*Matter of days, I took 3 days to build it, 2 of which were mostly tutorials and 1 of which was mostly cursing over not being able to get my models to tilt down, ahahah.
Also I was really confused for a bit watching the gameplay thinking "Huh, that looks a lot worse than it should" before realising that this is actually the build I uploaded public and not the recode I made for my own personal use. Big old RIP, I should update that download link with my smoother animations version!

After I watched Jao literally go insane in Discord and have his staff act childish and bully/ban members and provoke them, I realised he really was as bad as people claimed and there was something highly unstable about him. He accused us all of conspiring against him, even those who've supported him despite the shit-storm he's created. I took down my server, if I could take my KS money back I would. The attack on Anth was the last nail in the coffin for DoD, or is it.
I commend you for sticking with it, I went with the first wave three days before the Kickstarter closed. Didn’t pull my money, which I sorely regret, but I’ll certainly yell about how stupid this all is from the rooftops
Meanwhile, a similar-looking game (with actual custom content to show for it) gets minimum attention. I kind of wonder if they just had the worst timing, and now suffer from DoD's flop... Anyway please look up "Draconia" on Indiegogo. Custom self-funded dragon models, proper budget breakdown, NO money-grabbing exclusive content. I'd really prefer for these guys to succeed instead.

I dont play the game a buddy of kine does, but if Ai can attack it already has more complex Ai system than another similar game The Isle and that has been our 4 years now.

i have to completely agree. even the discord they use for official announcements has been 90% bad mouthing and trash talk against IGP/ICCaress/SidAlpha; let me explain, a discord used for the sole purpose of informing your client base of game addistions, progressions, and general news, has been limited to nothing but negative heresay and trash talk. I tried to give them the benefit of the doubt and wait and see; as i have, it has sunk to less than 25ppl per day (TOTAL PEOPLE ACROSS ALL SERVERS), and is now excessively taboo to discuss the things you mentioned initially started the ban happy trend by jao. If anyone doesnt believe the accuracy of the above statement, i strongly suggest you go to their discord ONLY to read the updates and announcements. I share all of your videos with a dragon-centric Facebook group. They had all been looking forward to this game but we're getting concerned. After I shared this, IGP, IceCaress, and Anthomnia's videos... They no longer have any interest. Jao's behavior has lost him over 10,000 potential customers.

Sometimes it is the small details like this that add up to meaningful differences, so I do believe this was worth pointing out. Proper tone was used.
As a programmer working on a game myself, and someone who has managed successful and unsuccessful projects, this game will never see completion unless Jao steps away and pays someone to take over the project entirely.
Years ago, this exact song and dance happened before. Some different vaporware dragon game that was designed around the concept of playing a human to build a castle, a dragon to build your treasure hoard, or a spider to build your nest/swarm. Same type of defenders here, backers who were desperate to see it finished, a developer who did barely anything and kept lying about it, and then the whole thing quietly disappeared in a puff of logic after making a shit ton of money.
This entire situation is just insane, from the developer to the rabid fanboys hanging off Jao's proverbial teet. Hell one of them even went so far as to threaten Anthomnia's dog. The more i hear about this the more i am glad that I didn't kickstart this dumpster fire in the first place.
It really saddens me to see devs like this. He'd get so much support if he acknowledged he was still figuring out how to code and was open to critique on the game. Most people would understand- being a game dev isn't something you just pick up overnight. Silencing critique only hurts the game and community. There is nothing to be gained from it. Not to mention the DMCA abuse.
TechRaptor site founder here. The server changes should have had zero impact on Mellow. We’d been on the new infrastructure for almost 4 months when he tried to log in for this article, and ran into issues I tried helping him resolve. No other staff has had this problem, and because I was incredibly busy with my day job, offered him a Google Doc and that we could input and publish the article while we figured that out. I had people emailing me for weeks about this interview (didn’t even know he was doing it) before he even tried logging in, so this is frustrating to see/hear. Especially since I was personally able to log in with his account with zero issue.
I've actually been using these videos as a guide of what not to do when I'm able to begin developing my game. Love your videos and hope I don't end up on your channel in the future! lol
I once asked a question in the dod discord and got a warning for “trying to start rumors” I left that server after saying “f*** you all..” I know, not smart but hey, I’m still young so I make stupid discussions.

