    I get asked a lot about whether being a practicing attorney is like being a lawyer on TV. I love watching legal movies and courtroom dramas. It's one of the reasons I decided to become a lawyer. But sometimes they make me want to pull my hair out because they are ridiculous. Today I'm taking a break from teaching law students how to crush law school to take on lawyers in the movies and on TV. While all legal movies and shows take dramatic license to make things more interesting (nobody wants to see hundreds of hours of brief writing), many of them have a grain of truth.

      Objection!! You need to watch at least a season of Damages to really, really get what's going on and why Patty is just hideous. This isn't really a legal drama or about a lawyer it's about a narcissistic sociopath who happens to be a lawyer. Patty doesn't care about the law she cares about winning at all costs.

    Do the movie "Philadelphia"! I know I'm probably the only person who requests this, but it's the only movie I've seen where a lawyer actually asks the judge to go into the well. And there's a lot of things that *seem* realistic and it's based on two real cases and I want to know how realistic it actually is. Plus, Tom Hanks! AND Denzel Washington!

    There is a Star Trek: The Next Generation episode called "Measure of a Man" that is about a legal case in Starfleet about the rights of sentient beings that I would be interested to hear your thoughts on. While it is not the U.S. Justice System it is clearly based on those values. It has a lot of aspects of legal arguments that I would be interested to hear you explore, even if it doesn't quite fit the U.S. legal system.

      It would be nice to get a bit of comparison between English Law (there is no such thing as British Law, England, Scotland, and Northern Ireland all have distinct legal systems and to a degree differing laws) and US law. There was a very good 1962 movie called "The Boys" which showcased English courtroom procedure, that would work great for a comparing the systems.

      It is indeed reasonable foreseeable that releasing such a good video would lead to any person damaging their fingers from clicking too quick. I'm also aware other persons have been been harmed by this gross negligence; as such, a class-action lawsuit should entail.

Is that the kind of advice you'd give a client? "Make sure you don't have any obvious signs that you're guilty on you."? Hahahaha! Delightful!

    Damages is one of my favorite shows ever, but when I saw the first episode even as a non-lawyer I thought it was weird that Patty was going through all this convoluted scheming just to get a witness to testify. I was glad though that Patty had an ulterior motive for hiring Ellen, even if that ulterior motive was implausible, rather than the silly and cliched idea that Patty was just so intrigued that she turned down the interview that she had to meet her.

      It’s actually not that implausible. She could have subpoenaed Katie but that doesn’t mean she would have been forthright in her deposition. Patty had to give her a reason to want to testify.

      @@jonnyc4241 yes and no. The Objection goes to the judge to say if it's a valid argument (sustained) or not (overruled)... Normally, a lawyer has no power to do so (in this case, our host is acting like the judge, and we are the lawyers).
      I believe the best way to say you agree would be "I second the motion"

    Objection. Threatening people tends to harden peoples' resolve, killing their dog is more likely to ensure someone testifies than dissuade them. It is the same reason torture does not work, people then are more motivated to spite the person doing the threatening. It is a trope I wish would die.

      I feel the same way about the "torture does not work" meme. There are many good reasons to be skeptical of the use of torture from both practical and ethical perspectives. However, there is no shortage of documented cases where people were tortured for their PIN number and give it up. This is valuable information they were highly motivated to protect.
      Torture is not problematic because people are unresponsive to pain. It's ineffective because somebody who's tortured will say whatever they think the person wants to hear, which severely limits their value as a source of intelligence.

      @@saraha180 it's also possible to verify quickly and with absolute certainty the pin number.
      What if there were two pins? Both gave cash, but one alerted the price and retained re order video? So you had no way to know if you got the safe pin or the unsafe pin?

    I think for a show like Damages, the pilot doesn't reveal much. Though it is emphasised throughout the series that Patty's objective was not justice for the 'little guys' but to win at all costs and to enjoy the thrill of doing whatever it takes to win, her methods and thinkings are still insane, compared to IRL people. The situations and details in the shows were definitely designed to heighten dramas for a TV show, more so than a realistic depiction.

    I'd love to see you do episode twelve of the first Psych season. It's a great episode taking place mostly in a courtroom. It also is the first place I heard the term "legal eagle"

    I love this show! It's so hard to breakdown the episode until you've watched the whole season, because everything is not as it appears.

    Finally you made a vid about Damages! It's one of my favorite shows! The show is mostly about witness blackmailing and negotiations (which are super entertaining because of Patty Hughes, who is this likable monster lawyer).

    @LegalEagle Can you cover some historical trials? The tobacco litigation for example. There's some good scenes in The Insider (1999) both with a deposition and talking about NDAs if you need a movie as backdrop.

    It must be rewarding to successfully finish a case after multiple years of hard work. I can't image the thousands of hours put into learning to become, and practice law. It's incredible.
    Recently a friend of mine finished writing a novel he spent four and a half years writing. Afterwards he said he woke up in the morning often feeling sad that it was finished. He said writing it became his whole life, and now that life was over.
    I can't imagine the character required to be so committed. It must be amazing.

