer and he had drank in at least six or seven drinks and was drunk. So being drunk can sometimes get you out
That list of 609 people needs to be released to the public or at least to the folks who were wrongfully charged! Don’t get me wrong, I support law enforcement as much as I possibly can but there are situations where law enforcement is wrong. My son was wrongfully charged with a DUI and hadn’t drank a single drop of anything! I honestly believe that the ones who were wrongfully charged and had to pay fines and more costs to get their drivers license back, should be refunded the money they paid and the charge removed from their records.

On a positive not it seems to go down 2023 had only 1/3 of false DUI arrest compared to 2017. 0.03% . I think it can be better but is it reasonable to expect zero? For example when you didn't sleep you have similar symptoms.
You know what i wanna know. How many of those 600 sober drivers took a plea deal or were actually convicted. Prosecutors hate dropping cases and they will gladly officer an innocent person a plea deal because it makes the prosecutor look tough.
My wife was one of the ones who took a plea deal. At the time of her arrest she was 19 and in college at MTSU. She worked at a bar and was on her way home after closing when stopped. They asked the standard questions and as soon as she said she worked at a bar and was coming home from closing they started a DUI investigation. She ended up taking a plea for implied consent that went away after she completed a class and paid a fine and stayed out of trouble for so many years because she was a broke college kid who couldn't afford a lawyer or the fees associated with a DUI while also losing her ABC license and job as a bartender. We sent WSMV the body cam video of her arrest from all those years ago. Anyone can tell my wife was stone cold sober. The only thing that was off a little was having a 110lb girl out in the rain and cold weather in a dress and dress shoes doing a sobriety test and her shivering.

What I do know is my wife is not a heavy drinker and certainly not the type of person who drinks and drives. A friend of mine is suing the Maryville TN police because they said she was drunk. She has MS. They just said she looks drunk and didn’t run any tests, she went straight to booking. So it’s 100% their word against hers in court

Because the test do not come back instantaneous. Some even go to court before or right as they are made available. By then you are already mug shot… which is plastered in a News paper( here in my state by law) and your life pretty much ruined!
And simply because the test are negative that is no assurance of aquital. You can still be found guilty because the state accepts the LE’s “ professional expertise “ as evidence that’s just as strong as the test!

The story did not present that fact. They did not present data on the pattern of results of that led to the arrest and collection of blood sample. They did not consider anything but the fear mongering side of things.

I live in Texas, and I had this happen to me. I spent 3 days in jail waiting to get bond. I had to pay a lawyer 10k. It took 2 years for my bloodwork to finally come back to prove my innocence. The officer who arrested me was at the trial, and he still insisted I was guilty. I don't know what I would have done if I could not afford my lawyer

You didn’t play by their rules: you challenged them and you are depriving them of what they think is their revenue.
Th problem is that for two years at least, the DUI arrest is going to show up on countless commercial databases. Moreover, many of them will not delete their records after your acquittal.
You have to hire someone to go after these companies to clean up their databases.
I did this recently for a friend: the DA kept on moving the court date the day before the trial, making it more and more expensive. And the DA would offer a plea deal.

Well in the video they are showing that over 100k blood tests where submitted between 2017 and 2023 and of those just over 600 came back negative thats less than one 1%. I would call that limited still sucks tho

I am no lawyer but this is also what I heard.

My nephew was falsely arrested for DUI. He was held in jail over the weekend, denied access to his medical devices and daily medications. He lost his job because of the arrest, and lost money for his car impound and court fees. He, his wife and two young children were evicted from their apartment. So many people are just scrapping by, and then you have to deal with something like this! This can ruin a family and there is no restitution!

Can't speak to your nephew but most people that face those consequences of an arrest like this are habitually making poor choices. They are skipping work, spending money on recreational drugs, alcohol and tobacco. Spending time doing recreational things when their personal business needs attention. You get the picture.

This sounds like communism. However, when the judge sees zero the judge has to dismiss the ticket. Meanwhile they probably impound the car take the person in for testing and that persons name is in a data base showing zero. This makes absolutely no sense and their is no probable cause. Remember: You do not have to submit to a roadside sobriety test. Make them take you in and give you a breathalyzer. Roadside sobriety tests are up to the discretion of the cop. Breathalyzers actually go on the record.

I posted his quotes because people were upset over the 600 false DUI arrests, saying the police need to be prosecuted, or held accountable. And I'm saying you can't have it both ways.
He won Tennessee, which means the majority of his cult voted for him there. And they expect police to be held responsible for these false arrests. It will never happen. There will not be a police officer prosecuted for anything over the next four years, no matter what they do. And this is what you all voted for, so you can't complain now.
This is why we should never be quick to judge someone who has merely been charged and not convicted.