I'm slowly transitioning from disliking but respecting Jao's desire to see Day of Dragon's succeed to actively despising him. I wouldn't call for him to take a "short drop and sudden stop" yet, but he's definitely trending in that direction. Speaking of Jao, how goes your setting up the lawsuit, Sid?
Without being savvy on law, my hunch is odds are Sid's keeping his cards close to his chest, lawsuit wise. So, I'd throw a comparison to Jim Sterling's lawsuit and say that it'd more realistically be kept "cold", unless a viable case is there. And unlike Jim, odds are Sid Alpha will not have as much mercy when it comes to pursuing charges. That said, if he DOES do a Lawsuit, it'd likely be probably kept hidden? Until the case is closed, then he'd make a video. But until then, it'd be a statement made, and less video's in the short term, for however long a lawsuit lasts.

What's got me upset right now is how almost all of the recent dev updates are him showing off concept art for a ton of DLC dragons. We don't even have actual models for the dragons already in the game that aren't store assets and he's already trying to peddle DLC. It looks like he's going to make it where you can't actually have fun unless you buy these DLC dragons. NOTE: I got the game as a random gift from someone I play The Isle with. I did not actually give money to this developer nor did I intend to.
@@Caffeine_K9 Yeah, a friend of mine played it and bought it for me randomly. I didn't know anything at the time of install and looking into the game so the window for a refund closed before I realized how horrible the dev was.

I'm truly sad about this game. Such an amazing premise, and yet the creator seems fit to drag it into the dirt, and through several layers of concrete it seems. Hopefully a decent studio can make something similar in future, without the crappy attitude.
I think it’s less he turned them and that he attracted this sort crowd, kind of like how YandereDev did. I’d imagine some of it has to do with portraying himself and a near one man team working on a passion project, alongside attracting the furry crowd and those who just want dragon based games that aren’t Spyro.

To be fair I'd say dragons more have claws than paws. But yea, so far no one's really made a dragon game that's really good. Closest thing I think was Drakengard, but that's an older game.
He doesn't seem to be able to separate his "comapany" does he even have one registered anyway? his project and himself as a person. He shouldn't handle this as a personal matter but as a business. Companies avoid to this kind of crap for a reason. Being agressive towards the public is the worst company strategy ever to deal with criticisms. No real company does that, I've only seen this behaviour from people who started a business and got overwhelmed by it.
I believe, when the Kickstarter launched, no, he did not have a company, or something to that affect. I remember on another video that he actually lost a good portion of the Kickstarter funds, like 10 or 20 percent of them, to personal taxes!
20:19 - If what he said was short drop rather than long drop, than that definitely means hanging. No room for any other interpretation there, it definitely does not mean "sit down and shut up". Not that it really changes the important points of the story in any way. A server manager being an asshole doesn't make Jao look any better.

Well... Technically Sid's channel is more about promoting awareness and covering important topic's within the Video Games Industry (at least that's how i've seen it the last few years), it's just that "The Dirty Dev's List" has become more of his bread n' butter of late. Plus it's *very* entertaining watching the pitiful justifications of dev's who simply want to release a "cash grab". He does such a good thorough job with research on topics, professional manner within his videos and the level of critique itself that he's got recognition from dev's, Valve, Epic and a ton of other people within the industry... Hell i wouldn't be surprised if UA-cam actually recognized him by name whenever he brings an issue up XD.
AC: Origins is how you make a phenomenal desert landscape, not whatever Jao made (or didn't make). Such a shame too, this could have been such a great project if it weren't for the developer's greed and unethical behaviour.
I remember there's a flash game that I played when I was little, I think it was called "How to Raise a Dragon" or something similar, that was pretty good. Check it out if you can, I remember it being fun. It's not MUCH of a game (it IS a 2000s flash game), but hell, it's better than Day of Dragons and has multiple endings and options available for the player.
I’d honestly love to see Icy work on Dawn o’ Dragon more, it’s actually a cool project. Meanwhile Day of Dragons barely functions and is nothing more than a 3D chatroom.

