  • On October 7th, 2023, an officer in Ohio was on patrol when a black Chevy was observed running a red light at a local intersection. The officer followed the vehicle as it pulled into the driveway of a residence. The female driver exited the vehicle before the officer approached her, leading to a direct interaction. Upon speaking with the driver, the officer noted signs of intoxication, including slurred speech and a strong odor of alcohol.
The driver told the officer she did not know she had ran a red light, stating she was unsure where she was coming from. Despite the officer asking the driver how much she had had to drink, she stated she had come from a friend's house, later admitting to having a shot of liquor. The driver refused to undergo Standardized Field Sobriety Tests (SFSTs), asserting that she was already home and the vehicle was not in operation. The officer, citing probable cause, placed the suspect under arrest for OVI.
During the arrest, the suspect was informed of her rights and the legal consequences of refusing a breath test, to which she remained uncooperative and refused to comply. The suspect refused to sign the necessary paperwork and grabbed the officer’s pen from her hands. Consequently, she was transported to jail. The female suspect was charged with Operating a Vehicle under the Influence (OVI) and Failure to Obey Traffic Control Devices.

The cop was not great. I don’t know what standard you’re holding up here, but she was very unprofessional. She got increasingly irritated throughout the encounter, promised to release the suspect to her mom after she drove drunk, then changed her mind because a DRUNK kept asking a question that the cop had only ever answered with a quick burst of cop jargon. Maybe the lady didn’t know what OVI meant. She indicated as much at one point. Maybe her memory wasn’t great because she was plastered!
If the cop had just answered her by spelling out that she was going to jail because she drove drunk, and the woman continued to resist, she could have informed her that she would be arrested unless she complied and THEN done so in a calm and professional manner. The only reason they had to persist in refusing to answer the question was to try and prove who was in charge. And the only reason she gave for retracting her promise to let her go was that she was rude to her.
Cops, male or female, whose bruised egos and impatience inform their actions don’t belong on the force. Police should expect to be held to a higher standard of conduct under the strain of rude behavior considering the nature of their work.

Let me translate this logic for you... "You committed a crime"
"But I'm not committing a crime anymore, so you can't arrest me."
"But I already caught you committing a crime."
"But I'm not now, so it doesn't count anymore."

I'm retired law enforcement and still am a reserve deputy and Louisiana State Special Officer and I lost count of how many people think they know their rights or because they are home they can't be arrested. I have had many people use their phone before we could stop them and call people to come to the scene to help them. I have arrested multiple people showing up to the scene and even had some violent encounters. I personally will not allow it as safety to myself and other officers.

Once this gets to the Tag committee qualified immunity is out the window.

She wasn't going to let her get off the drunk driving charge. She giving her the OWI citation either way. She was deciding whether to release her to her mother or taking her to jail to process her. The latter consisted of drying out in a cell and possibly having to post bail. Had she signed that paper promising to appear for court, it might have been a different story.
