The case actually relates to a type of trust called common intention constructive trust.
The courts hold that the parties intention was not to divide the property equally but to divide the property according to the proportion of their shares. The courts inferred their intention from the fact Ms Stack and Mr Dowden had separate finance accounts and their finances had been independent.