I actually think that Jao has started out with an idea he was passionate about wich is a game about living the life of a dragon but quickly found out that he doesnt have the skills to create a good game in any way or form and then just bought a few assets and put them together, but now he is also too childish to admit that and makes dumb decisions that will ultimately lead to his end
All games use assets bought from 3rd party creators. Who cares if he outsourced all assets and even programming? He has the mandate from his donators to produce a product. Doesnt matter how he uses those resources to accomplish it.

Ah, i remember that in the comment section of the first(or one of the first ones) video Anth made about DoD, one answer for one of the comments said something like that this thing(i refuse to call this a game, it doesn't deserve that title) was problably a scam, people begun an argument over that, obviously no one would like something like that to happen. @@chrisward4410 Not that simple. Not only does he have to prove the statements were false, he has to prove they were intentionally false and made for the purposes of damaging him on purpose. He also has to show damages, in order to be awarded anything more than the single dollar that people are entitled to as a matter of law.

I haven't kept up with this game at all, I saw one game play video from it along time ago and this popped up reminding me of it. I'm sad it's all going down this way, I actually thought the game would be really fun if it was made correctly but it doesn't seem like it is or ever will be. RIP dragon game that will never be.
Which is against Steam TOS. How hasn't DoD been kicked off the platform yet? Especially as the "dev" outright denies these hardcoded bans (which have been proven with hard evidence to exist).
If you hard coded banned as well. Open up the game files and see If your steam ID is in the game. That is then another Hard code ban. That's a third validation of Steam TOS
its not realy hard to do. all you need is the engine and assets. then put them together with the help of manuals that you can find everywhere on the internet and you can make a bare bones game in less than a month.
Honestly i learned more about others things game related, which is awesome. But this three part series is interesting and this guy might permanently effect indie crowdfunding for games years to come, for the negative aspects..

@creapsmantic Check SidAlpha's Dirty Devs series on Day of Dragons/Jao, or the Day of Scams website which has most of the information surrounding Jao. This is a different dev altogether and is not Digital Homicide (although Jim Sterling has recently made a new video about Digital Homicide reappearing).
Not condoning what Jao is doing, has done, or will do, because god damn is he terrible - I have never played this game, and now never intend to - but anyone who has seen the first Pirates of the Carribean movie can tell you that "short drop and sudden stop" refers to execution/death by hanging. Even outside of that movie, I have NEVER heard it used for "sit down and shut up". When I first heard the news of that remark, and his defense of it, I was just... cringing so hard. Thank you for exposing more on this Jao guy, though, Sid. I've been following this story since IGP and IcyCaress got hard-coded out of the game.
NR is from a different country I'm pretty sure, terms and phrases tend to mean different things depending on nationalities. I thought he meant sit down and shut up when I saw it as well, never thought of it in relation to a Pirate movie.