How often do you make errors at your work? In 2023 for example the number equates to 1 in 341 cases being wrong. This doesn't include the idea that some of them may also have be close to the limit but not exceeding it. Yes it's terrible, and there should be things like breathalizers but if it's really 1 in 341 it means the officers aren't randomly picking people, they must be using the driving of the person to assess the situation. The issue becomes it's difficult to determine sometimes distracted driving from DUI especially if the person denies using their phone. Roadside sobriety checks are difficult but still if it's 0.5% error rate that's overall pretty good, especially given a blood test is used to determine the case afterwards.
What should happen though is that formal charges shouldn't apply until after they confirm though.

It is when you consider it’s 609 out of 102,290 arrests. That’s half of one percent. Those 690 people should be entitled to recompense but it is in fact limited, statistically.
@@dmanatan Have you tried comparing that to other areas of wrongful arrests? Cause it jumps up to about 300-400% when compared to other areas with the same issue. A 400% rise statistically is not limited. Imagine someone trying to hammer DUIs NOT downplaying an issue their cause might be affecting. It doesn't happen. MADD is mothers against drunk driving, a couple hundred get screwed by their policies, "Eh, not really a problem, just a little overblown." Kinda funny they'd bring someone on who's against the people and doesn't care if they get caught up, for the greater good, but it's also kinda like jerry springer. These spikes are isolated incidents, usually to particular departments.

@@dmanatan There is zero justification for arressting a sober person for DUI. They can test their BAC in the field and show it is zero. Half a percent is an insanely high number for false arrests for a crime that is so easy to determine in the field.

The proposal of creating a public database doesn't answer the scope of the issue at all. When someone is arrested for a crime, that goes in the national database maintained by the FBI. Once it does, the state and local courts no longer even have control of it. Even if they acknowledge the innocence, false arrest, and order expungement, federal agencies are under no obligation to abide by state and local orders. So the very fact that they were arrested for this can show up on any background check for a job or for leasing a home, etc., from then on.

Funny part is I had a neighbor who was a massive drinker early twenties and he got pulled over one night did the sobriety test and passed them and never had to blow a breathalyzer and he had drank in at least six or seven drinks and was drunk. So being drunk can sometimes get you out

That list of 609 people needs to be released to the public or at least to the folks who were wrongfully charged! Don’t get me wrong, I support law enforcement as much as I possibly can but there are situations where law enforcement is wrong. My son was wrongfully charged with a DUI and hadn’t drank a single drop of anything! I honestly believe that the ones who were wrongfully charged and had to pay fines and more costs to get their drivers license back, should be refunded the money they paid and the charge removed from their records.
These people need to sue the officers directly for bearing false witness against them.

This is probably to some extent a problem of corrupt departments as well as bad judges and bad laws. Good law practice and custom would require restitution be made to victims of such law enforcement malice and malpractice. These jackbooted thugs are criminals.
On a positive not it seems to go down 2023 had only 1/3 of false DUI arrest compared to 2017. 0.03% . I think it can be better but is it reasonable to expect zero? For example when you didn't sleep you have similar symptoms.
You know what i wanna know. How many of those 600 sober drivers took a plea deal or were actually convicted. Prosecutors hate dropping cases and they will gladly officer an innocent person a plea deal because it makes the prosecutor look tough.
I believe these were the people that weren't charged. There's probably more who did the plea deal.

My wife was one of the ones who took a plea deal. At the time of her arrest she was 19 and in college at MTSU. She worked at a bar and was on her way home after closing when stopped. They asked the standard questions and as soon as she said she worked at a bar and was coming home from closing they started a DUI investigation. She ended up taking a plea for implied consent that went away after she completed a class and paid a fine and stayed out of trouble for so many years because she was a broke college kid who couldn't afford a lawyer or the fees associated with a DUI while also losing her ABC license and job as a bartender. We sent WSMV the body cam video of her arrest from all those years ago. Anyone can tell my wife was stone cold sober. The only thing that was off a little was having a 110lb girl out in the rain and cold weather in a dress and dress shoes doing a sobriety test and her shivering.

What I do know is my wife is not a heavy drinker and certainly not the type of person who drinks and drives. Just last month we went out for a Halloween costume contest and because we both had a drink with friends took an Uber home even though we was both far from drunk.

A friend of mine is suing the Maryville TN police because they said she was drunk. She has MS. They just said she looks drunk and didn’t run any tests, she went straight to booking. So it’s 100% their word against hers in court

Who were the arresting officers? I would not be surprised to find it's the same people, over and over. As is, every individual charged would be within their rights to sue the TBI for violating their rights.
