    Hello! I have a question, how many times they can apply the 2 years rules in a J1 visa? Because I made the program 3 times and they applied the 2 years rules in my first J1 visa so I’m wondering if they can apply it again in the future in my next j1 visa?

      Hello. You can be subjected to the 212e rule for each J-1 visa program that you participate in.

    Hi, thank you for the nice and informative video. I'm holding a J1 Visa and my wife has a J2 Visa. We are subject to the 212e rule. She wants to change her J2 to F1. Can she go to a consulate in Mexico to do the change without a waiver of the J Visa? Thank you in advance for your reply.

      Hello and you're welcome! The 212e rule doesn't have any restrictions on the F-1 visa, so a waiver wouldn't be necessary.

    Thank you for the information! I had a R-J1 visa for less than 3 months. I have the 2-year rule because my finances came from my government. Now, I have been selected for a postdoc. Can I apply for a second J1 without applying for a waiver? If I need to apply for a waiver, the university can not wait for me more than six months. Is it possible to obtain the waiver in less time? My previous scholarship does not require me to homestay. Thank you for your appreciated help!

    Hi, I just finished my J1 visa trained program in the USA. My schedule was extended, so Instead of 12 months, I did the program for 18 months. My question is that my visa stamp said I am subject to the two years, but my DS 2019 said I am not subject to the two-year home requirement. How do I know which one is correct?? Please let me know your thoughts on this, and thanks in advance for your response.

      Hello Walder, since you have conflicting information on your documents, you can ask for an Advisory Opinion from the Department of State and they will inform you if you are subject or not.     Thanks for the video. In my case , my husband J1 has fulfilled his 2years home requirement but I did not since I went in our home country later due to a medical condition. Given that my husband (previous J1 holder) has fulfilled his 2 years , how can I apply for a J2 waiver ?

    Hi thanks for the J-1 visa info! It was super elaborative. I have a question on my J-1 visa: I went to the US with a J-1 visa over the summer of 2022. I am subject to the '`two year homestay requirement' as the notation on my passport reads it. However I decided to terminate my program two weeks after its start date and I went back home right away. It was a 3 months long program. My program providers told me that I will be subject to the two year rule and I understand it. However my J-1 visa was a year long. It expires in August 2023. My question is: can I travel back to the US with that J-1 visa since it's still valid? and if you have time, I would like to know if a waiver application is possible since I did not complete the program. Thank you and I look forward to your answer when you are able to do so.

      Hello. I'm glad you liked the video! No, you will not be able to travel on the J-1 visa you have as your J-1 visa program has ended and your SEVIS record is shortened as well. Without a valid DS-2019 form, you will not be able to enter the U.S. on the J-1 visa that you have. Yes, you can still apply for the waiver. Good luck!

    I have a question regarding re-obtaining a J1 visa before the 2 years home residency is fulfilled; for instance If a finish a professional fellowship sponsored by te US government under a J-1 visa, will I still be eligible to apply for other government programs like the Fullbright Foreign Student program? and will I be able to re-apply for the J-1 visa before fulfilling the 2 years home residency policy?

      Yes, the 212e rule doesn't prevent you from getting a J-1 visa. It's for immigrant visas such as the H-1B or a green card.

      Hello Pavel. Your compliance is not being in the U.S. on the specific visas that are limited during this time. In addition, you can also show proof of where you are currently living (lease/mortgage, job contract, etc).

My program ended in November 2023 and I’m already back in my home country. I got a job opportunity and the company offers H2B visa. Do you know If I can do the waiver from my country?     Thank you for sharing this video. I do have 1 question that I cannot seem to find the answer to. Can you apply for a green card at the start of the 2 year home residence fulfillment or does it have to be at the very end? I am hoping that I can apply for a green card for my fiancee when she starts her 2 year home residence so that the green card can be ready to go at the end of her 2 year stay.       I don't specialize in green cards, but I do believe you would need to wait for the entire 2 years or obtain a J-1 waiver before starting the green card process. You should consult with an immigration attorney that specializes in green cards. Good luck!

    What's home country? Is the nationality at admission to US or current nationality? I have lived in another country after J1 and changed my citizenship.

      Hello. In general, your home country is the country of citizenship that you applied for your J-1 visa with. If you have changed your citizenship after your J-1 program, your home country will probably be your first country of citizenship before the change.