Yes, the world is bigger than the US, but all my searching does not find alternate meanings for both "short drop and sudden stop" as well as "quick drop and sudden stop", the latter of which being the only alternate version of the phrase I could find, which also denoted that it could mean a fall from a high place. I would be happy to see a source that says it means "sit down and shut up" or anything else aside from references to death, if you would be so kind as to provide such a thing for me.
This is a very tricky one indeed. Especially since the meaning of "Sit down and shut up" is actually rather new (honestly couldn't find it on the internet either however upon asking a small group of friends I have around the world I found about 1 in 5 had heard it to mean this, sadly not enough data to know if it is a cultural thing or so new it goes beyond that). The reason we didn't know it ever meant that is because we are all much more use to it meaning "To be hung by the neck until dead", WHICH is the "proper" meaning for that saying. HOWEVER... language is fluid, ever changing, and one thing I have noticed is the same goes for sayings. I have said a thing or two thinking it meant something that those around me didn't. This does lead to one more thing to think about though. No matter what the saying means, if you say it to yourself and it in any way sounds like a threat, then don't say it.
@@hansvonheileger5791 The dude was getting harassed. At the end of the day, all he wanted was for the harassment to stop and they expressed that using that phrase. In the context it was used, I personally interpreted it as "leave me alone". As you said, language is fluid. I don't see why this is a big deal, people seem to be focusing on this and ignoring that the guy was getting harassed by a fan base and by a team of developers. Which is much WORSE than a slip of the tongue. Jao has certainly heard much much worse from disgruntled backers.

I personally do not see any issue with using store assets, to speed up your overall concept. If he did use that 500k to hire a few developers and artists, he might be able to make leaps with his game within a few months. Though it seems he didn't use it for that.. shit with 10k I could easily drop my own game much more developed this. SO I doubt he will pull a no man's sky.. I feel he will try to forever alpha/beta/EA and keep trying to get more money from this Idea of the game.. and at the same time.. his entire idea for the game isn't even well thought out in my opinion .
Thanks for all this info! I never backed this game, but I really hoped it would live up to its potential. If I had a proper computer, I would've absolutely bought Day of Dragons upon the game's completion. Dragon games like this are very rare from my understanding, and it's so sad to see this project fall so hard due to an incompetent, abusive developer. It really did have potential, imo. At least we have the Spyro games, I guess...?

I think one of the main reasons Jao doesn't have a copyright leg to stand on when it comes to taking down footage of his "game" is that he just plain doesn't own the copyright to the unmodified assets his program is made of. Although your video may not meet the "amount of material used" consideration for fair use with b-roll covering almost the whole video, your video is still transformative with respect to Jao's program. Jao's program, however is *NOT* transormative with respect to the assets he bought and plugged in, giving him no right whatsoever to even attempt to enforce his *SPECIFICALLY NON-EXCLUSIVE* copyright license. Is that the right amount of words to make the point I made? It feels like I used waaay too many words. -edit LOL, I didn't even realize that the footage from this particular video was from Dawn 'o Dragons.
I'd argue that the amount of footage Sid used was necessary to drive home just how empty and pointless the game is. Was it a lot of footage? Sure. But it matches how vast, yet empty the landscape is. And that's assuming gameplay footage itself isn't inherently Fair Use. Gameplay is transformative by nature, since you're not just displaying game assets, but also your unique playthrough.
@@Greywander87 Where the line is on that is about as unclear as it can be. I can tell you this, its not "lets plays = fair use". Nintendo's content ID claiming held up legally, as did their "creators program", as have their content claims on gameplay since the creators program shut down. I think the real thing here is that no one has challenged it in court in a trial. What few lawsuits have been made public have self-destructed before trial. It will eventually be part of case law, not actual legal code. I think you have two extremes here. You have games like minecraft or mario maker where your personal gameplay is the only reason people are watching and you have no-commentary lets plays of games like outlast or resident evil 7 where people are only watching it for the story and your gameplay is utterly irrelevant. I think one is clearly fair use and one is clearly not. Anyway, it doesn't matter because for these asset dogpiles, I literally don't think their game is transformative with respect to the assets they put into their particular dogpile. One thing people might not understand is that when people license an asset like the dragon in day of dragons, its not just a graphical asset. Its basically an entire playable character with models and animations and code controlling it and the licensee does nothing except stick it in an environment asset pack which also had models and terrain generation and collision boxes and code for interaction with entities. I would bet that Jao has written less than 500 lines of code, most of which were copy-pasted from tutorials and forums. I've written throw-away projects just to test an idea that were several thousand lines of code.
I always marvel at those with the levels of self delusion to proclaim that they can take (or usually that they ‘welcome’) criticism while also railing against negative reviews under the grounds they are somehow ‘unfair’.

