But he was charged and plead guilt to disorderly intoxication at his court date and plead guilty and currently has a suspended license for not paying his fines. Warrants are only needed for searches or arresting someone who you think is in the property. If an officer can visually see a suspect inside a building that is committing or has committed a crime, a warrant is no longer needed to enter. As he was commited and was charged for corruption by threat while in front of the officer a warrent is no longer needed. Note this holds true for florida and most states to my knowledge. Same rule applys to say dometic violence and any number of crimes that would result in a warrent no longer being needed. Tho is most cases the officers need to back up in court why the entered but in this case... it was all on camera? TLDR police can see crime infront of them? Warrent no needed.

Case will be dismissed- he will probably get 50k for a civil rights violation, at the same time he will probably be court ordered to AA if this isn't a first offense.

For real, I used to work at McDonalds. I have watch buns with ketchup hit the floor and then go out the door. Ive seen yellow salty liquid added to lemonades as a "free drink" to the a-hole. No, for 2 reasons. 1) It's not trespassing, the cop had probable cause and didn't need a warrant, as soon as he was assaulted in the first 5 seconds of the video (several times). 2) Even if someone does trespass, that does NOT activate any right to kill them in Florida, even though it does have a castle doctrine law. You must have a reasonable belief your life is in danger to use that law. If the cop simply calmly walked inside without any threatening anything, and he shot him, that would be murder, castle doctrine or not. It would be a basis for a lawsuit, but not killing. So EVEN IF he had specified "I'll rip your head off IF you come inside" (which he didn't specify at the beginning, watch it again), it would STILL have been felony assault, and given probable cause. The guy is a dangerous idiot, should be a felon, and hopefully he gets disbarred.

Unlike in a citizen's arrest, there is no mistake as to the purpose of force used by an officer, thus one can't claim a lack of awareness when force is applied. LE must be given certain amounts of leeway in legal enforcement, but as a consequence of that, they must be held to the strictest standards, should they break any laws.

I just found that his mother(or sister) died and that he was charged with disorderly intoxication but was dropped on any other charges he had. He did not really do anything bc ig he knew that they could go further than that due to the death threats he made not only to the sheriffs, but to the neighbours who knocked on his door earlier in the day. Not sure tho

No, for 2 reasons. 1) It's not trespassing, the cop had probable cause and didn't need a warrant, as soon as he was assaulted in the first 5 seconds of the video (several times). 2) Even if someone does trespass, that does NOT activate any right to kill them in Florida, even though it does have a castle doctrine law. You must have a reasonable belief your life is in danger to use that law. If the cop simply calmly walked inside without any threatening anything, and he shot him, that would be murder, castle doctrine or not. It would be a basis for a lawsuit, but not killing. So EVEN IF he had specified "I'll rip your head off IF you come inside" (which he didn't specify at the beginning, watch it again), it would STILL have been felony assault, and given probable cause. The guy is a dangerous idiot, should be a felon, and hopefully he gets disbarred.