      @@BobCao There are other types of waivers besides the No Objection. If your government won't provide you the no objection letter, then no, you won't be able to get this type of waiver.
      Visa to go to your own country of citizenship? You should be able to return with your passport. If you're unable to, then no, you will not be able to fulfill the requirements.

    Hi, I've had two sponsors of J1-- the first one was the US government (Fulbright) and currently a private international school+my home country's government. The 212(e) was initially attached from the Fulbright program. If I were to apply for a waiver, do I need the No Objection Statement from both my former sponsor (Fulbright) plus my current sponsor(home country), or do I only need to provide NOS from my current sponsor?     Hi, I was in usa in the period between 2016 to 2018 as researcher, and I moved immediately to india as home stay requirement. Later, in 2021 August I was back in the same j1 category. Actually, the j1 period is for 5 years . My question is the present j1 accounts from 2016 or the j1 visa obtained in 2021 will be the fresh visa. Expecting your reply.

      @@balajeeramachandran2141 If you are not subject to the 212e rule, you won't need a waiver. If you are unsure if you are subject to the rule or not, you should get an advisory opinion. Once it's been confirmed you don't need a J-1 waiver or No Objection statement, you can potentially apply for H-1B.

      The 212e rule only applies to U.S. visas. I can't speak to your specific requirements since your bond might have other stipulations that rule 212e doesn't have.

    Hi Avery - Thank You! Using a J1 Visa I entered the USA in Nov 4, 2022. I was told at the port of entry that my immigration status was inactive because I was late for the J1 program. I returned to my country on Dec 3, 2022 in Good standing.
    Recently I was refused an F1 Visa at my interview, reason being that I'm subject to 212(e).
    Even though I didn't participate in the J1 program due to invalid j1 status upon arrival, am I still subject to the rule?
    If yes, should the 212(e) be a reason not to acquire an F1 visa?

      Hello. You should speak with your J-1 visa sponsor to get a record of when your J-1 visa status went inactive. If you were in the U.S. for a minimum of 1 day in J-1 status, you could still be subject to the 212(e) rule. The 212(e) rule doesn't apply to F-1 visas. Good luck!

      Hello and thanks for watching! Yes, a J-2 dependent can travel abroad. There isn't a known specified time but if they have no plan on returning to the U.S. the J-2 program should be ended.

    Could you help me, please? Last year I went to the US with a J1 visa - short term scholar (6 months) from january to july 2022 to carry out research and after that I returned to Brazil where I defended my PhD. I recently received an offer to return to the US in July 2023 on another J category - visiting professor, however I have a 212e barrier because my skills and government fundings. I have already completed 1 year of permanence. Could I return to the US even though I haven't completed the two years with another type of J visa or should I apply for a waiver?

      Hello. If you are using less than the maximum duration of stay, then yes you should be able to.

      Hello. If your husband's J-1 program is still valid then your J-2 program should be valid too. You will need to ensure your DS-2019 is up to date and has a valid travel signature and your visa is still valid. As long as his program doesn't end, yours won't either. I hope this helps.

    Hi. i had been to United States 0n 2018 in J1 visa for six months and after completing my period i went back to my country Nepal. After two months of staying at home i came to Denmark to complete my studies and currently i am staying in Denmark. Now its 2022 and i would like ask if i can apply for work visa or not in the United States ? As two years home rule i have to stay at my country i guess but i am in Denmark so how it works please assist.

      Hello. If you were legally residing in Nepal before your J-1 visa program, then Nepal is where you should fulfill your two year home residency requirement if you were subjected to it.

    Hi! Thanks for this awesome video! I finished my scholarship in March 2020 so my two year rule would end in March 2022. I was in the US for a few weeks vacation since then. Will these weeks be added on top of my two year rule?

    I have a question. What exactly does indirect funding mean?
    I receive a stipend from my supervisor from Harvard Medica School. Harvard Medical School is a private organization and not related to the US government, but it turns out that my funding source is NIH which is from the US government.
    Do you think I am likely/not likely to be subject to two year home residency?

      Hello. This is an example of indirect funding since ultimately the funding source is NIH, which would be government funding even though you're getting paid by Harvard. This will probably subject you to 212e.