HAHAHA I really enjoy this series and everything that you cover. I myself originally backed this game and don't want to see that wasted however, it is so backwards of what I hoped for that I have already just written it off as a bad choice and moved on. Right now I am just really excited to see this Man Baby get everything he has coming to him. I hope this lawsuit of yours happens, I hope that any further projects he's in causes future customers and project leads to lift their noses, and that he gets a giant fucking wake up call on how to be a damn adult. Just to say thank you for taking the time to do this the info is helpful when contemplating buying the game. They have no customer service and im finding very little to encouraging to buy the game due to the discords actions and the makers actions.
@Destructive_Goddess I spent a month watching the discord as I dont just dive in and buy a game, I do checks on customer service, development, and structure and the things I saw made me shudder they broke most of Discords TOS and at one point i did photo Jaos comment as he had what I would call a meltdown in chat. I tried to ask questions in the chats and was told to not talk about certain things and had to walk on eggshells in fear of being banned, I asked on thier youtuber site for a timeline on when the "place" holders would go and got told when its done it will be done. very curt and no customer service what so ever. I feel so sorry for all those caught up in this mess. Theres no way that i would invest in this mess right now.
So I have to question what do all his hardcore defenders get out of this? Anyone who has ever played a game before can tell that the game as released is unplayable as anything other than a tech demo, so it's not like they're defending a maligned developer who is otherwise producing a semi-decent game. I can't understand what kind of reward would make any of this worthwhile to them.
The only reasonable thing I can think of is rather simple....they are backers of the game who flat out don't want to admit they have been scammed. It's not a good feeling for anyone who has been taken advantage of in this way. All the other defenders in the comments, are likely Jao himself, because we know he doesn't spend any actual time working on the game.
As a backer I was originally scared when the first video was published, but after the raids stopped and progress was being made in the game everything calmed down enough to get back on track. Personally I still have a very small fraction of doubt for the game, but a plethora of evidence and content has proven otherwise. I don't feel that I was being taken advantage of. Since my financial standing is in good condition I had extra cash that I decided to throw at the game. Even if I didn't get it back I wouldn't care. Its just money.

All indications are that this is still a bunch of store bought assets, nothing original and absolutely no game play has been programmed. wow it took him 14 months to learn that lumberyard required you to use AWS for all multiplayer... back when I looked at it (game dev curious...) a couple of years ago I found that out in about 5 minutes... also for the "servers and server providers tend to be Linux" while true there are games like Space Engineers where even with private servers being a thing and 3rd party server providers are available to be rented... it has a requirement on Windows (due to directX)... use Linux users have to wine/proton it :P

I took down my server, if I could take my KS money back I would. The attack on Anth was the last nail in the coffin for DoD, or is it.

i have to completely agree. even the discord they use for official announcements has been 90% bad mouthing and trash talk against IGP/ICCaress/SidAlpha; let me explain, a discord used for the sole purpose of informing your client base of game addistions, progressions, and general news, has been limited to nothing but negative heresay and trash talk.
I tried to give them the benefit of the doubt and wait and see; as i have, it has sunk to less than 25ppl per day (TOTAL PEOPLE ACROSS ALL SERVERS), and is now excessively taboo to discuss the things you mentioned initially started the ban happy trend by jao.

As a programmer working on a game myself, and someone who has managed successful and unsuccessful projects, this game will never see completion unless Jao steps away and pays someone to take over the project entirely.

