I'm disappointed that Depp settled because of the larger implications of the case. But I understand why he doesn't want to spend the next eternity footing the bill for this thing, and just wants it to be over. He got his vindication. For him it's not about the money he could get from her. So I understand him bowing out when given the option, as continuing might undo the work that the case itself did.
But dear God, after watching Amber testify on the stand I did not want her to win. I came in with no opinion of her one way or the other, and she was so clearly a liar and a bully that I dislike her walking away with money in her pocket and media contacts left who are willing to spread lies about and cover for her as a domestic abuser.

But somehow this still doesn’t seem like justice. I’m assuming the judgement still stands but I still think he held the ace cards there and could definitely have enforced a well thought out NDA with serious penalties written into it. It just feels a bit wrong although I also understand that he must be feeling absolutely sick of it. Just because a settlement has been reached it doesn’t mean any problems will be ultimately solved because she can still say what she wants and continually defame him for the rest of his life. • @deang5622
      @deang5622 Рік тому +1

      @@thekitowl Hold on.
This "settlement" is not a conventional settlement. A settlement can be in court or out of court. If it is out of court then the details are not usually published.
This case was decided upon by the judge, it was an in-court settlement. The court issued a judgement order for just over $10 million.
What this is, is a separate out of court settlement, which doesn't settle the case, as that has already been done and done by the judge in court.
This is a private agreement (that's probably a better term than settlement) between Depp and Heard where she has almost certainly said to him "I can't pay you $10 million, because I don't have it".
And he has formed an agreement with her where he says "I will accept less than the Court has ordered you to pay me, I will accept $1 million and in return for letting you get away with less, you (Heard) agree not to take the case to appeal..(or other other similar requirement)".
Now he didn't have to form any such agreement with her, as the Court ruled on the case and passed judgment and in favour of Depp, so Depp has the full power of the Court to take enforcement action to recover $10 million from her.
The fact she couldn't afford to pay $10 million is immaterial, he could have taken enforcement action and recovered a sum, a sum which she could afford, and then he not take any further enforcement action.
So there was actually no need for him to enter another private agreement with her, which begs the question why did he?
A gagging order is simply a private agreement between two parties, where one party agrees not to talk to anyone about a particular topic and in returned for their silence they are paid a sum of money. Their silence is bought.
That gagging order is then legally enforceable, meaning if the person gagged breaks it, they can be taken to Court. It's a breach of contract. They were paid to keep silent, and they agreed to that condition.
So nearly there... As that gagging order is a private agreement between two parties, I don't see why a gagging order could not be written up to benefit Depp and require Heard to stop talking about the topic. The benefit to her in signing such an agreement is that she benefits to the tune of $9 million, which is the difference between the $10 million she was ordered by the Court to pay Depp and the amount he finally agrees she should pay him.
So I am not convinced by the claim it wasn't legally possible to issue a gagging order.
If she doesn't shut up, them she leaves herself open to further defamation claims by Depp and possibly even a restraining order.
Now, as for publishing the settlement, this appears to be a private agreement between Depp and Heard to allow her to avoid paying the full Court Judgment Order amount of $10 million, and if that is the case, and that there been no successful application by either party to modify the judgement amount, then this is purely a private agreement not involving the court and there is no obligation for Depp or Heard to publish details of the agreement.

This is clearly a decision made by her insurance company, not her - she can't afford to continue to case without them. It would be interesting to know the details of the agreement with the insurance company. What are they getting in exchange for the $1m payout? I understand they weren't on the hook for the damages, since they resulted from a deliberate act, and they were arguing in court that they weren't liable for her legal fees either. Are they now accepting liability as part of this settlement? In addition to the payout to Depp, presumably they are going to be paying Heard's legal fees.
I guess if they think Heard can't afford to reimburse the legal fees even if they are successful then it doesn't make sense to fight it.

And for her to say that the UK trial got it right, and that the US trial got it wrong, makes it sound like she won in the UK as they ‘proved’ she was ab**ed by JD and that the US should’ve done the same but since she lost in the US trial, the US isn’t fair like the UK is within the court system & so she’s lost faith with the US justice system. She says she stands by her truth and was tired of being harassed for doing so. This is a ridiculous statement and I can’t help but wonder why in the world Johnny Depp agreed to this.