      I think I might not have correctly explained my case.
      My primary sponsor is Intrax Inc. which is an international company, and my DS-2019 letter was issued by this company. In my DS-2019 letter, my source of funding is mentioned to be Brigham and Women's Hospital Inc. + personal fund. This is all that is mentioned in my DS-2019 letter.
      However, I found out that my supervisor at BWH inc. is supporting me through NIH funding, but there is no mention of this in my DS-2019 letter.
      Yesterday, I also contacted NIH to see if this could be counted as indirect NIH funding, and they responded that I needed to reach out to my sponsor (Intrax inc. in my case) as my DS-2019 was not issued by the NIH. Due to this response, I kind of gained the impression that my case was not counted as indirect funding.
      I then reached out to Intrax Inc. to ensure this, but they did not provide me with a clear answer. They just said that they could not advise on these immigration inquiries.
      Considering the above clarification, do you still think this is an indirect way of US government funding and I will probably be subject to 212(e)?

      @@azimparandakh2952 Hello again. If it's not stated on your DS-2019 form, it doesn't seem to be categorized at government funding. According to your documents, you are being paid by private institutions, so you may not be subject to the 212e rule. A final decision will be made when you have your visa appointment. Good luck!

While i am also applying for my medical post graduate training program for which my visa will be sponsored by ECFMG. So is it possible for me to get ecfmg j1 visa after bieng to US (for 3 months fellowship on j1 with 212e) without completing 2 years home country stay clause...
      Kindly make it clear if someone is subject to 212e, what are the tyoe of visa if s/he get back to us within 2 year...?

      @@iqbalhussain2924 Hello. As stated in the video, being subject to rule 212e means the person is ineligible to return to the U.S. on a H, L or LPR (green card) visa until the two year home residency requirement has been fulfilled or the waiver has been granted.

    Hi, I have a question im applying for an exchange program which requires a j1 visa! My question is, after my echange program ends in the usa and I get back to my country I know I wont be able to re-enter the usa for 2 year but Can I still travel to other countries other than the usa for periods of time, I am asking since possibly after my ecchange program in the usa I might need to travel to other countries from my home country because of the social programs I work with it wont me much time maybe a week or two every couple of months,
    this visa requires me to stay in my country for 2 years , or it just does not allow me to reneter the USA

      Yes, you're permitted to travel to other countries. If you are subject to rule 212(e) you must remain in your home country for 2 years before you can apply for an immigrant visa. You could obtain a waiver to not be subject to this.

      Hello Monica, if you just finished a J-1 visa internship, you will have to wait 2 years before you can start a J-1 visa traineeship. But this is a separate rule that is not 212(e).

      If you're currently living in a EU country then you can return there. I can't speak to eligibility requirements for universities outside the U.S. Good luck!

However, if in the future I decide to work in the US, then prior to that trip I need to stay in my country of origin for 2 years. So, 2 years home country recidence requirement is not immediate after coming back from the US, , but needed to be fulfilled in home country only even later to be sufficient . Is that true information?

      @@JoE-yb7yc You will need to return to your home country or country of legal permanent residence in order to return to the U.S. If this isn't an option, you can always apply for the J--1 waiver.

      Hello Jerome. Unfortunately yes, 212e still applies even if you married a U.S. citizen. The only way to get around it is with the waiver.

    I went to the US last year for 8 months on a J1 visa as a research scholar at the Auburn University, and I'm subject to section 212 (E).
    I have a proposal to return to the same University with the J1 visa, but as a specialist.
    I would like to know if there is a possibility for the embassy to grant me a visa?
    There is also a question on Form DS-160: Are you applying for the same type of VISA? (Yes or No) I'm not sure how to respond as I'm actually going with the same visa but with a different major.

    Hello, thanks for this video.
    I am starting a J1 trainee program in June under the education bracket. I’m from the UK so I don’t think the 212(e) rule applies to me. However, you talk about another two year stay at home rule. Will this apply to me? Would I be able to participate in another J1 program such as J1 teacher, camp counselor or intern after I complete my 18 month traineeship or is this other two year stay at home rule uniform for all trainees?

      Hello Andrew. As you mentioned, you probably wouldn't be subject to the 212(e) rule as you mentioned, but make sure to check your DS-2019 form and your J-1 visa once it's issued to confirm. You must wait 2 years if you wish to repeat another J-1 trainee program but don't have to wait if you wanted to do a J-1 intern program.

      Hello. I don't know your background but if you have been previously subjected to the 2 year rule, you would need a J-1 waiver in order to return on a J-1 visa again.