      @@bernlin2000 While it's possible to claim false advertising, that specific incident gets interesting when you try to calculate damages. Basically... there aren't any. The bags people got aren't shoddy junk, the only question is whether they can be accurately described as "canvas".

    Can you do a LegalEagle review of Daredevil season 3? The ending has Nelson and Murdock working together again, and a testimony goes before a grand jury, and then there's a dying confession that (if I understood the legal jargon) bypasses the hearsay restriction. Also, it was a really good season! You should watch it. :)

    This has been, hands-down by far, THE best episode thusfar. The jokes were on point. The reactions were great. The overlay of "never mess with anybody's dog" was solid.
    The "That's weird" reaction about the veganism, the "WHAT IS SHE SIGNING!!!" and the outrage about the "She's a blank slate!!!" girl were all SO GOOD. Man, what a gem! I actually had to re-watch that middle part of the episode again to laugh at the eye rolling and general disappointment at the scenes LOL
    Keep it up!

    Just wanted to let you know that I love your videos, I am currently a Mechanical Engineering major but I took law courses during high school at a vocational school for about three years. I always found law really interesting (especially case law and what occurs in the court room), but decided to become an engineer due to the fact that I thought it would fit my skills more; your videos are really entertaining and I love the work you do.       Probably a mix of both?
      Big, complicated cases would probably take a lot of time, but I've heard that many parts of the justice system are pretty overburdened as well.

      sander heutink makes you wonder why the justice system is so burdened. Is it too many frivolous cases or too many cases in general? Or, as stated by OP, is it just the nature of litigation in an increasingly complex legal system?

      @@albaniaball5764 Frivolous cases really are not much of an issue as it is hard to find lawyers willing to actually take them and often they will just be thrown out before it even gets that far. It's like how people think there are lots of ridiculous law suits for damages which is something spread by large companies to discourage people from suing legitimately. Even the McDonalds woman that gets thrown about a lot was a really serious and important case where McDonalds acted ridiculously and the woman just wanted her medical costs covered for her severe burns.

      @@jetfirexx Good old hot coffee case - one of the most widely misunderstood cases in American jurisprudence. But apparently that's what you get when you settle with a confidentiality clause - the company takes control of the narrative and lies through its teeth to push for tort reform

    Objection: 3:20 2 other reasons besides dollar amount itself to be awarded: 1) Trials can take eons and the defendant pays the legal fees, and 2) If the court reaches a verdict, the amount awarded is public knowledge. If you settle, one condition that corporations negotiate is to keep the amounts hush-hush.

    I would like to see you react to the tv series Bull. It is a series I find very interesting and was wondering how close to real it is. It is about cases inside and outside of a courtroom and it holds lots of information about cases and going from open to close.     Really loved the first season of this show, very compelling personalities. Glenn Close is incredible, as always, and a really terrible character (move over "Devil's Advocate"). 13:30 You figured that out pretty fast...that's pretty much what her character is. Tainted by the world around her, but pretty blank herself. Close's character puts her through the ringer in the first season.

      No, he was referring to Rose Byrne's Ellen as having no redeeming qualities and being the blank slate which means she is undefined in character. Patty Hewes is plenty defined and quite stereotypical.

      I think it's masterful that Ellen starts off as this naive blank slate that makes her a perfect target for Patty's mind games, only for it to backfire later as she grows into a formidable foe for Patty.
      This show is fantastic.

    All your videos are great, but this was the best one because:
    1. As you said, in the beginning it is a true depiction legal "stuff" - the case, etc.
    2. It tanked in the second part - for bad lawyering.
    So, in both cases, I learned a lot.
    Watching you watching the show and making commentary would be, for me, more interesting than watching the show.
    Question: if I'm subpoenaed as a witness for a disposition, do I have to talk? Can I respond by saying I'm not interested, I'm sorting my socks that day?

    Wow! You know the guy that litigated the Monsanto (now owned by Bayer) case? That case was tragic! That poor man... I definitely feel for him & his family.

      Except...the scientific and skeptic community thoroughly tore apart that case. The condition the guy is suffering from is impossible to have obtained from his work with glyphosate, as it would have developed several years prior to him working as a groundskeeper. It's not like you can use any chemical and suddenly get non-Hodkin's lymphoma within a year. It's not a medical possibility.
      And the guy's own lawyers in the case presented a timeline that showed that he knew he was developing it prior to the job, funny enough.

      @@SCP-5000 Yeah, basically. And just that the guy's own lawyers kinda torpedoed his own case on the basis of the timeline of development of his lymphoma. It's one of the reasons why the higher level court drastically reduced the liability payout.
      The problem is that the case wasn't based around actual scientific evidence, but an emotional storyline (which admittedly is rather effective on a jury). The only "science" that was brought up was the IARC report, which has been debunked six ways to Sunday by this point.
