@@fruitsalad5802 not quite my point. sure, not all presumption is hubris, but all hubris is presumption, so presumption is literally just not a defense. you were better off pleading the fifth on that one but whatever, you asked a question. ignoring the error in your wording, probably not. the stakes aren't high enough to warrant extra care, and noticing the existence of an object in plain view barely qualifies as a skill to be overconfident in. one can make the argument that it IS hubris, but the debate would be pedantic and obnoxious and just suck but if im RUNNING down the stairs bc im impatient, fast enough that a bad landing would ruin my ankle, then my hubris 100% earned my sprain ... then again, if im being chased down the stairs by a murderman, then definitely not, the risk is harder to evaluate and my brashness is extrinsically motivated
