Things worth mentioning that weren't in the video: The employee was actually the manager of the store, and his finances are directly tied to the success of the store. He's a veteran, served for 10 years. Has a wife and two daughters. The only reason he even had the gun is because his store was robbed another time before. The criminal was accused of doing the same thing at another store in the area, for pokemon cards worth ~$500, which is less than what he attempted to steal this time. In summary, nobody looks good here, but I'd say the employee has a shot at getting reckless discharge of a firearm and reckless endangerment, maybe less with a good lawyer.

Reason he shot the thief was because his financial stability was already trickling away as is.

This is a tricky one. For starters we have so many laws that protect criminals more than law abiding citizens. I mean bottom line is you shouldn't steal, at the same time the employee could have used less drastic measures, you also shouldn't shoot someone when their back is tuned otherwise YOU look like the bad guy

As much as i agree that this was waaaaaaay too much of an escalation, i don't think people are judging the employee fairly.
Speaking from experience, when you're being robbed, there's a thousand things going through your head. You don't know what the robber will do, if they might have a hidden weapon, if something entirely different happens, it's too much for someone to go through.
Of course, with the benefit of hindsight, we can say that the guy was unarmed and only wanted the pokemon cards, but in the heat of the moment it's chaos for every party involved.