Years ago, this exact song and dance happened before. Some different vaporware dragon game that was designed around the concept of playing a human to build a castle, a dragon to build your treasure hoard, or a spider to build your nest/swarm. Same type of defenders here, backers who were desperate to see it finished, a developer who did barely anything and kept lying about it, and then the whole thing quietly disappeared in a puff of logic after making a shit ton of money.
Not to mention the Stomping Lands and Mesozoica
This entire situation is just insane, from the developer to the rabid fanboys hanging off Jao's proverbial teet. Hell one of them even went so far as to threaten Anthomnia's dog. The more i hear about this the more i am glad that I didn't kickstart this dumpster fire in the first place.
While I will admit, "a short drop and a sudden stop" is a bit too much, he had every right to say that after being attacked by Jao's "hit squad".
It really saddens me to see devs like this. He'd get so much support if he acknowledged he was still figuring out how to code and was open to critique on the game. Most people would understand- being a game dev isn't something you just pick up overnight. Silencing critique only hurts the game and community. There is nothing to be gained from it. Not to mention the DMCA abuse.

TechRaptor site founder here. The server changes should have had zero impact on Mellow. We’d been on the new infrastructure for almost 4 months when he tried to log in for this article, and ran into issues I tried helping him resolve. No other staff has had this problem, and because I was incredibly busy with my day job, offered him a Google Doc and that we could input and publish the article while we figured that out.
I had people emailing me for weeks about this interview (didn’t even know he was doing it) before he even tried logging in, so this is frustrating to see/hear. Especially since I was personally able to log in with his account with zero issue.

I'm slowly transitioning from disliking but respecting Jao's desire to see Day of Dragon's succeed to actively despising him. I wouldn't call for him to take a "short drop and sudden stop" yet, but he's definitely trending in that direction. Speaking of Jao, how goes your setting up the lawsuit, Sid?
Without being savvy on law, my hunch is odds are Sid's keeping his cards close to his chest, lawsuit wise. So, I'd throw a comparison to Jim Sterling's lawsuit and say that it'd more realistically be kept "cold", unless a viable case is there. And unlike Jim, odds are Sid Alpha will not have as much mercy when it comes to pursuing charges. That said, if he DOES do a Lawsuit, it'd likely be probably kept hidden? Until the case is closed, then he'd make a video. But until then, it'd be a statement made, and less video's in the short term, for however long a lawsuit lasts.

What's got me upset right now is how almost all of the recent dev updates are him showing off concept art for a ton of DLC dragons. We don't even have actual models for the dragons already in the game that aren't store assets and he's already trying to peddle DLC. It looks like he's going to make it where you can't actually have fun unless you buy these DLC dragons.

I think it’s less he turned them and that he attracted this sort crowd, kind of like how YandereDev did. Well... Technically Sid's channel is more about promoting awareness and covering important topic's within the Video Games Industry (at least that's how i've seen it the last few years), it's just that "The Dirty Dev's List" has become more of his bread n' butter of late.

He does such a good thorough job with research on topics, professional manner within his videos and the level of critique itself that he's got recognition from dev's, Valve, Epic and a ton of other people within the industry... One of the worst parts about this for me is I would love to play a game where you play as a dragon.
I remember there's a flash game that I played when I was little, I think it was called "How to Raise a Dragon" or something similar, that was pretty good. Check it out if you can, I remember it being fun. It's not MUCH of a game (it IS a 2000s flash game), but hell, it's better than Day of Dragons and has multiple endings and options available for the player.

All games use assets bought from 3rd party creators. Who cares if he outsourced all assets and even programming? He has the mandate from his donators to produce a product. Doesnt matter how he uses those resources to accomplish it.

If you hard coded banned as well. Open up the game files and see If your steam ID is in the game. That is then another Hard code ban. That's a third validation of Steam TOS

This is a different dev altogether and is not Digital Homicide (although Jim Sterling has recently made a new video about Digital Homicide reappearing).
Jao uses the money he didn't really earn to buy tons of cheap drama. What a waste!
Not condoning what Jao is doing, has done, or will do, because god damn is he terrible - I have never played this game, and now never intend to - but anyone who has seen the first Pirates of the Carribean movie can tell you that "short drop and sudden stop" refers to execution/death by hanging. Even outside of that movie, I have NEVER heard it used for "sit down and shut up". When I first heard the news of that remark, and his defense of it, I was just... cringing so hard.

NR is from a different country I'm pretty sure, terms and phrases tend to mean different things depending on nationalities. I thought he meant sit down and shut up when I saw it as well, never thought of it in relation to a Pirate movie.

This is a very tricky one indeed. Especially since the meaning of "Sit down and shut up" is actually rather new (honestly couldn't find it on the internet either however upon asking a small group of friends I have around the world I found about 1 in 5 had heard it to mean this, sadly not enough data to know if it is a cultural thing or so new it goes beyond that). The reason we didn't know it ever meant that is because we are all much more use to it meaning "To be hung by the neck until dead", WHICH is the "proper" meaning for that saying. HOWEVER... language is fluid, ever changing, and one thing I have noticed is the same goes for sayings. I have said a thing or two thinking it meant something that those around me didn't.
This does lead to one more thing to think about though. No matter what the saying means, if you say it to yourself and it in any way sounds like a threat, then don't say it.
@@hansvonheileger5791 The dude was getting harassed. At the end of the day, all he wanted was for the harassment to stop and they expressed that using that phrase. In the context it was used, I personally interpreted it as "leave me alone". As you said, language is fluid. I don't see why this is a big deal, people seem to be focusing on this and ignoring that the guy was getting harassed by a fan base and by a team of developers. Which is much WORSE than a slip of the tongue. Jao has certainly heard much much worse from disgruntled backers.

I personally do not see any issue with using store assets, to speed up your overall concept. If he did use that 500k to hire a few developers and artists, he might be able to make leaps with his game within a few months. Though it seems he didn't use it for that.. shit with 10k I could easily drop my own game much more developed this. SO I doubt he will pull a no man's sky.. I feel he will try to forever alpha/beta/EA and keep trying to get more money from this Idea of the game.. and at the same time.. his entire idea for the game isn't even well thought out in my opinion .

Thanks for all this info! I never backed this game, but I really hoped it would live up to its potential. If I had a proper computer, I would've absolutely bought Day of Dragons upon the game's completion. Dragon games like this are very rare from my understanding, and it's so sad to see this project fall so hard due to an incompetent, abusive developer. It really did have potential, imo.

I think one of the main reasons Jao doesn't have a copyright leg to stand on when it comes to taking down footage of his "game" is that he just plain doesn't own the copyright to the unmodified assets his program is made of. Although your video may not meet the "amount of material used" consideration for fair use with b-roll covering almost the whole video, your video is still transformative with respect to Jao's program. Jao's program, however is *NOT* transormative with respect to the assets he bought and plugged in, giving him no right whatsoever to even attempt to enforce his *SPECIFICALLY NON-EXCLUSIVE* copyright license.

I'd argue that the amount of footage Sid used was necessary to drive home just how empty and pointless the game is. Was it a lot of footage? Sure. But it matches how vast, yet empty the landscape is.
And that's assuming gameplay footage itself isn't inherently Fair Use. Gameplay is transformative by nature, since you're not just displaying game assets, but also your unique playthrough.
@@Greywander87 Where the line is on that is about as unclear as it can be. I can tell you this, its not "lets plays = fair use".
Nintendo's content ID claiming held up legally, as did their "creators program", as have their content claims on gameplay since the creators program shut down.
I think the real thing here is that no one has challenged it in court in a trial. What few lawsuits have been made public have self-destructed before trial. It will eventually be part of case law, not actual legal code. I think you have two extremes here. You have games like minecraft or mario maker where your personal gameplay is the only reason people are watching and you have no-commentary lets plays of games like outlast or resident evil 7 where people are only watching it for the story and your gameplay is utterly irrelevant. I think one is clearly fair use and one is clearly not.
Anyway, it doesn't matter because for these asset dogpiles, I literally don't think their game is transformative with respect to the assets they put into their particular dogpile.
One thing people might not understand is that when people license an asset like the dragon in day of dragons, its not just a graphical asset. Its basically an entire playable character with models and animations and code controlling it and the licensee does nothing except stick it in an environment asset pack which also had models and terrain generation and collision boxes and code for interaction with entities. I would bet that Jao has written less than 500 lines of code, most of which were copy-pasted from tutorials and forums. I've written throw-away projects just to test an idea that were several thousand lines of code.

I myself originally backed this game and don't want to see that wasted however, it is so backwards of what I hoped for that I have already just written it off as a bad choice and moved on. Right now I am just really excited to see this Man Baby get everything he has coming to him. I hope this lawsuit of yours happens, I hope that any further projects he's in causes future customers and project leads to lift their noses, and that he gets a giant fucking wake up call on how to be a damn adult. Just to say thank you for taking the time to do this the info is helpful when contemplating buying the game. They have no customer service and im finding very little to encouraging to buy the game due to the discords actions and the makers actions.
@Destructive_Goddess I spent a month watching the discord as I dont just dive in and buy a game, I do checks on customer service, development, and structure and the things I saw made me shudder they broke most of Discords TOS and at one point i did photo Jaos comment as he had what I would call a meltdown in chat. I tried to ask questions in the chats and was told to not talk about certain things and had to walk on eggshells in fear of being banned, I asked on thier youtuber site for a timeline on when the "place" holders would go and got told when its done it will be done. very curt and no customer service what so ever. I feel so sorry for all those caught up in this mess. Theres no way that i would invest in this mess right now.

So I have to question what do all his hardcore defenders get out of this? Anyone who has ever played a game before can tell that the game as released is unplayable as anything other than a tech demo, so it's not like they're defending a maligned developer who is otherwise producing a semi-decent game. I can't understand what kind of reward would make any of this worthwhile to them.
The only reasonable thing I can think of is rather simple....they are backers of the game who flat out don't want to admit they have been scammed. It's not a good feeling for anyone who has been taken advantage of in this way. All the other defenders in the comments, are likely Jao himself, because we know he doesn't spend any actual time working on the game.
As a backer I was originally scared when the first video was published, but after the raids stopped and progress was being made in the game everything calmed down enough to get back on track. Personally I still have a very small fraction of doubt for the game, but a plethora of evidence and content has proven otherwise. I don't feel that I was being taken advantage of. Since my financial standing is in good condition I had extra cash that I decided to throw at the game. Even if I didn't get it back I wouldn't care. Its just money.
It's porn. I get that SA is too polite to say it but they are just defensive about their ERP fetish game. Some people fetishize dragons and get very, VERY weird about it.

All indications are that this is still a bunch of store bought assets, nothing original and absolutely no game play has been programmed. It's just an empty sandbox that would barely qualify to be called a tech demo, it's not even a game. I see no reason to be so blindly optimistic, except perhaps being delusional or in denial.

wow it took him 14 months to learn that lumberyard required you to use AWS for all multiplayer... back when I looked at it (game dev curious...) a couple of years ago I found that out in about 5 minutes...
also for the "servers and server providers tend to be Linux" while true there are games like Space Engineers where even with private servers being a thing and 3rd party server providers are available to be rented... it has a requirement on Windows (due to directX)... use Linux users have to wine/proton it :P
Heh, there's no law that says servers need to be Linux. It's totally viable to make the server package for windows too, and use window server services to run them. EDIT: I mean, I agree with you, Jao is just full of shit.

Just commenting on the "dev"s comments at about 4:31 where they stated they "had" to make a Linux Server rather than their "pre-existing" (taking their word here) windows one and just pointing out an example of a game that only offers a windows server package and does quite well and has several 3rd parties offering servers for it for people to run.
